Good afternoon All,
The DWR has reviewed the CAMA major permit application for excavation of a boat basin and access
channel at an existing docking facility located at 1913 and 1917 Atlantic Drive in Wilmington, New
Hanover County. The Division of Water Resources (DWR) has additional questions regarding the
proposed development and has determined that additional information will be necessary to
complete the review of your permit application. The existing docking facility is located in the
SA;ORW waters of Middle Sound. The DWR rules for ORW waters state No dredge or fill activities shall
be allowed if those activities would result in a reduction of the beds of "submerged aquatic vegetation habitat" or
"shellfish producing habitat," defined in 15A NCAC 03I.0101, and incorporated by reference including subsequent
amendments and editions, except for maintenance dredging, such as that required to maintain access to existing
channels and facilities located within the designated areas, The docking facility is located adjacent mapped
SAV and area within the dredged footprint contains suitable SAV habitat. The existing depths at the
docking facility remain consistent with those that were documented in the 2004 major permit and it
appears the request to dredge to -3' MLW would be new dredging (beyond the documented depth
in 2004) and not considered maintenance by the DWR. Avoidance and minimization of impacts
should be considered and extension of the facility to deeper water an alternative option to
dredging. Similar concerns regarding dredging have been raised by the DMF and WRC, however
formal comments have not been received by the DWR. The DWR has requested and is waiting
receipt of the resource agency comments. Once those comments have been received the DWR will
compile a more detailed request for additional information that incorporates those agency
comments. The application is on hold until the information requested above has been received
