This office has reviewed the subject erosion and sedimentation control plan. We find the plan to be
acceptable with modifications and hereby issue this letter of Approval with Modifications. The
Modifications Required for Approval are listed on the attached page. This plan approval shall expire three
(3) years following the date of approval, if no land -disturbing activity has been undertaken, as is required
by Title 15A NCAC 413 .0129.
As of April 1, 2019, all new construction activities are required to complete and submit an electronic
Notice of Intent (eNOI) form requesting a Certificate of Coverage (COC) under the NCGO10000
Construction General Permit. After the form is reviewed and found to be complete, you will receive a link
with payment instructions for the $100 annual permit fee. After the fee is processed, you will receive the
COC via email. As the Financially Responsible Party shown on the FRO form submitted for this
project, you MUST obtain the COC prior to commencement of any land disturbing.

project changes in the future, the new responsible party must obtain a new COC.
Title 15A NCAC 413 .0118(a) and the NCGO1 permit require that the following documentation be kept on

1. The approved E&SC plan as well as any approved deviation.
2. The NCGO1 permit and the COC, once it is received.
3. Records of inspections made during the previous 30 days.
Also, this letter gives the notice required by G.S. 113A-61.1(a) of our right of periodic inspection to
ensure compliance with the approved plan.
North Carolina's Sedimentation Pollution Control Act is performance -oriented, requiring protection of
existing natural resources and adjoining properties. If, following the commencement of this project, it is
determined that the erosion and sedimentation control plan is inadequate to meet the requirements of the
Sedimentation Pollution Control Act of 1973 (North Carolina General Statute 113A-51 through 66), this
office may require revisions to the plan and implementation of the revisions to ensure compliance with the
Act.
Acceptance and approval of this plan is conditioned upon your compliance with Federal and State water
quality laws, regulations, and rules. In addition, local city or county ordinances or rules may also apply to
this land -disturbing activity. This approval does not supersede any other permit or approval.
Please note that this approval is based in part on the accuracy of the information provided in the Financial
Responsibility Form, which you provided. You are requested to file an amended form if there is any
change in the information included on the form. In addition, it would be helpful if you notify this office of
the proposed starting date for this project.

Sheet C4.1 must continue to show the temporary skimmer basin. The referenced skimmer basin must
remain until all upgradient areas have stabilized and NC DEQ DEMLR approves its removal.
2. During the phase shown on Sheet C4.1, a temporary diversion may be needed across the proposed
Crystal Downs Drive road area, to maintain positive drainage to the temporary basin, until the new storm
drain system is installed.
3. Additional measures may be required - The applicant is responsible for the control of sediment on -site. If
the approved erosion and sedimentation control measures prove insufficient, the applicant must take

Fact Sheet on the New NCGO1 Permit
April 2019
The NC Construction General Permit (also known as was renewed on April 1, 2019. The updated permit
does not significantly change the measures that are required to be implemented on construction sites. However,
there are some organizational and technical updates to the permit as described below. Mostnotably, there isanew
process in which construction sites will obtain official coverage under an NCGO1 permit through an electronic
process. DEMLR worked with a broad team of stakeholders to make all of these updates. |fyou have questions,

Organizational Updates
The new permit:

The NCGO1 Process
The new 0CG01 applies tmpermits approved nwwrafter April 1, 2019,
Pennitteeswill nolonger receive acopy ofthe NOG01permit inthe mail
with their E&5CPlan approvals and beconsidered ascovered under the
permit. Federal rules require that DEK8LRreceive anNO|oneach
construction project and issue each construction project its own [O[.
Under the new NCGD1process, construction sites will continue to
receive approval for B&S[Plans from either DEK8LRorthe delegated
local E86[program just like before, After receiving E&5[Plan approval,
permitteeswill officially obtain coverage under the NCGD1by
completing one'NO|(available at ). The e'NO|will
only take about 2Uminutes tnfill out and submit nn'|ine.
Initially, there will benocharge associated with applying for anNCGO1
permit but onnraround June 1,2O19,DEWlLRwill begin charging a$10O
annual general permit fee asrequired per §143'21S.3D.
DEMLRis working oncreating asingle application form that will allow an
applicant tusimultaneously apply for anE&SCpermit and anN[GO1

Why do construction sites have to do this extra application step?
DEK8LKisrequired bythe EPA toissue aspecific CO[toevery construction
site that disturbs one acre ormore. DE&lUHisworking tucreate aform
that combines the E&S[p|on approval and e-N0 processes, but that will
take more time. For now, DEMLR has created an efficient e-NOI process.
ManE&SC Plan is approved before April 2°whimh permit applies?
Projects with already approved E&S[Plans will automatically follow the
new N[GOIpermit, but will not need tofill out ane'NO|orpay anannual
permit fee, However, the permhteesshould print the new permit and the
two standanjdetail sheets and have them onsite.
Will DEMLRoffer tools tmhelp permkttemncomply with the new NCG01?
Yes DEK4URwill provide two sample plan sheets ot that
can beplaced into the E&5[plan set. The first covers the site stabilization
and materials handling portions ofthe permit. The second sheet covers
the inspection, record -keeping and reporting portions ufthe permit.
How will the new e-NOImmbmmittal and COC process work?
Pennitteeawill apply for E&SCPlan approvals from DEK4LRorthe local
E&3[program like before. The E&5[approval letter will instruct the
permitteetmvisit tosubmit ane'N0form tnDEK#LR.
The perrnitteemay begin the construction activity after receipt ofthe CO[
(within three days*).The permit1eemust print and retain acopy ofthe
permit and the [OCun site. Initially, the [D[xvi|| be issued for free but on

Who is allowed tosubmit an e-NOUYmmn?
Submittal must be by a responsible corporate off icer that owns or
operates the activity, such as a president,secretary, treasurer, orvice
president or a manager that is authorized in accordance with |V.B.6 of the
N[GU1permit. Additional signatory options are set forth in|V.8.6cfthe

and email ittothe responsible entity for signature &submittal.
What happens tuthe COCwwhen the construction activity iucomplete?
When aproject is complete, the pennhteeswill contact DEMLRorthe local

report, the permitteewill visit tosubmit ane'NOT,
Will there be a grace period for adherence tothe new process?
DEMLKdoes not have the authority togrant agrace period from a
federally mandated permit, Permitteeswill beinformed nfthe new
process via web site, EQSC Plan approval letters and list sera. If
construction activity disturbs one acne or more (or is part of common plan
ufdevelopment that disturbs one acre mrmore) fails tosubmit une'NO|

How does the new NCG01 affect the
delegated local E&SC Programs?
