Accordingly,we are forwarding the attached NPDES permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.Environmental Protection Agency dated May 9,1994(or as subsequently amended). In response to your questions/comments on the draft permit: > A summary of our permitting strategy for ion-exchange water treatment plants was included with your draft permit. In your comments you indicated the"permitting strategy appears flawed." The full workgroup findings,along with the participants involved on the workgroup,is available on our website at http://h2o.enr.state.nc.us/NPDES/documents.html. The 77-page document is entitled "Assessment and Recommendations for Water Treatment Plant Permitting:Findings of the Water Treatment Plant Workgroup." The new permitting strategy for water treatment plants affects all membrane and sodium cycle cationic exchange water treatment plants regardless of the facility's compliance history. ➢ We understand that the new requirements will increase man-hours and costs associated with the operation of your facility. The new requirements are an attempt by the Division to collect more information about the nature of your discharge so that we can properly characterize your effluent,as well as the effect your discharge may have on the receiving water. These requirements are consistent for all water treatment plants using ion exchange technology. By requiring monthly monitoring for the new parameters,we aim to minimize the disruption to your operations while still gathering important data. We do not believe that these requirements pose an impractical burden on a properly operated facility. The Division will re-evaluate the monitoring requirements at the next permit renewal in 2010. ➢ Please contact Jim Meyer in the Lab Certification Branch at(919)733-3908,extension 207 with any questions about the procedure for obtaining specific parameter certifications or for obtaining a list of certified laboratories. D In your comments you indicated there is no upstream or downstream flow in the receiving water, except during rain events. The stream monitoring requirement will remain in the permit. However,if when sampling is conducted there is no stream flow,then simply indicate"No Flow"on the monitoring report. ➢ With regard to your comment that the conductivity monitoring requirement has been removed from "Most all NPDES permits,"this is not entirely correct. The instream monitoring requirement for conductivity was removed from those NPDES permits with 100%domestic wastewater only. Your facility,an ion-exchange water treatment plant,does not fall into this category,and hence is still subject to the instream conductivity monitoring requirement. The TRC limit will not take effect until eighteen(18)months after the effective date of the final permit. This eighteen(18)month grace period,which will conclude on September 30, 2006,will allow you the needed time to make any modifications to your plant as well as time to purchase new equipment or to find a certified laboratory able to conduct the TRC analysis. The Division's TRC policy memo was included with your draft permit. ➢ In your comments you objected to the need for the chronic toxicity testing requirement. You stated, "We oppose any testing requirement for parameters that do not have a proposed limit." Again we understand the requirements will increase man-hours and costs associated with the operation of your facility. The new requirements are an attempt by the Division to collect more information about the nature of your discharge so that we can properly characterize your effluent,as well as the effect your discharge may have on the receiving stream. At this time,your permit currently includes chronic toxicity monitoring. This is not a"pass/fail"test;rather the purpose is to gather information about the nature of your discharge. We need to determine whether your effluent discharge has a toxic effect on the receiving stream. Based on the data gathered,we will be able to determine whether or not future limits will be required. At this time we do not have sufficient information to make this determination. The Division may re-evaluate this monitoring requirement at the next permit renewal in 2010. This permit includes a TRC limit that will take effect on October 1,2006. If any parts,measurement frequencies or sampling requirements contained in this permit are unacceptable to you,you have the right to an adjudicatory hearing upon written request within thirty(30)days following receipt of this letter. This request must be in the form of a written petition,conforming to Chapter 150B of the North Carolina General Statutes,and filed with the Office of Administrative Hearings(6714 Mail Service Center,Raleigh,North Carolina 27699-6714). Unless such demand is made,this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources,the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. CHRONIC TOXICITY PERMIT MONITORING (Quarterly) The permittee shall conduct quarterly chronic toxicity tests using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions. The effluent concentration defined as treatment two in the procedure document is 90%. The permit holder shall perform Quarterlu monitoring using this procedure to establish compliance with the permit condition. The tests will be performed during the months of March, June, September, and December. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of"No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring will begin immediately. Upon submission of a valid test, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-opened and modified to include alternate monitoring requirements or limits. We must express opposition to the Permit conditions. There are substantial changes to the Permit of which we feel are unnecessary questionable significance, and of which permitting strategy appears flawed. Little consideration of "Real World"processes seem to have been made. This facility is a potable water sodium cycle ion exchange treatment for water hardness. The discharge is not continuous and happens only when the softeners need to be regenerated based on predetermined actual flow use. This facility has been in place for a number of years with no problems of any kind. Since there are few limits being proposed, the Division is in effect using the Permittee to gather data. This should not be our responsibility. We object to the following: 1) Except for rain events, there is no upstream or downstream other than the effluent. We must ask that all upstream and downstream monitoring be removed. 2) Conductivity has historically been a parameter of little value. Most all NPDES Permits had this requirement at one time, but most have since been removed. It is our understanding that conductivity must be tested in the field which will require purchase of new equipment and an amendment to our laboratory certification—or to pay a certified lab to do the work—all of which are totally unnecessary. Monitoring equipment is extremely expensive and the addition of common dechlorination chemicals may in themselves have a negative environmental impact through reduction of dissolved oxygen or pH. Again, the facility has operated for many years with no adverse impact. 4) Chronic Toxicity. We must adamantly oppose inclusion of this parameter. We oppose any testing requirement for parameters that do not have a proposed limit. Again, the Division is clearly using the Permittee to gather data. We feel thero sed changes are unrealistic and present substantial economic and operations impact P Po to the Permittee for little, if any, benefit.
