Sullivan, III, Division Administrator Federal Highway Administration PROJECT COMMITMENTS: Addendum to CE TIP No. I-3802A/ B-5984 Replace Bridge No. 56 on SR 2000 (Brantley Road) Over Lake Fisher in Kannapolis, NC The following commitment is new and specific to the bridge replacement. Design Team — Bridge Rail Because the bridge may be widened in the future to include a sidewalk on the north side of the bridge, the rail type and height will be appropriate to coordinate with future pedestrian use. The list of environmental commitments provided in this section was taken from the 2013 CE. The status of each commitment is indicated in italics after the commitment. Roadway Design Unit, Hydraulics Unit, Structure Design Unit, Division 10 — Provisions for Greenway The proposed new I-85 bridges over Irish Buffalo Creek will be designed with adequate vertical and horizontal clearance to accommodate the future Irish Buffalo Creek greenway crossing under I-85. Coordination with the local municipality will be performed during design of those bridges to ensure they are compatible with the future greenway crossing. The bridge c�ossing Irish Buffalo Creek was designed to have sufficient length to accommodate a ten foot wide future greenway on the north side of I�ish Buffalo Creek. Project Development and Environmental Analysis Unit — NEPA/Section 404 Merger Process NEPA/Section 404 Merger Concurrence Points 3(Least Environmentally Damaging Practicable Alternative) and 4(Avoidance and Minimization) will be completed far the project. A meeting to discuss Concurrence Points 3 and 4 was held on March 13, 2014. Concurrence was reached at the meeting. Project Development and Environmental Analysis Unit, Division 10, Roadway Design Blake House, Goodman Farm, Caldwell House and Barrier House Blake House, Goodman Farm, Caldwell House, and Barrier House are National Register of Historic Places (NRHP) eligible properties. These properties are located within the project's Area of Potential Effects. Currently, the proposed project will have No Effect on the Blake House and Goodman Farm and No Adverse Effect on Addendum to Categorical Exclusion Page 1 of 3 Green Sheet March 2015 Caldwell House and Barrier House. If design plans change near any of the properties, impacts will be re-evaluated and appropriate coordination with the Department of Cultural Resources will be undertaken. Additional analysis and coordination were done for the proposed design modifications. There will be no effect on any historic resources. North Cabarrus Park North Cabarrus Park, owned and managed by Cabarrus County, is located on the west side of I-85 near Irish Buffalo Creek. No additional right-of-way or easements are proposed along I-85 on park property; thus, the project will not impact North Cabarrus Park. If design plans change and result in impacts to North Cabarrus Park, a Section 4(� evaluation will be prepared. The proposed design rnodifications will not affect the park. Hydraulics Unit — Floodplain Mapping Program Coordination The NCDOT Hydraulics Unit will coordinate with the North Carolina Floodplain Mapping Program (FMP), the delegated state agency for administering FEMA's National Flood Insurance Program, to determine �he status of the project with regard to the applicability of NCDOT's Memorandum of Agreement with the FMP or approval of a Conditional Letter of Map Revision (CLOMR) and subsequent Final Letter of Map Revision (LOMR). Two FEMA crossings, Irish Buffalo and Cold Wate� Creek were impacted. An MOA Type 2 app�oval was obtained. Divisions 9 and 10 — As-Built Construction Plans The Divisions shall submit sealed as-built construction plans to the Hydraulics Unit upon completion of project construction, certifying that the drainage structure(s) and roadway embankment that are located within the 100-year floodplain were built as shown in the construction plans, both horizontally and vertically. The Team will work with the Division to obtain as-builts of the constructed bridges and will review for cornpliance with the construction plans. Division 10 and Roadside Environmental Unit- Landscaping NCDOT will provide vegetative screening along the Dale Earnhardt Boulevard southbound off-ramp, which utilizes Jaycee Road. This concmitment is no longer applicable with the design modifications. Congestion Management Unit — Interchange Modification Report Due to the proposed improvements at the I-85 interchanges in the study area, an interchange modification report is being prepared and will be submitted to the Federal Highway Administration for approval following completion of the final environmental document. This report has been completed and will be submitted upon approval of this consultation form. Addendum to Categorical Exclusion Page 2 of 3 Green Sheet March 2015 Design-Build Unit During Final Design, NCDOT will investigate the feasibility of a roundabout at Vinehaven Drive and Copperfield Boulevard. NCDOT determined that a roundabout at this location is not feasible. NCDOT will provide a leftover from northbound US 29-601 (Cannon Boulevard) to S. Ridge Avenue, and will provide access from Ridge Avenue to the Rider Transit Center. The proposed roundabout on S. Main Street will be removed from the design. This commitinent is no longer applicable with the design modifications. NCDOT will connect S. Ridge Avenue to US 29-601 with right-in/right-out access. This commitment is no longe� applicable with the design modifications. NCDOT will provide full access at the intersection of Old Earnhardt Road and Dale Earnhardt Boulevard. This commitment is no longer applicable with the design modifications. NCDOT will coordinate with representatives of F&M Bank to minimize impacts. NCDOT will modify the proposed service road at the Dale Earnhardt Boulevard interchange to provide improved access to F&M Bank, the Chamber of Commerce Building, and Lowe's Home Improvement store. This commitment is no longer applicable with the design modifications. NCDOT will provide a leftover into the Pilot Truck Stop on Lane Street. A leftover is p�ovided in the design plans. NCDOT will provide right-in/right-out access to Motel 6, Waffle House, and Brantley property on Lane Street. The proposed service road will be removed. A right- in/right-out is provided in the plans and the p�oposed se�vice �oad has been eliminated. NCDOT will coordinate, on a case-by-case basis, the location of bus stops, sidewalks, and pedestrian controls with the City of Concord, City of Kannapolis, and Rider Transit. The Team will coordinate with the local municipalities to locate bus stops, sidewalks, and pedestrian controls. NCDOT will coordinate with local officials regarding emergency access in the NC 152/US 29 interchange area. This commitment is part of I-3802B, which is outside the current project limits. Addendum to Categorical Exclusion Page 3 of 3 Green Sheet March 2015 Addendum to CE TIP No. I-3802A/ B-5804 Replace Bridge No. 56 on SR 2000 (Brantley Road) Over Lake Fisher in Kannapolis, NC Background/Purpose & Need Since the completion of the CE (12/30/13) a bridge (Bridge No 56) near the Brantley Road I-85 interchange failed inspection and was closed (see Figure 1). The plan for replacing the bridge over the interchange is dependent on the crossing of Brantley Road over Lake Fisher (Bridge No. 56) being open to traffic. Therefore the project footprint is being extended to include replacement of Bridge No. 56. II. Proposed Action Since the road is already closed, traffic will remain in its existing pattern while the bridge is replaced. Bridge No. 56 is 201 feet long. The replacement structure will be a bridge approximately 210 feet long providing 30.5 feet of clear deck width (see Figure 2). The bridge will include two 10-foot lanes, a 3 foot offset on the high side and a 7.5 foot offsite on the low side to accommodate hydraulic spread. At present there are no sidewalk facilities on the approach to the bridge but the city desire one in the future. It is not possible to widen the bridge enough to allow for a sidewalk without also widening the causeway at significant expense and delay. However, the bridge is being designed so as to easily accommodate a future widening see (Figure 3). The bridge length is based on preliminary design information and is set by hydraulic requirements. The roadway grade of the new structure will be approximately the same as the existing structure. Preliminary design and therefore detailed guantities are not yet available but fills in the lake will be limited to fill around the abutments of the new bridge. The approach roadway will extend approximately 217 feet from the west end of the new bridge and 230 feet from the east end of the new bridge. The existing approach cross section will be maintained throughout the project. III. Jurisdictional Resources Jurisdictional Waters One jurisdictional water was identified in the expanded project area and no jurisdictional wetlands. Lake Fisher (DWQ # 13-17-9-4(1)) has a best usage classification of WS-IV; Critical Area. There are no designated trout streams, High Quality Waters (HQW), Outstanding Resource Waters (ORW), anadromous fish waters, or water supply watersheds (WS-I or WS-II) within 1.0 mile downstream of the extended study areas. The North Carolina 2010 Fina1303(d) list of impaired waters does not include any surface waters within the extended study area or 1.0 mile downstream. Protected Species As ofNovember 11, 2014, the U.S. Fish and Wildlife Service (USFWS) lists three federally protected species for Cabarrus County: Schweinitz's sunflower, Carolina heelsplitter and the Northern long eared bat (Table 11). A brief description of each species' habitat requirements follows, along with the biological conclusions rendered based on survey results in the study area. Table 1. Carolina Heelsplitter Suitable habitat for Carolina heelsplitier is not present in Lake Fisher in the expanded study areas. North Carolina Natural Heritage Program (NCNHP) records, reviewed May 20, 2014, do not list any occurrences of the Carolina heelsplitter within a one-mile radius of the project area. Given the results of the mussel surveys in 2007 and 2011 in the vicinity, it is unlikely that the Carolina heelsplitter occurs in any of the streams associated with I-3802 including Lake Fisher. Therefore, this project will have No Effect on Carolina heelsplitter. 2 2. Schweinitz's Sunflower The project study area is comprised of a maintained causeway that has been previously surveyed (September 15, 2014) for the presence of Schweinitz's sunflower. A search of the N.C. Natural Heritage Program (NCNHP) database did not identify any recorded occurrences of Schweinitz's sunflower within 1.0 miles of the project study area. It can be concluded that the construction of this project will have no effect on the Schweinitz's sunflower. 3. Northern Long-Eared Bat If the Northern long-eared bat (NLEB) becomes listed as a protected species under the Endangered Species Act, then based on the results of the bridge inspection, the lack of caves or mines in the project vicinity, the distance to known occurrences of the NLEB, and the lack of suitable summer roosting habitat, the proposed project will propose a biological conclusion of May Affect-Not Likely to Adversely Affect to the U.S. Fish & Wildlife Service seeking their concurrence. Prior to being afforded protection under the Endangered Species Act (ESA), we conclude that the proposed project is not likely to jeopardize to continued existence of the NLEB. B. Cultural Resources Historic Architecture NCDOT — Human Environment Unit, under the provisions of a Programmatic Agreement with FHWA, NCDOT, HPO, OSA and the Advisory Council on Historic Preservation (effective July 1, 2009), reviewed the proposed project and determined that no surveys are required (see form dated February 20, 2015 ). 2. Archaeology NCDOT — Human Environment Unit, under the provisions of a Programmatic Agreement wiih FHWA, NCDOT, HPO, OSA and the Advisory Council on Historic Preservation (effective July 1, 2009), reviewed the proposed project and determined that no surveys are required (see form dated February 23, 2015). C. Social Effects The extended area does not affect any additional residences or businesses and because the bridge is already closed there will not be any additional impact to the community. D. Land Use The project remains compatible with local plans. There are no indirect or cumulative effects from the replacement of the bridge. E. Traffic Noise and Air Quality This portion of the project is an air qualiry neutral project in accordance with 40 CFR 93.126. It is not required to be included in the regional emissions analysis (if applicable) and project level CO or PM2.5 analyses are not required. This project will not result in any meaningful changes in traffic volumes, vehicle mix, location of the existing facility, or any other factor that would cause an increase in emissions impacts relative to the no-build alternative. Therefore, FHWA has determined that this project will generate minimal air quality impacts for Clean Air Act criteria pollutants and has not been linked with any special MSAT concerns. Consequently, this effort is exempt from analysis for MSATs. Any burning of vegetation shall be performed in accordance with applicable local laws and regulations of the North Carolina State Implementation Plan (SIP) for air quality compliance with 15 NCAC 2D.0520. Noise levels may increase during project construction; however, these impacts are not expected to be substantial considering the relatively short-term nature of construction noise and the limitation of construction to daytime hours. The transmission loss characteristics of nearby natural elements and man-made structures are believed to be sufficient to moderate the effects of intrusive construction noise. V. Comments and Coordination The recommendations of this document have been coordinated with the Army Corps of Engineers, the Division of Water Quality and the City of Kannapolis. NCDOT is currently pursuing concurrence from the U. S.
