(UNCLASSIFIED) Classification: UNCLASSIFIED Caveats: NONE Marla, My observations were that there were wetlands on the downstream sides of Crossings #2 and #4. The application indicated stream length. Crossing #2= approximately 250 square feet of wetland impacts instead of 35 If of stream impact. Crossing #4= approximately 450 square feet of wetland impacts instead of 10 If of stream impact. My assessment is: -The total amount of wetland fill is approximately 0.01 acre. -We required stream mitigation for the 10 If of impact at site 4(1:1). -The total amount of wetland impacts (had it been permitted), would not have required any compensatory mitigation. -The fill footprint and the project design will not change. Heath and I discussed the observations. Sometimes, depending upon the time of year you are on a site, making the distinction between wetland resources and stream resources can be difficult. That seems to be what happened. We also discussed that typically, if there is no bed/bank and there is wetland vegetation within the project footprint, we would typically determine the resource to be a wetland. At this point, I have noted the resource determination discrepancy in my compliance inspection report, but since there are no changes to the design or the mitigation requirement, I am recommending no further action. I went back over the application package. It was not identified as a widening, but rather "grade, drain, base and pave". The plans I received were EC plans and had no topo lines or other identifying features that would indicate the amount of disturbance and hillside removal. I assume for minor paving projects that there will only be minor disturbance. Of course the more disturbance, the more concern about sediment getting into the waterway and about destruction of wildlife habitat. There should be a better way to determine the scope of work in an application. South Prong Lewis Fork does have records for some trout, but we determined there was not a significant enough population to warrant a moratorium. Smallmouth Bass, a popular game fish, have been recorded in greater numbers, but we no longer request a moratorium for them. We are concerned, however, about sedimentation and thermal impacts to this species. They occur in a narrow temperature range and requires a stream bed of clean gravel or fine rubble for spawning.
