Dear Mr. Holcomb,
On March 8, 2023, the Mooresville Regional Office received the completed written request for a variance
to the well construction rules, specifically rule 15A NCAC 2C.0113 (b)(6), which specifies "wells
constructed in consolidated rock formations or that penetrate zones of consolidated rock may be filled
with grout, sand, gravel, or drill cuttings within zones of consolidated rock. The top of any sand, gravel
or cuttings shall terminate at least ten (10) feet below the top of the consolidated rock or five (5) feet
below the bottom of casing in a manner to ensure complete filling of the casing and extend up to land
surface."
The Variance request is for the abandonment of an Industrial water supply well located at 188 Sidetrack
Drive, Statesville, Iredell County.
Based upon the information that has been submitted, a variance to the above -cited rule is granted. The
abandonment method in this instance is consistent with the definition of well abandonment in G.S. 87-
88(k)(2) in that the well has been effectively sealed to prevent the well from becoming a potential source
of contamination to the groundwater. This variance will be effective from the date issued.
It is my finding that the factors specified above are sufficient to satisfy the conditions for approval of a
variance as defined in 15A NCAC 2C.0101(b). A copy of this variance shall be attached to the required
Well Abandonment Record (GW-30). The granting of this variance is for the abandonment of the well
only, and in no way relieves the owner or agent from other requirements of the North Carolina Well
Construction Standards, or any other applicable law, rule or regulation that may be regulated by other
agencies. If you are dissatisfied with this decision, you may commence a contested case by filing a
petition under G.S. 150-23 within sixty (60) days after receipt of the decision.
