Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 960404 dated October 17, 1996, for the construction of Ocean Isle Beach Motel. This permit shall be effective from the date of issuance until October 17, 2006, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an ajudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. This stormwater system has been approved for the management of stormwater runoff as described on page 3 of this permit, the Project Data Sheet. The stormwater control has been designed to handle the runoff from 34,575 square feet of impervious area. 3. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved plans. 5. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built - upon area. 6. The following items will require a modification to the permit: a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision of the project area. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. In addition, the Director may determine that other revisions to the project should require a modification to the permit. 7. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. II. SCHEDULE OF COMPLIANCE 1. The permittee will comply with the following schedule for construction and maintenance of the stormwater management system: a. The stormwater management system shall be constructed in it's entirety, vegetated and operational for it's intended use prior to the construction of any built -upon surface except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 2. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in it's entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. 3. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 4. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 4 State Stormwater Management Systems Permit No. SW8 960404 5. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. III. GENERAL CONDITIONS This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143- 215.6(a) to 143-215.6(c). The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DEHNR Staff permission to enter the property for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. Permit issued this the 17th day of October, 1996. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. Please add a vegetated filter detail to the plans. Indicate the flow spreader mechanism, the width of the filter, the type of vegetated cover, and calculations to indicate a non -erosive velocity. Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to October 10, 1996, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. Since the bypass runoff now drains toward "SA" classified water, we have stored 1 1/2" runoff, and routed the bypass water through a 50' vegetated filter. Please review this plan for approval. As you are aware, the plans were submitted to CAMA for their approval also. We were waiting to receive their comments before responding to your letter, because we wanted to see whether there were significant changes requested in the site plan. Since they have required all parking and drainage structures to be removed from within their 60' setback, the stormwater management design has had to be completely redesigned. Enclosed are four sets of the revised plans, as well as a copy of the revised calculations and a copy of the soils report. I believe the following revisions to the plans address the concerns mentioned in your review. 1) We have included a typical building footprint and have labeled drives, walks, and buildings on the plan. One reason this plan is a little harder to follow than most, is that there are drives and parking areas located underneath the buildings; 2) The trench widths for the infiltration trenches have been revised. The revised trench dimensions are shown on the plans, as well as in the calculations; 3) The revised calculations are based on differing trench widths for each trench. These are shown in the calculations; 4) The pool deck is to be constructed of treated lumber; 5) A revised bypass plan has been designed, consisting of an additional pipe system, which is separate from the infiltration pipe. The invert of the bypass pipe is no lower than the top of the filter trench. The bypass water will not be run through the infiltration pipe; 6) The Seasonal High Water Table is at an elevation of 6.5'. The system meets the 2' separation requirement; 7) According to the soils evaluation completed by Soil Tech Engineering, the soils on this site are relatively clean, free draining sands, which generally contain less than 1.0% fines; 8) The expected average drawdown times of the system, for the first 1" of runoff, are shown in the calculations. These times are based on an average infiltration rate of 18 gal/SF/hour , as indicated in the soils evaluation; 9) The vegetated filters have been revised and relocated from those shown on previous plans. Our investigation consisted of evaluating the subsurface soils for soil type and infiltration rate. Two test borings were advanced on -site to a depth of 10 feet below the ground surfaces. Each soil test boring, conducted in accordance with procedures specified by ASTM D-1586, determined the consistency of the subsurface conditions and provided a classification of the soils encountered to the depth of each boring. Selected samples of this subsurface soils encountered were also tested for grain size analysis in accordance with the American Society for Testing & Materials (ASTM) procedures entitled ASTM D-422; Particle Size Analysis of Soils." Infiltration testing was also conducted at three locations on -site at the approximate depth where the designed stormwater discharge is anticipated. Based on the results of our field and laboratory testing, the subsurface soils were found to be a relatively clean, free draining sands, which generally contained less than 1.0 % fines (material passing the No. 200 Sieve). Our infiltration testing determined that a rate from 11.2 to 26.2 gallons per hour per square foot, should be used in design of the stormwater discharge system. From our site observations of the subsurface conditions, we predicted that the,seasonal high watertable is approximately 6 feet below the existing ground surface.: Because of the close •proximity of the ocean, we anticipate that during extreme high tides, this water level will be temporarily higher. The trench detail also shows a cross-section that is 3' wide and 30" high. You use an area 3' by 3' to calculate the storage volume. If a 3' x 30" area is used, the volume provided will not be adequate. Please revise. 4. Please label the pool deck material. If it is concrete, show spot elevations and how the pool deck will drain to the infiltration area. 5. The bypass you propose will not meet the State requirements. The pollutants in the first inch will be flushed through the filter media by the incoming ninoff. Sunset Beach, NC 28468 RE: Ocean Isle Motel Dear Mr. Johnson: The letter is a response to the request that you and Mr. Ken Stewart made of me during your office visit on Monday, October 12, 1992. I have reviewed the site plat that you provided me of the current construction of the Ocean Isle Motel to assess applicable provisions of the North Carolina Sedimentation Pollution Control Act. Reiterating our discussion, I expressed concern that the plat you provided while only 15,000 square feet in size in of itself, might be part of a larger project that is being phased in, in increments of less than one acre each in an effort to (incorrectly) avoid the N.C. Sedimentation Pollution Control Act. As I explained during our meeting, if a project is planned to exceed a total of one acre anytime during its land disturbance or disturbances, sedimentation and erosion control plan approval is necessary. Although you and Mr. Stewart admitted that an adjacent site was also part of the Ocean Isle Motel, the combined land disturbances would be approximately one acre (no one was able to assure complete accuracy). Since the former phase is complete and causing no problems and this phase is to less than 15,000 square feet in total development, a sedimentation and erosion control plan is not deemed necessary. If further phases of this project are planned, our office will request that a total site plan be developed for this project. We hope this clarifies the Land Quality Section position in this matter.
