The North Carolina Department of Transportation (NCDOT) has scheduled to widen and
improve SR 2220 (Tom Starling Rd) in Cumberland County. Total project length is 4.43mi.

Construction of this project will require impacts to the waters of the United States in the Cape
Fear River Basin. The project is located within the 03030004 Hydrologic Unit, sub basin 03-06-
15. All Permit Sites #1-5 are unnamed tributaries of Rockfish Creek (C).
This site is located in Southern Cumberland County and is an often used `cut through' road
between Business US 301 and NC 87 by all motorist types. Tractor trailers frequent Tom
Starling Rd. as the Cumberland County industrial park is located toward the beginning and
middle of SR 2220. There is presently two tight radial curves, whieh in addition to speed
contribute to run off road crashes. A re-design of both reverse curves to accommodate increased
speed in addition to 2ft widening has been deemed the most appropriate action.
Permit Site #1 is located at Station 37+10. Currently a 50 LF 48" CMP conveys water
underneath the roadbed. Within the confines of this project the stream portion has had great
human influence. A natural, spring feed, intermittent system begins roughly 100ft downstream
of this project. This makes the portion within the work zone a contributing surface water of
Rockfish Creek and as such will incur 0.004acres of surface water impacts from the proposed
installation of 2(60 LF 54" RCP). One pipe will be inline with the channel for normal flows,
while the second pipe will be set offline to act as a floodplain pipe. A headwall will be loeated
upstream, while 10 LF of Class I stone will be installed on the banks downstream to protect
against erosive velocities. Dewatering operations shall result in 0.003acres of temporary
impacts.
Permit Site #2 located at Station 127+23 has an existing 60 LF 42" CMP, which will be
replaced with an 80 LF 60" RCP with Headwall upstream. Tl�ere is an 18" RCP driveway pipe
that comes into join the tributary upstream. Class I rip rap will be placed on the banks within this
junction area to protect the banks from scouring. 10 LF of Class I rip rap will be placed on banks
downstream due to grade changes from the roadway to natural ground to protect banks from
erosion. As this intermittent stream is an unnamed tributary of Rockfish Creek it will incur 20
LF of permanent stream impacts and 20 LF of temporary impacts due to dewatering measures.
Permit Site #3 currently contains 2(62 LF 36" RCP) at Station 136+13. These pipes will be
replaced with a single line 93 LF (95" x 67") CSAP with Headwalls. This perennial stream will
thus incur 31 LF of permanent impacts and 20 LF of temporary impacts from dewatering
operations. All BMP's sball be followed during construction and upon completion 10 LF of
Class I rip rap will be placed on banks of the outlet for bank stabilization.
Permit Site #4 conveys water underneath SR 2220 through existing 2(48 LF 36" RCP) at
Station 164+14. NCDOT proposes to replace these double lines with a single 60 LF (103" x 7P')
CSAP with Headwalls. There is a small, dammed pond upstream on private property; proposed
grades reflect 1 ft burial below existing stream bed. 10 LF of Class I rip rap will be placed on
banks on the outlet end to assist in erosion protection. This intermittent stream channel will incur
12 LF of permanent impacts and 20 LF of temporary impacts due to dewatering.
Permit Site #5 is located at Station 214+22 and currently has an 65 LF 18" RCP. This pipe is
dramatically undersized and shall be upgraded to an 65 LF 36" RCP. This intermittent unnamed
tributary of Rockfish Creek rated a 21.75 utilizing the Stream Assessment form. No permanent
stream impacts shall be incurred as the pipe is being replaced with the same length and set at the
same elevations. 20 LF of temporary impacts from dewatering will result.
RESOURCESTATUS
In general, there will be minor impacts proposed as a result of the replacement of the culvert and
wetland fill along SR 2220, Tom Starling Rd in Cumberland County. A Nationwide Permit #14
/ NCDENR 401 WQC 3886 is required for the project.
Endangered Species: Plants and animals with Federal classification of Endangered (E) or
Threatened (T) are protected under provisions of Section 7 and Section 9 of the Endangered
Species Act of 1973, as amended. As of December 26, 2012, the U.S. Fish and Wildlife Service
lists seven (7) federally protected species for Cumberland County.

REGULATORY APPROVALS
Application is hereby made for a Department of the Army Nationwide Permit 14 ! NCDENR 401
WQC 3886 as required by the above-described activities.
The National Register was reviewed in addition to conducting a field view of the project for
significant historic features.
The projecY impacts are minor in nature and should not remove or degrade existing water quality
uses. Pipe size proposed are the minimum necessary to create a safe highway while
accommodating the 25-year design storm. By utilizing the erosion control measures,
downstream water quality standazds will be protected. All appropriate BMP's will be uYilized
during construction.
Attached is a Preconstruction Notification Form, plan sheets, marked county road map, quad
location map and photographs.

This road is located in South Western Fayetteville and is a'cut-through' road between Bus US 301 and NC 87.
Cumberland County industrial park is located at the projects beginning, while residential neighborhoods are located
towards the end.

3d. Explain the purpose of the proposed project:
This is a safety project to eliminate the hvo reverse curves in the middle of Tom Starling Rd. These curves, coupled with
the narrow width throughout the entire road contribute to a high crash volume.
3e. Describe the overall project in detail, including the type of equipment to be used:
The two reverse curves will be eliminated. The radius will be increased to flatten both curves into a more fluid motion for
motorists. Culverts will be replaced and extended to accommodate improvements. The entire road will experience 2ft
widening and resurfacing. Impacts will be minimized as much as possible. The culverts will be replaced utilizing a track-
hoe excavator. While front end loaders will place fill material. Eventually a motor grader will finish grade the project prior
to paving.

Both reverse curves where re-aligned so that all culvert sites could be replaced in their existing location.

The roadway shall be closed for the replacement of sites #2  so that pipes are placed back within the channel area and
no boring will be necessary. Rip rap protection will be installed on banks and not within the stream channel. Double line
culverts are being replaced with single line barrels where possible. Permit Site#1 shall have a main barrel inline with the
channel while the other is set offline for a floodplain pipe.

Due to the minimal transportation impact resulting from this Spot Safety project, this project will neither influence nearby

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicanYs acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will
provide an approved JD to accomplish that result, as soon as is practicable.
