Sullins, Director Division of Water Quality Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). This final permit includes no significant changes from the draft permit sent to you on September 26, 2007; however, you are reminded of the following changes in its terms from those found in your existing permit: Daily maximum limits for ammonia have been added to the permit. Since December 2002, the Division has been adding daily maximum limits for ammonia to permits with monthly average limits in order to conform to federal NPDES regulations. • Instream monitoring requirements for dissolved oxygen have been added to the permit to correct the mistake of their removal from the 2003 permit. Monitoring and limits for total residual chlorine have been removed from the permit as a result of ultraviolet (UV) disinfection being installed at the WWTP. However, a condition has been added to the permit describing actions you must take should the UV system not function properly. If the UV system fails and chlorine compounds are used as an alternate means of disinfection, daily monitoring and a 28 µg/L daily maximum limit will apply to the discharge. Please note that minor changes have been made to the wording of this condition, but its content remains the same as stated in the draft. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Total Residual Chlorine monitoring requirements and limits are applicable if chlorine compounds are used for disinfection. Permit NCO061425 A. (2.) TEMPORARY MEANS OF DISINFECTION In the event that the wastewater treatment plant's ultraviolet (UV) disinfection system should fail, underperform, or otherwise be removed from effective service, the permittee or his agent should immediately inform the Surface Water Protection Section staff of the Winston-Salem Regional Office of this development and discuss temporary, alternate means for disinfection of the effluent. If chlorine compounds are used as temporary means of disinfection, the total residual chlorine (TRC) concentration of the effluent must be monitored on a daily basis while this method of disinfection is in use and values must be reported on the discharge monitoring report. TRC in the effluent may not exceed 28 µg/L; therefore, dechlorination methods may also be necessary to ensure protection of water quality in the receiving stream. Use of a disinfection system other than the permitted UV system during circumstances not deemed as emergency and/or temporary (replacement of lamps, lamp cleaning or maintenance, etc.) will be considered a violation of the terms of this permit. NC0061425 Willow Valley Resort WWTP_ This permit was modified in 2005 to remove the monitoring and limit for total residual chlorine, because they use UV. This is in agreement with our internal permitting policy. Recent inspections indicate they have no back up system, so there'd be no real need to even keep a parameter listing for TRC with a footnote stating monitoring would be required only if it is used. However, there still seems to be concern around here as to how to potentially deal with those occasions when a UV system would fail. I'm going to suggest that we add a condition to the permit that would require the permittee to call the regional office upon their knowledge of the UV system failing (I'd say this is already a term of the permit). At the same time, the SWP staff could discuss with the permittee any plans that ought to be made to implement a temporary, alternate means of disinfection. Such plans could be site and circumstance specific, with factors such as flow, receiving stream, control mechanism and length of time the UV system is anticipated to be down being taken into account. It may be the region's determination that an alternate means would potentially do more harm than good. Such a determination would not release the permittee from compliance with fecal coliform limits. What do you think? Is such a term necessary? Also for the existing permit, I notice that there is instream monitoring for temperature, but no such monitoring for dissolved oxygen. D.O. was monitored instream in the 1997 permit. Do you think there's a need to reintroduce this monitoring? I believe when Susan looked at this, her feeling was that the temperature and D.O. ought to go hand in hand, and if one wasn't there, the other had less meaning. They'll be getting a daily max limit for ammonia per our standard renewal policy. _NC0036242 Woodland Hills Apartments_ The existing permit has temperature monitoring at the upstream and downstream locations, but not at the effluent. Should it be added there? Obviously, I don't think this will bring about great hardship to the facility. As a part of standard policy, we'll be adding daily maximum limits for both ammonia and total residual chlorine. For TRC, they'll get an eighteen month compliance schedule to install either UV or dechlor. For this one, do you have any idea as to who/what should be designated as the permitted entity? The owners seem to be a family doing business under multiple corporations/LLCs. They've got me confused, but that's not hard to do. NCO050610 The Ponds WWTP_ This one has the same issue as Willow Valley with regard to potential need for temporary disinfection. Additionally, they'll get the ammonia limits. As I've gone over these and other permits from western counties, I've noticed we haven't always adhered to our rules with regard to monitoring frequencies for temperature. I looked at other permits with continuous flow monitoring requirements and the standard seems to be frequency Continuous and Sample Type Recording. If this permit has not been rewritten yet to change requirements for C12 monitoring, could the flow monitoring be changed at the same time? Thanks! I'll handle those. The facility has UV disinfection and has had this prior to the reissuance in 2003. The permit should not have included a chlorine limit when it was issued in Feb.2003. I do think we need to consider this an administrative error on our part during the issuance back in 2003 and proceed to modify the permit (remove the Chlorine limits) as an administrative clean up rather than having them go through the hoops for requesting a permit modification and paying any fees and taking months to clean this up.. Hq and or the region and the permittee all should have caught this back in 2003. Can you proceed to make this permit limit modification w/o the request from the permittee?
