The new bridge ��vill be located just do��vnsh'eam of tlie esisting bridge, therefore, a detour will not be required during construction. The project will also include some minor approach work on tlie existing roadway. Tlie database lists 47 species for Ha}n��ood Couury that have federal status. Bog hirtle (Gl��teiir��s nttJ�lerrbergri) is listed as threatened diie to similarity of appearance to tlie listed northern bog hirtle. Bald eagle (Hrdiaeehrs /etrcocepltaltrs) is listed under the Bald and Golden Eagle Protectiou Act (BGPA). Appalacl�ian elktoe records i�i die area are fi•om relatively large streams; the French Broad River, Pigeon River, Little River, and Mills River. There are no records of occurrence in the smaller tributaries of these streams. No Appalachian elktoe were obserned duruig the field scoping process and records indic�te the nearest kiiown occurrence is located more thau 12-ruiles upstream of the project u� the Pigeon River ne�r Canton. With rare exception, gray bats roost in caves year-round. Siuce this project is limited to the replacement of an eaisting bridge, there sltould be minunal impacts beyond tlie limits of the bridge. Therefore, gray bats will uot be iuipacted by the replacement of the bridge. Northern Iong-eared bats winter i�i caves or mines with stable, but not freezing, cold temperatures. lu simuner tliey geuerally roost iii the loose bark of trees, either dead trecs with peeling bark or cavities, or live Uees wiUi shaggy b1rk, sucli as white oak, maples, sycamore and hickoi•ies. These tree species were not present at tl�e site; ho��vever, cleariug of h�ees will take place behveen August 15`�' and May IS°i (winter clearing) to avoid potential impact to roosting iioithern lonb eared bats. Althotigh the Tndiana bat is listed in the dalabase due to au isolated wiuter record, the U.S. Pish aud Wildlife Service does not consider Ha��vood Coi�nt}� to be a�i Indiana batcouuty. Spruce-fir moss spider onlp lives on the highest ntountaiu peaks in the Southern Appalachian Moimt�ius of western North Caroliva and eastern Tennessee. The higli elevation forests where this spider is lound are dominated by Frascr fir with scattered red spruce. This forest type is commonly referred to as spruce-fir forests. The typical habitat of tliis spider is damp, but well- draiued moss mTts gro���ing on rocks and botilders itt �vell-sliaded areas within tliese forests. Tlie moss mats camiot be too dry (the species is veiy sensitive to desiccation) or too wet (large drops ofwater can also pose a du•eat to tlie spider). The elevation at the site is approsimately 3,900 feet and does not liave tlie required tree species for spruce-fir moss spider to persist. Therefore, tliis project ���ill uot impact spruce-fir moss spider. Carolina northern flying squirrel, rock guome liclien, and spreading avens are species that require habitaC fouud at relatively high elevation. Although most rock guome lichen populations occur near or above 5,000 feet elevation, it does occur at lower clevations within deep river gorges. The elevation at the site is appro�unately 3,900 Yeet and vertical rock substrate required by tlie irock gnome licliev is lacking near the bridge. Therefore, there is uo suitable habitat for these specics ne�r the project. Small �vhorled pogonil generally occurs in open, dr}�, deciduous woods with acid soil, accordiug to tlie U.S. Fish and Wildlife Service. However, it is also known to occur in a variery of habitats in North Caroliva; iucluding aloug strelms. 'I'he project site is mauitained road rigl�t of way, with some forest area consisting of deciduous trees and rhododendron. The bridge site appears to have a veiy low potential to support small whorled pogonia. Records indicate the neTrest known occurrence of small whorled pogonia is approsimately 13 miles east of the project area. Bridge No. 326 — Ha}�vood Couiity Page 3 April 8, 2015 In the July 9, 2007 Pederal Register (72:37346-37372), the bald eagle �vas declared recovered, and removed (de-listed) from the Feder�l List of Tlu�eatened 1nd Endaugered wildlife. This dclisting took effect August 8, 2007. After delisting, the Bald and Golden Eagle Protectiou Act (Eagle Act) (16 U.S.C. 668-668d) becomes tlte primary law proteeting bald eagles. Tlie Eagle Aet prol�ibits take of bald and golden eagles aud provides a staturory detinition of "take" tliat includes "disturb". The USFWS has developed National Bald Eagle Maiiagement Gaidelines to provide guidauce to land managers, landowuers, and others as to how to avoid disturbiug bald eagles. Tlie project is limited iu scope to t�e replacement of a�� e�istiug spamung structure with auother spatming shuctare. Erosion and sedimentation control measures will be implemented ro furdier �uiuiuiize potential to adversely affect aquatic habitat. Habitat foi tlie listed species and for the bald eagle is lacking at tlie project site. No tlueatened or eudangered species were obseived during the tield scopiug process. For these reasons and those discussed above, �ve reconnnend a "no cffecN' determivation lor threatened ai�d endangered species. This project was reviewed by NCDOT's Human Euvirorunent Unit iu 2013 for potential effects to liistoric architectw•e and archaeolog}�. It �a�as determiiied that no survey ��vas required Yor historic Trcl�itecture or arcl�aeology (see attached foims). NCDOT best management practices ���ill Ue used to miniinize and control sedimentation and erosion on this project. The construction foreman will revie�v a�l erosion and seclimentation control mcasures daily to ensure erosion and sedimentation is being effectively controlled. lf the devices 1re not fimctioning as intended; tliey �vill be replaced inunediatcly w�ith better devices. Lupacts ta Waters of tlie United States IIemphill Creek (DWQ Cl�ss: C, Tr) is shown on the USGS topographic map as a peremiiTl slream. The channel is �vell defiued w�ith a substrate prim�rily composed of large rocks, gravel aud sand/sil( and is appro�imately 5-6 feet in width. From Bridge No. 326, Hemphill Creek flow�s approsimately 3.8 miles to Jouathans Creek, which then tlows 6.1 miles before joiniug tlie Pigeon River. The Pigeon River flows 20.4 miles before ci•ossiiig the Temiessee state line. Tlie Pigeon River meets tlie detinition of a Traditional Nlvigable W�ter. For these reasons, we believe Hemphill Creek is a Relatively Perinaueut Water and is under the jurisdiction of the U.S. Army Corps ofEngineers. In order to construct the project, it will be necessary to impact �vaters of the United States in tlie French Broad Rivei• Basui (HUC 06010106). Specifically, NCDOT is requesting to replace Bridge No. 326 with a new spanning structure. The impacts are listed in Uie table below. Hemphill Creek, included within the French Broad River Drainage Basin, constitutes a second order stream Oowing wes[ to eas[ through the project area. It emptyies into lonathan Creek near the U5276/SR1318 junction. A strongly sloping topography. characterizes the majority of the APE and surrounding area. A map review and site file search was conducted at the Office of State Archaeology (OSA) on Tuesday, August 20, 2013. This tvork disclosed the location of four prehistoric archaeological sites (31HW198, 31HW202 — 31HW204) si[uated along Hemphill Road to the east of the proposed bridge replacement. Rewrded by Bass (1975) during his survey of the Great Smoky Mountains, the sites contained surface debris representa[ive of mul[i-componen[ occupations spanning the Archaic and Woodland periods. Midden deposits were noted at three of the archaeological sites. Clearly, prehistoric setUement was focused along level, well-drained terraces in the less restrictive sheam valleys. These areas would have been highly prized and returned to often, offering respite from the un(orbidding and sloping terrain surrounding. Based on this information, the small Hemphill Creek stream valley was occupied throughout much of prehistory. Therefore, the potential of documenting additional archaeological sites or isolated artifact finds in the vicinity of the Bridge 326 APE is wnsidered moderate. An inspection of National Register of Historic Places (NRHP�, State Study Listed (SL), Locally Designated (LD), Determined Eligible (DE), and Surveyed Site (SS) properties employing resources available on the NCSHPO website concluded that none of the above designated property types were located within or adjacent to the project area. Historic maps of Haywood County were also appraised for evidence of former sVUCture locations, land use pattems, oi other confinnation of historic occupation at this bcale. In general, this work established that no existing NRHP listed proper[ies, archaeological sites, or cemeteries will be impacted by the proposed consVUCtion project. Further, topographic, geologic, environmen[ai, and NRCS soil survey maps (WoD, SoF) were referenced to evaluate ecological, geomorphological, hydrological, and other elements that may have resulted in past occupation at this location.
