P.O.Box 240908 Charlotte,North Carolina 28224 Subject: NPDES Permit Issuance Authorization to Construct NPDES Permit No.NC0086592 ATC No. 086592ACA The Point WTP- Well Control Building#1 Iredell County Dear Mr. Haas: In accordance with the application for discharge permit received on December 2, 1998,the Division is forwarding herewith the subject state -NPDES permit. In addition, authorization is concurrently granted for the construction of a septic tank for solids removal. Specific conditions and limitations are listed below. NPDES Permit Issuance • This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated December 6, 1983. There is one change between the DRAFT permit and this FINAL permit. Due to the intermittent flow in the receiving stormwater ditch, compliance monitoring for turbidity has been changed from instream sampling to effluent sampling,with an effluent limit of 50 NTU. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable to you,you have the right to an adjudicatory hearing upon written request within thirty(30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, Post Office Drawer 27447, Raleigh,North Carolina 27611-7447. Unless such a demand is made, this permit shall be final and binding. Please take notice that this permit is not transferable except after notice to the Division of Water Quality. Part II, E.4.addresses the requirements to be followed in case of change in ownership or control of this discharge. Authorization to Construct A letter of request for an Authorization to Construct was received by the Division on March 12, 1999, and final plans and specifications for the subject project have been reviewed and found to be satisfactory. Authorization is hereby granted for the construction of septic tanks for the removal of solids from filter backwash at The Point Water Treatment Plant, Well Control Building#1,with discharge of treated filter backwash water into an unnamed tributary to Lake Norman in the Catawba River Basin. Specifically,this authorization is for the following construction activities: • Installation of two 1500-gallon septic tanks in series. This Authorization to Construct is issued in accordance with Part III.A of NPDES Permit No. NC0086592 issued concurrently, and shall be subject to revocation unless the wastewater treatment facilities are constructed in accordance with the conditions and limitations specified in Permit No. NC0086592. Failure to abide by the requirements contained in this Authorization to Construct may subject the Permittee to an enforcement action by the Division of Water Quality in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. The issuance of this Authorization to Construct does not preclude the Permittee from complying with any and all statutes, rules,regulations,or ordinances which may be imposed by other government agencies(local, state, and federal)which have jurisdiction. The sludge generated from these treatment facilities must be disposed of in accordance with G.S. 143-215.1 and in a manner approved by the North Carolina Division of Water Quality. The Operational Agreement between the Permittee and the Environmental Management Commission is incorporated herein by reference and is a condition of this permit. Noncompliance with the terms of the Operational Agreement shall subject the Permittee to all sanctions provided by G.S. 143-215.6 for violation of or failure to act in accordance with the terms and conditions of this permit. Upon classification of the facility by the Certification Commission,the Permittee shall employ a certified wastewater treatment plant operator to be in responsible charge(ORC)of the wastewater treatment facilities. The ORC must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the wastewater treatment facilities by the Certification Commission. The Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of Title 15A, Chapter 8A, .0202. In the event that the facility fails to perform satisfactorily, including the creation of nuisance conditions,the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement wastewater treatment or disposal facilities. The Mooresville Regional Office,telephone number(704)663-1699, shall be notified at least forty-eight(48)hours in advance of operation of the installed facilities so that an on-site inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. • NPDES Permit Issuance Authorization to Construct NC0086592; ATC #086592ACA The Point WTP- Well Control Building #1 Page 3 Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professional engineer certifying that the permitted facility has been installed in accordance with the NPDES Permit, this Authorization to Construct, and the approved plans and. specifications. Mail the completed certification to:North Carolina DENR-DWQ,NPDES Unit, P.O. Box 29535,Raleigh,NC 27626-0535. One(1)set of approved plans and specifications is being forwarded to you. A copy of the approved plans and specifications shall be maintained on file by the Permittee for the life of the facility. This is a new applicant for a water treatment plant(WTP)filter backwash discharge to an trib to Lake Norman. The applicant proposes to construct a community drinking water well with cation exchange resin water softeners. Backwash from the filters(estimated at 3000 gpd)will be discharged to a dry stormwater channel and travel approx. 300-feet before entering Lake Norman,which is oligotrophic and not listed in the 1998 303(d)list. For treatment of backwash discharge, applicant proposes to construct two septic tanks in series to trap particulates. Proposed Effluent Limits. Effluent limits were based on revised 1992 WTP NPDES Policy memo. Since Q<5,000 gpd,quarterly monitoring is appropriate for all parameters. TRC monitoring added since GW is disinfected with chlorine. Chloride monitoring added since they will perform brine recharge of water softener. EAA Review. Based on recent NPDES review,the potential alternatives for WTP backwash discharges are extremely limited. The applicant stated that a POTW is approx. 5 miles away;residences in subdivision are on individual septic systems. The permittees soil scientist stated that land application/reuse options are not feasible due to high sodium content. Non-Discharge Unit(Kim Colson) concurred that the high sodium content would nullify a land application option. Therefore NPDES is recommending issuance of discharge permit. Mooresville Region. This distance makes this alternative economically unfeasible. Regarding possible reuse as a non-discharge option,I have investigated the operation of the softeners with Global Water Conditioning,the manufacturers of the equipment,and discussed this option with Toney Jacobs, the soil scientist for The Point project. (As a matter of information, The Point residences will all be served by individual septic systems.) The softener backwash is approximately 3,000 gallons, and occurs once a day. There are two (2) softeners,each of which has full rated capacity,thus they will alternate every other day backwashing. Backwash is with a brine solution which uses 325 pounds of salt per backwash,of which 213 pounds attaches to the media to replace the hardness(Calcium Chloride). Based on this concentration,even with an extremely low loading rate,there would be a sodium buildup over time that would severely inhibit plant growth. Thus,Toney would not recommend a land application system for the backwash water.
