The Wilmington Regional Office received a complete Stormwater Management Permit Renewal
Application for Northwest Business Park on May 18, 2009. Staff review of the plans and
specifications has determined that the completed project complies with the Stormwater
Regulations set forth in Title 15A NCAC 2H.1 OOO effective September 1, 1995, Therefore
Permit No. SW8 970517 has been renewed on May 21, 2009. and shall be effective until June
26, 2017.
Please pay special attention to the Operation and Maintenance requirements in this permit.
Failure to establish an adequate system for operation and maintenance of the stormwater
management system will result in future compliance problems.
This stormwater system was inspected on March 3, 2009. The items of deficiency noted have
been corrected, including receipt of an Engineer's certification for the stormwater system. The
site is currently in compliance with the terms and conditions of this state stormwater permit. The
plans approved on June 26, 1997 remain in full force and effect.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within thirty (30) days following
receipt of this permit. This request must be in the form of a written petition, conforming to
Chapter 15OB of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this
permit shall be final and binding.

operation and maintenance of two wet detention ponds in compliance with the provisions of
15A NCAC 2H .1000 effective September 1, 1995 (hereafter referred to as the "stormwater
rules') and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division of Water Quality and
considered a part of this permit.
This permit shall be effective from the date of issuance until June 26, 2017, and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff
as described in Section 1.7 on page 3 of this permit. Pond A has been designed to
handle the runoff from 212,278 square feet (Lots 9,10.11, and 12 085%) of impervious
area, and Pond B has been designed to handle the runoff from 601,019 square feet
(Lots 1-8, 13, and 14 @85%) of impervious area..
3. The tract will be limited to the amount of built -upon area indicated on page 3 of this
permit, and per approved plans.

4. All stormwater collection and treatment systems must be located in either dedicated
common areas or recorded easements. The final plats for the project will be recorded
showing all such required easements, in accordance with the approved plans.
5. The runoff from all built -upon area within the permitted drainage area(s) of this project
must be directed into the permitted stormwater control system.

The stormwater management system shall be constructed in its entirety, vegetated and
operational for its intended use prior to the construction of any built -upon surface.
During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
The permittee shall at all time provide the operation and maintenance necessary to
assure the permitted stormwater system functions at optimum efficiency. The approved
Operation and Maintenance Plan must be followed in its entirety and maintenance must
occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and re -vegetation of slopes.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow spreader,
catch basins and piping.
g. Access to the outlet structure must be available at all times.
Records of maintenance activities must be kept and made available upon request to
authorized personnel of DWQ. The records will indicate the date, activity, name of
person performing the work and what actions were taken.

5. The facilities shall be constructed as shown on the approved plans. This permit shall
become void unless the facilities are constructed in accordance with the conditions of
this permit, the approved plans and specifications, and other supporting data.
7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has
been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation. Any deviations from the approved plans and
specifications must be noted on the Certification. A modification may be required for
those deviations.
8. If the stormwater system was used as an Erosion Control device, it must be restored to
design condition prior to operation as a stormwater treatment device, and prior to
occupancy of the facility.
9. Access to the stormwater facilities for inspection and maintenance shall be maintained
via appropriate recorded easements at all times.
10. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to any item shown on the approved plans, including the stormwater
management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further development, subdivision, acquisition, lease or sale of any, all or part of
the project area. The project area is defined as all property owned by the
permittee, for which Sedimentation and Erosion Control Plan approval or a
CAMA Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
11. Prior to the construction of any permitted future areas shown on the approved plans, the
permittee shall submit final site layout and grading plans to the Division for approval.
12. A copy of the approved plans and specifications shall be maintained on file by the
Permittee at all times.
13. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in the
notice, the permittee shall submit a written time schedule to the Director for modifying
the site to meet minimum requirements. The permittee shall provide copies of revised.
plans and certification in writing to the Director that the changes have been made.
III. GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and approval
by the Director. In the event of a change of ownership, or a name change, the permittee
must submit a completed Name/Ownership Change Form signed by both parties, to the
Division of Water Quality, accompanied by the supporting documentation as listed on
page 2 of the form. The approval of this request will be considered on its merits and
may or may not be approved.

2. The permittee is responsible for compliance with all permit conditions until such time as
the Division approves the transfer request. Neither the sale of the project nor the
transfer of common area to a third party constitutes an approved transfer of the
stormwater permit.
3. Failure to abide by the conditions and limitations contained in this permit may subject
the Permittee to enforcement action by the Division of Water Quality, in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
4. The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances, which may be imposed by other
government agencies (local, state, and federal) having jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including
those as may be required by this Division, such as the construction of additional or
replacement stormwater management systems.
6. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
7. The permit remains in force and effect until modified, revoked, terminated or renewed.
The permit may be modified, revoked and reissued or terminated for cause. The filing
of a request for a permit modification, revocation and re -issuance or termination does
not stay any permit condition.
8. Unless specified elsewhere, permanent seeding requirements for the stormwater control
must follow the guidelines established in the North Carolina Erosion and Sediment
Control Planning and Design Manual.
9. Approved plans and specifications for this project are incorporated by reference and are
enforceable parts of the permit.
10. The permittee shall notify the Division of any name, ownership or mailing address
changes at least 30 days.prior to making such changes.
11. The permittee shall submit a permit renewal request at least 180 days prior to the
expiration date of this permit. The renewal request must include the appropriate
documentation and the processing fee.

ORGANIZATIONAL MEETING
NORTHWEST BUSINESS PARK OWNERS' ASSOCIATION, INC.
July 25, 2008
The organizational meeting of the Northwest Business Park Owners' Association, Inc.
(the "Association') was held at 3684-C Henderson Drive, Jacksonville, North Carolina at 10:00
A.M. on July 25, 2008. Members with ownership of nine (9) lots in the Northwest Business
Park subdivision were present, either in person or by proxy.
The Lot Owners/Members present, in person, were Debra R. Ray, trustee of the Richard
Ray Irrevocable Trust, dated January 28, 1994, Royce Bennett, President of Benco Properties,
Inc. (d/b/a The Shepherd Shoppe) and Scott Reid, authorized representative for VHP III, LLC.
The first order of business was to elect the directors of the Association. Debra R. Ray
nominated the following persons to serve as directors: Royce Bennett, Scott Reid and Debra R.
Ray. The nominations were closed and the following individuals were elected by acclamation
to serve as directors: Royce Bennett, Scott Reid and Debra R. Ray.
The next order of business was to elect officers of the Association. The following
individuals were nominated by Debra R. Ray and elected by acclamation to serve as officers of
the Association: Royce Bennett - President, Scott Reid - Vice -President and Debra R. Ray -
Secretary/Treasurer.
The next order of business was to review the By -Laws of the Association, copies of
which had been mailed to the members, along with the notice of meeting. A motion was made,
seconded and unanimously approved ratifying and adopting the By -Laws and authorizing the
recordation of same in the office of the Register of Deeds of Onslow County, North Carolina.
There was some discussion concerning the present condition of the retention ponds
constituting the common area of the Association and what should be done to maintain them m
compliance with'the rules and regulations of the North Carolina Department of Environment
and Natural Resources, Division of Water Quality ("DENR"). Debra Ray stated that she has
received bids from contractors to correct all deficiencies in the condition of the ponds to bring
them into compliance with DENR requirements. The Richard Ray Irrevocable Trust, dated
January 28, 1994 will pay the costs and expenses required. It was brought to the attention of
the members that a proposal has been presented by Retention Pond Services, Inc., an aquatic
and wetland maintenance firm, that for a $200.00 per month fee, Retention Pond Services, inc.
will provide future maintenance of the retention ponds and adjacent corm -non area in

compliance with DENR requirements. A motion was made, seconded and unanimously
approved, authorizing the acceptance of the proposal and directing the President to accept the
written proposal within three months following completion of the current work to be
performed by The Richard Ray Irrevocable Trust.
The total estimated operating expenses for calendar year 2009, including the
maintenance contract, accounting, administrative and legal fees and expenses will be
approximately $3,360.00. The armual common expense charges necessary to pay the estimated
expenses will be $240.00 per Lot (i.e. 14 Lots x $240.00 = $3,360.00). A motion was made by
Scott Reid, seconded by Debra Ray to establish the calendar year 2009 annual conunon expense
charges at $240.00 per Lot, payable on January 1, 2009. After reviewing the proposed budget
and some discussion, the motion was unanimously approved. The Secretary -Treasurer was
directed to prepare and send to the Lot Owners a billing notice of the annual common expense
charges, along with a copy of these minutes.
There being no further business, a motion was made, seconded and unanimously
approved to adjourn.

Based upon our inspection this date and our review of documentation from
DWQ, we have the following comments regarding the stonnwater ponds at the
referenced project.
Pond A
1. Pond appears acceptable. As a maintenance note, you may wish to consider
having grass cut "higher" (raise the blade height) as banks are slightly
"scalped" in some locations.
Pond B
1. As noted by DWQ in their recent inspection, we would recommend installing
a cover over junction box located at the southwest comer of pond . DONE —
See Photo.
2. As noted by DWQ in their recent inspection, install some CI"B" Stone armor
in the outlet ditch in the location "scoured" by the pond outlet. Based on my
observations, we would estimate that approx. 40 s.f. (4' wide x 10' long) of Cl
"B" Stone installed one layer deep (approx. 6" thick) would suffice DONE —
See Photo.
3. Recommend installing a small amount (approx. 20 s.f.) of CI'B" Stone in the
low point of the vegetated shelf "bens' between the forebay and main pond in
order to prevent a'breach" in this location. Your contractor may also
consider installing a 4"-6" high 'weir structure" inside the outlet pipe at the
outlet structure in an effort to raise the normal pool elevation to that of the
vegetated shelf DONE — See Photo.
4. Recent repairs to eroded areas on the east bank require attention (fill "rill" and
reseed this area) DONE — See Photo.
5. Again, you may want to consider having grass cut'higher" as banks are
scalped in some locations
Upon satisfactorily addressing these items, we can issue the required Engineer's Certifications for
these ponds.

Following an on -site inspection and review of the scope Of work set out in Correspondence from Mr. David K.
Newsome, PE to Mr. Cliff Ray dated March 20, 2009, RPS proposes to complete the following scope of work
at the pond to the south of the hotel:
1. Fabricate and install a cover over the junction box located at the southwest comer of the pond.

2. Place class 8 granite rip rap at the toe of the outfall pipe leading to the outlet ditch and armor the existing
area of scouring. The class B granite rip rap is to be placed over #1196 filter fabric (approx. 60 square feet).
3. Place class B granite rip rap at the low area of the forsbay separator (approx, 20 square feet).

Based upon our inspection this date and our review of documentation from
DWQ, we have the following comments regarding the stormwater ponds at the
referenced project.
Pond A
1. Pond appears acceptable. As a maintenance note, you may wish to consider
having grass cut "higher° (raise the blade height) as banks are slightly
"scalped' in some locations.
Pond B
1. As noted by DWQ in their recent Inspection, we would recommend installing
a cover over junction box located at the southwest comer of pond .
2. As noted by DWQ in their recent inspection, install some CI"B' Stone armor
in the outlet ditch in the location "scoured' by the pond outlet. Based on my
observations, we would estimate that approx. 40 s.f. (4' wide x 10' long) of Cl
"B' Stone installed one layer deep (approx. 6' thick) would suffice.
3. Recommend installing a small amount (approx. 20 s.f.) of CI'B' Stone in the
low point of the vegetated shelf "berm' between the forebay and main pond in
order to prevent a "breach' in this location. Your contractor may also
consider installing a 4"-6" high *weir structure" Inside the outlet pipe at the
outlet structure in an effort to raise the normal pool elevation to that of the
vegetated shelf.
4. Recent repairs to eroded areas on the east bank require attention (fill 'rill' and
re -seed this area).
5. Again, you may want to consider having grass cut "higher' as banks are
scalped in some locations
Upon satisfactorily addressing these items, we can Issue the required Engineer's Certifications for
these ponds.

Please find attached a copy of the completed form entitled "Stormwater Compliance
Inspection Report". The report summarizes the findings of a recent inspection of the
project's stormwater controls conducted on March 3, 2009 to determine compliance with
Stormwater Permit Number SW8 970517 issued on June 26, 1997.
As indicated in the attached inspection report the following deficiencies must be
resolved:
1. Submit an Engineer's Certification of the stormwater system
2. Complete installation of rip rap per approved plan, and install cover to the
interference manhole section of the outlet structure for Pond B.
Please inform this Office in writing before April 6, 2009, of the specific actions that will
be undertaken and the time frame that will be required to correct the deficiencies.
Failure to provide the requested information, when required, may initiate enforcement
action including the assessment of civil penalties of up to $10,000 per day. If a written
Plan of action is not submitted to this office by April 6, 2009 then DWQ staff will re-
inspect the site and issue a Notice of Violation if the listed deficiencies have not been
addressed.

The organizational meeting of the Northwest Business Park Owners' Association, Inc.
(the "Association') was held at 3684-C Henderson Drive, Jacksonville, North Carolina at 10:00
A.M. on July 25, 2008- Members with ownership of nine (9) lots in the Northwest Business
Park subdivision were present, either in person or by proxy.
The Lot Owners/Members present, in person, were Debra R. Ray, trustee of the Richard
Ray Irrevocable Trust, dated January 28, 1994, Royce Bennett, President of Benco Properties,
Inc. (d/b/a The Shepherd Shoppe) and Scott Reid, authorized representative for VHP III, LLC.
The first order of business was to elect the directors of the Association. Debra R. Ray
nominated the following persons to serve as directors: Royce Bennett, Scott Reid and Debra R.

The next order of business was to elect officers of the Association. The following g

There was some discussion concerning the present condition of the retention ponds .
constitiiting the common area of the Association and what should be done to maintain them in
compliance with the rules and regulations of the North Carolina Department of Environment
and Natural Resources, Division of Water Quality ("DENR"). Debra Ray stated that she has
received bids from contractors to correct all deficiencies in the condition of the ponds to bring
them into compliance with DENR requirements. The Richard Ray Irrevocable Trust, dated
January 28, 1994 will pay the costs and expenses required. It was brought to the attention of
the members that a proposal has been presented by Retention Pond Services, Inc., an aquatic
and wetland maintenance firm, that for a $200.00 per month fee, Retention Pond Services, Inc.
will paovide future maintenance of the retention ponds and adjacent common area in

I pulled the file and determined that Pat returned application by letter dated June 20, 2008. Several
inadequacies were cited including insufficient fee, Engineers Certification, and O&M Plan. By letter
dated July 2, 2008, Debra Ray let Pat know that she was working on these issues and would resubmit.
We haven't received anything yet. The whole package needs to be resubmitted including the $505 fee
with the items that you are working on.
Pat is now working mostly out of the Washington Office and David Cox has picked up the renewals.

We have received Notice of Inspection and Non -Compliance letters for the above
referenced stormwater projects. We would like to inform the Wilmington Regional
Office that we have contacted three separate contractors to submit bids on all three ponds.
We have also engaged our engineer, Crystal Coast Engineering, PA, to begin the process
of inspecting each pond and begin filling out the stormwater permit renewal application
forms.
We expect to receive all three bids by July 1 I`h, 2008. We will then evaluate each
proposal and initiate corrective measure to bring each pond into compliance so that we
may complete the renewal application forms.

Dear Mr. Pierce,
Per your request, we have conducted an inspection of the referenced
stormwater facilities in hopes of issuing the required Designers Certifications. I am,
however, unable to issue the Designers Certification at this time due to some
deficiencies noted during my recent site visit. Those deficiencies are as follows:
Pond "A"
• "Woody vegetation" (myrtle trees) should be removed from vegetated shelf
adjacent to the outlet structure.
• Pond does not contain the required surface area. Pond dimensions appear to
be about 20' short in both directions (length and width). I surmise this is due
to the elevation of the outlet structure which, based on visual observation (no
survey data), appears to be low. I would suggest having the outlet structure
raised to the proper elevation which should expand pond surface area to that
required by the permit.
• "Woody vegetation' (myrtle/pine trees) should be removed from vegetated
shelf. Also, there appears to be a small "berm breach" which should be
repaired. It appears some minor redistribution of material on the berm can
remedy this problem (i.e., take material from high areas of berm and fill the
breach")
• The adjacent road shoulder is bare (scalped) and needs to be stabilized.
• Remove accumulated debris (trash) from pond.
We suggest that you contact a local contractor to perform the above noted
maintenance/repair work. Once this work is completed, please call my office and I
will re -inspect. If the completed work is acceptable, I will issue and forward to DWQ
the required Designers Certifications.

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number
SW8970517 to Richard L. Ray Irrevocable Trust to serve the Northwest Business Park on
6/26/1997. This permit expired on 6/26/2007. Section .1003(h) of 15 A NCAC 2H .1000 (the
stormwater rules) requires that applications for permit renewals shall be submitted 180 days
prior to the expiration of a permit and must be accompanied by a processing fee, which is
currently set at $420.00. If this is still an active project please complete and submit the
enclosed renewal application in a timely manner. If this project has not been constructed and a
permit is no longer needed, please submit a request to have the permit rescinded. If you have
sold the project, or are no longer the permittee, please provide the name, mailing address and
phone number of the person or entity that is now responsible for this permit. Enclosed is a form
for change of ownership, which should be completed and submitted if the property has
changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer
for the system installed. This is to certify that the permitted facility has been installed in accordance with
the permit, the approved plans, specifications and supporting documentation. Please include a copy of
the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample
certification. Also enclosed is a new Operation and Maintenance agreement that should be completed
and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a
stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and
may result in appropriate enforcement action including the assessment of civil penalties of up to
$10,000 per day.

Dear Ms. Ray:
The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8970517
to Richard L. Ray Irrevocable Trust to serve the Northwest Business Park on 6/26/1997. This permit
will expire on 6/26/2007. Section .1003(h) of 15 A NCAC 2H .1000 (the stormwater rules) requires that
applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must
be accompanied by a processing fee, which is currently set at $420.00. If this is still an active project
please complete and submit the enclosed renewal application in a timely manner. If this project has not
been constructed and a permit is no longer needed, please submit a request to have the permit
rescinded. If you have sold the project, or are no longer the permittee, please provide the name, mailing
address and phone number of the person or entity that is now responsible for this permit. Enclosed is a
form for change of ownership, which should be completed and submitted if the property has changed
hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer
for the system installed. This is to certify that the permitted facility has been installed in accordance with
the permit, the approved plans, specifications and supporting documentation. Please include a copy of
the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample
certification. Also enclosed is a new Operation and Maintenance agreement that should be completed
and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a
stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and
may result in appropriate enforcement action including the assessment of civil penalties of up to
$10,000 per day.

the remaining issues of your letter. I hope to have a date for you that all.the discrepancies

This facility has two ponds labeled "A & "B". Both ponds need routine mowing and trash collecting maintenance. Pond B has
excessive large woody vegetation on the berm between the forebay and the main pond. There was also a small cut made into the
berm. The plans did not indicate that there was to be a cut there. There was erosion outside of the fence resulting in some carry -
down to the pond slopes.
Pond A appeared to have a high level of water in it which in an indicator of a plugged orifice. You should check this after every
runoff producing rainfall.
There was an additional inlet pipe installed near the forebay. This pipe was not shown on the plans. Trees have been planted on
the slopes of the pond.
There was some minor erosion due to the installation of the new pipe and nearby construction.
The permit expired on June 26 2007 and a request for renewal has not been received to date.
