(Fayetteville Outer Loop) Notice of Violation X-0002 C NOV-2013-PC-0281 Dear Ms. Chapman: This correspondence is in reply to your Notice of Violation dated August 7, 2013 for the X-0002C project (Fayetteville Outer Loop). On July 31, 2013, Mr. Herndon observed two sediment basins that had failed. The sediment material from the two basins discharged into jurisdictional area within Permit Site #4 near Sta.-L-118+00 LT and -L-119+00 RT was removed by the Barnhill Contracting Company, but was not reported to DWR. While the discharge was not reported for this area of the project, the Division did overlook these discharges while still reporting discharges on other areas of the project. For the months of June and July approximately 33 inches of rainfall was experienced on the project. Many of the rainfall events were of a short duration, high intensity variety, i.e. 2 incres o��er 1 hour duration. Barnhill Contracting Company and the NCDOT worked diligently to keep up with the excessive amount of rainfall that fell during the two months. Several of the skimmer basins blew out around the outlet pipe (which had become saturated), and water was flowing along the pipe until it blew out the dam. We had committed 20 or more laborers with buckets to clean out the sediment that was lost in the jurisdictional areas. We should point out that Barnhill did not design the basins, or the capacity of the basins. Since this has liappened, we have tried to use different fabrics on the outlet end of the basin to try and stop the infiltration of water along the PVC outlet pipe. Mr. Herndon noted that an excavator was conducting repairs to the outlet weir with no erosion-measut�es in place to control the turbid water. It is our understanding that the existing silt fence was knocked down and overcome with sediment when the basin blew out. We have discussed this with our foreman and have told them that measures need to be in place prior to fixing basins that are discharging turbid water. Since this November, we have met with Mr. Herndon and NCDOT to discuss this matter and talk about ways to prevent this in the future. Also, all areas have been mitigated and stabilized.
