2013 — 2014 Compliance Report. This report documents the measures taken by NCGTP to ensure compliance
with the conditions of the Department of the Army Section 404 permit (Action ID No. SAW-1992-02851) and the
North Carolina Division of Water Quality (NCDWQ) Section 401 Water Quality Certification (WQC Project #
970093, WQC #3184). Included in this report is an accounting of the authorized impacts that occurred during FY
2013 — 2014.
This report is an addendum to the Baseline Report Documenting Compliance with the Conditions of the
Department of the Army Permit, Action ID No. 199202851 and Water Quality Certification (January 2013) that
summarized the activities that have occurred at the NCGTP from October 1998 through June 30, 2012.

1. Introduction
This report documents the measures that have been taken by NCGTP during FY
2013 —14 (July 1, 2013 —June 30, 2014) to ensure compliance with the conditions of
the Department of Army Section 404 permit (Action ID No. SAW-1992-02851) and
the North Carolina Division of Water Quality (NCDWQ) Section 401 Water Quality
Certification (WQC Project # 970093, WQC # 3184) issued in 1998. This report is an
addendum to the Baseline Report Documenting Compliance with the Conditions of
the Department of Army Permit Action ID No. 199202851 and Water Quality
Certification #3184 (NCGTP 2012).
The North Carolina Global TransPark (NCGTP) in Kinston, North Carolina consists
of 5,775 acres of land targeted for development as an intermodal transportation
facility for supply and distribution of goods and services to commercial, agricultural,
industrial, and military clients. Currently the focus of the NCGTP is on development
within the 2,533 acres owned by NCGTP and specifically 876 acres surrounding the
11,500 foot runway.
2. Wetland Impacts
The Section 404 permit issued in 1998 authorized a total of 870.9 acres of
impacts to wetlands; 106.4 acres of riverine (riparian) wetlands and 764.5 acres of
inter-stream (nonriparian) wetlands within the 5,775 acre permit area. As stated in
Special Condition 1 of the Section 404 permit, authorization was issued in two parts:
Area A for which the NCGTP provided detailed specific plans, and Area B for which
the NCGTP has provided preliminary or conceptual plans. Wetlands designated as
Area A wetlands total 76.4 acres (42.5 acres riparian and 33.9 acres non-riparian).
Wetlands designated as Area B wetlands total 794.5 acres (63.9 acres riparian and
730.6 acres non-riparian). The NCGTP maintains a ledger that documents authorized
wetland impacts and is updated with each authorized wetland impact. As of lune 30,
2014 a total of 130.9 acres of impacts have occurred leaving a balance of 739.93
acres of authorized impact (Table 1).
2.1 Area A Permit Activities
No impacts to Area A wetlands were requested or authorized during FY 2013 —
14. Remaining authorized impacts to Area A wetlands total 41.3 acres (19.8 acres
riparian and 21.5 acres non-riparian).

2.2 Area B Permit Activities
In March 2014, the GTP requested permission to impact .28 acres of riverine
wetlands to construct two access roads adjacent to the GTP Rail Spur (Permit No.
SAW-2008-02650/Attachment 1) to provide access to City of Kinston utility lines.
Table 1 reflects an additional .28 acre debit in riparian impacts under the Rail Spur
project.
3. Permit Modifications
Discussions were held with the USACE on 27 June 2014 concerning the potential
for modifying the permit boundary to include 158 acres of GTP owned property
north of the current permit boundary adjacent to NC 58 (Parcel 5).
4. Compensatory Mitigation
There have been no changes to 4,566 acres of wetlands and riparian areas the
NCGTP has successfully restored, enhanced, and preserved at three different
locations within the Lower Neuse River Basin (HUC 03020202). The NCGTP began
implementation of the mitigation plan and its key components in 1998 and
completed the major cbmponents of the mitigation plan in 2009.
These sites are:
• Dover Bay, a 3100-acre area on Carolina Bay located near pover in
Craven County;
Stonyton Creek Conservation Area (SCCA), a 366-acre site located within
the NCGTP permit boundary along a 2.6-mile reach of Stonyton Creek;
and
• Frog Hollow, 1100 acres of Neuse River floodplain wetlands and bluffs in
Craven County.
5. Compliance with Neuse River Basin — Nutrient Sensitive Waters
Management Strategy
Development within the NCGTP permit boundary must comply with the Neuse
River Basin — Nutrient Sensitive Waters Management Strategy, specificalty rules 15A
NCAC 2B .0233 and 2B .0235. As described below the NCGTP has taken actions to
comply with these rules and will continue to implement policies and procedures to
ensure compliance with these rules. The NCGTP approved a revision to its Exclusive
Development Ordinance on March 23, 2011 to include the Stormwater Control and
Watercourse Buffer Ordinance. This ordinance incorporates restrictions on
development within protected riparian buffers that are consistent with 15A NCAC 26
.0233 and requires on-site stormwater controls to reduce nitrogen export and peak
runoff as required by 15A NCAC 2B .0235.

5.1 Protection and Maintenance of Riparian Buffers
No impacts to riparian buffers were requested or authorized during FY 2013 —
14.
5.2 Stormwater Requirements
5.2.1 Nutrient Loading
No new development or re-development occurred within the NCGTP permit area
during FY 2013 —14. The Total Nitrogen Export from the NCGTP permit area is 2.48
Ibs/acre/year (Table 2).
5.2.2 Peak Flows
No new development or re-development occurred within the NCGTP permit area
during FY 2013 — 14.
6. NPDES Stormwater Permit
As required under NPDES Permit Number NCS000516, a Stormwater
Management Plan (SWMP) has been developed and implemented by the NCGTP.
Activities that have been conducted during FY 2013 —14 are documented in the Year
3 Annual Report submitted to the NCDWQ on June 23, 2014 and is listed on the
NCGTP website.
7. Historic Preservation Plan (HPP)
No development or re-development that would have impacted historic resources
occurred within the NCGTP permit area during FY 2013 —14. The annual HPP report
was submitted to the North Carolina Department of Cultural Resources (NCDCR) on
111une 2014. Attachment 3 is NCDCR acknowledgement of receipt.

Subject: Permit Modification Request — City of Kinston Utility Access Roads
Raii Access Spur to NC Global TransPark

Dear Ms. Wheeler:
On behaff of the NC Global TransPark I am requesting a madification of Permit No. SAW-2Q08-
02650 issued on February 17, 2010 to authorize impacts to jurisdictional areas for the construction
of two access roads to access City of Kinston maintained utilities. The construction of the rail spur
eliminated the use of the existing access roads resulting in the need to construct one new access
road and install cuiver#s in an existing access road. As described below, and shown in the attached
figures, the additional impacts to jurisdictional areas will occur at two different locations. The
construction af these roads will result in the piacement of fill in 0.28 acres (11,853 sq ft) o# riverine
wetlands. In addition construction wil) result in temporary imparts to 0.08 acres (3,531 sq ft) of
riverine wetlands. Permanent and temporary impacts have been minimized to the maximum
extent practicable.
Approval of this request wifl increase the permanent impacts to wetlands for this project by 0.28
acres to 7.21 acres (1.23 acres riverine; 5.98 acres non-riverine). Compensatory mitigation for the
additional impacts will be debited from the Stonyton Creek Conservation Area.
DescriQtion and Justification
Dobbs Farm Road — Sanitarv Sewer Access Road
The purpose of the access road is to provide access for the City of Kinston ta perform maintenance
on the eastern portion of the sanitary sewer (ine that extends from Dobbs Schoof to Robinwood
Drive. The existing deeded easement for access to the eastern portion of this sewer line is now
inaccessible due to the construction of the Rail Access Spur. The location of the proposed road as
�hown on the attached drawing provides the least amount of wetland disturbance as compared to

other options that were evaluated. 7he construction of this access road will resul# in the
placement of fill in 0.24 acres (10,257 square feet) of riverine wetlands. The proposed impacts are
located at Site 10 as shown on Figure 1 of the origina! permit application.
The majority of the wetiand impact is associated with the turn-around at the end of the road
(Figures 1— 3). The impacts to jurisdictional areas are unavoidable due to the following reasons:
1. The access road mus# extend to the existing sanitary sewer easernent to provide direct
access to the sewer line.
2. The maintenance vehicle that wili utilize the proposed access road to service the sewer line
is the smailest maintenance vehicle operated by the City af Kinston Water Reclamation
Section. This vehicle carries two tanks with a total capacity of 3,500 gailons {1,500 gallons
of water and 2,000 gallons of sewage) and is approximately the size of a school bus.
Therefore, a school bus design turning radius template was used to determine the size of
the turn-around required to safely maneuver the ma'rntenance vehicle.
3. Due to the topography of the area the portion of the road that is ciosest to the sewer iine
wiil be elevated requiring the area around the road and turn-around be sloped and graded
to ensure that stormwater will flow away from the road and turn-around to prevent
washouts.
4. The turn-around is necessary for the safety of the operators of the maintenance vehicle.
Without the turn-around the vehicle would be required to back down the length of the
access road (approximately 750 feet} and into traffic on Dobbs Farm Road.
WYE —Electric Line Access Road
The purpose of the access road is to provide access for the City of Kinston to perform maintenance
on elettric lines that are parallel to the existing rail road. The existing deeded easement for access
to the electric lines is now inaccessible due to the construction of the Rail Access Spur. As shown
on Figures 4 and 5, crossing the relocated linear wetland and the pre-existing linear wetland is
necessary to provide access to the power lines. Crossing these jurisdictional features will require
the installation of cuiverts and associated grading o# the linear wetlands to ensure proper
drainage. The culverts will be installed in accordance with NCDOT standard procedures for the
installation of culverts in jurisdictional areas. The construction of this access road will result in
permanent impacts to 0.04 acres {1,596 square feetj and temporary impacts to 0.08 acres (3,531
square feet) of riverine we#lands. The proposed impacts are located at Site 1 as shown on Figure 1
of the original permit application.
The impacts to jurisdictional areas are unavoidable due to the following reasons:
1. An access road is necessary to provide the City of Kinston access to their existing power
poles that are now inaccessible due to the GTP Rail Spur crossing over their access.

z. The size of vehicle that will be utilizing this driveway will be a single unit truck with a
bucket lift. The closest design vehicle I could find that would articulate the turning
movement of this vehicle is an AASH70 SU-40 and is shown on the attached plan
sheet. The road design was based off of the turning movements of this vehicle.
3. The temporary impacts are necessary to maintain existing flows within the linear wetlands.

Reference the Department of the Army permit issued on February 17, 20l 0 and the written
request submitted by Ron Ferrell of PBS&J on behalf of NC Global TransPark Authority dated
September 23, 20I0. The issued permit authorized wetland and stream impacts associated with
tlie construction of a 5.66 mile long railroad spur in and adjacent to the existing North Carolina
Global TransPark located north of US Highway 74 and west of NC Hi�tiway 58 adjacent to
Stonyton Creek and �3riery Ru.0 north and west of Kinston in Lenoir, North Carolina.
On March 25, 2014, Mr. Fenell submitted a request for pernut modification to authorize
irnpacts associzted with the construction of two access roads to allow the City of Kinston to
maintain utilities located adjacent to the pernvtted rail spur. As proposed, these activities would
require impacts ta an additiona10.28 acres of jurisdictional wetlands. Review of the enclosed
drawings and subsequent discussions indicate that the proposed impacts are unavoidable.
Therefore, tfie permit has been madified to allow construction of the 922 foot long sewer access
road south of Dobbs Farm Road and east of the NCGTP RaiI Access Spur, as shown on the plats
titled, Figure 1 and Figure 2, Dobbs Farm Road, received in tnis office Mazch 25, 2014, and
designed by Roadway Design and Hydraulics Engineers with I�TCDOT. Construction of this
access road will result in the permanent loss of 0.2� acres of jurisdictional riverine wetlands. The
permit has also been moditied to all�w construction of two wetiand crossings east of Sand Clay
Road to allow the City of Kinston to access telephone poles as shown on the plats titled, Figure 4
und Figure 5, WYE, received in this office March 25, 2014, and designed by Roadway Design
and Hydraulics Engineers with NCDOT. Construction of these crossings ��vill result in permanent
impacts to 0.04 acres of jurisdictional riverine wetlands and tenl�orary impacts to 0.08 acres of
jurisdictional riverine wetland. Mitigation for the U.28 acres of jurisdictional riverine wetland

impacts will be debited from the Stonyton Creek mitigation site at a 5:1 ratio. Any increase in
impact amount wilt require further modif cation of this permit, It is understood that all conditions
of the original permit remain applicable and that the expiration date is �.uichanged.
