The Cherokee Department of Transportation on behalf of the Eastern Band of Cherokee Indians requests
your review of the Will Scott Church Road Improvement Project. Will Scott Church Road is a BIA Road
(BIA Route 488), but not all the road is on Tribal Trust Land. The four culvert replacement sites are not
on trust land.

Please ensure you have submitted a pre -filing meeting request at least 30 days prior to submitting this
form, as DWR will not be able to accept your application without documentation of this important first step.
The Division has developed a Pre -filing Meeting Request email address 401 PreFileCa)_ncdenr.gov to accept
the federally required pre -filing meeting request and provide confirmation receipt of submittal . This receipt
or similar documentation will satisfy 40 C.F.R. Section 121.4(a) which states "At least 30 days prior to
submitting a certification request, the project proponent shall request a pre -filing meeting with the certifying
agency." In accordance with 40 C.F.R. Section 121.5(b)(7), and (c)(5), all certification requests must
include documentation that a pre -filing meeting request was submitted to the certifying authority at least 30
days prior to submitting the certification request.

Cherokee Department of Transportation would like to improve Will Scott Church Road to allow for better access
for enrolled members that live in that community.
4i. Describe the overall project in detail, including the type of equipment to be used:
CDOT will replace and upgrade all existing culverts, work all ditchlines, and pave the existing gravel road. Erosion
controls will be installed and all disturbed soil will be seeded as soon as practical. All culvert work will be completed in the
dry by dewatering (see dewatering design). Equipment will be adequate to complete the job and will inspected daily for
leaks of any kind.

area, including silt fencing material around the fill sites. The entire site will be reseeded within 30 days of instillation.

Project Special Provisions
Major and Minor Structures '`�; P.VN�`���
Precast Box culvert shall be considered a major structure. All other pipes, including the 95"X67" CSPA
shall be minor structures.
Detour 1
Contractor shall mark Wil Scott Church parking as shown for proposed detour. Contractor shall use
pavement marking tape or temporary pavement markings as necessary. Contract shall maintain temp
markings as needed for the life of the detour.
Contractor shall remove existing block wall and perform earthwork as necessary to tie from Wil Scott
Church parking lot to Wil Scott Church Road. Unpaved portion of detour shall be completed with 8" of
ABC Stone. Contractor shall replace block wall upon removal of detour.
Contractor and Tribal Roads Inspector shall document the condition of the existing pavement to be used
in the detour prior to construction. Contractor shall pave connection to Wil Scott Church Road as a
driveway for the church.
No direct payment will be made for any items covered above. Payment will be made under:

PRECAST REINFORCED CONCRETE (12-12-13)
BOX CULVERT AT STATION 11+22
GENERAL
This Special Provision covers the design, fabrication and construction of precast reinforced
concrete box culverts intended for the conveyance of storm water.
When a precast reinforced concrete box culvert is required on the plans, design the precast
culvert sections in accordance with ASTM C 1577 or the current edition of the AASHTO
LRFD Bridge Design Specifications. Rate all sizes of precast reinforced concrete box
culverts in accordance with the current edition of the AASHTO Manual for Bridge
Evaluation. Ensure the culvert rates for the AASHTO design loads and North Carolina's
legal loads (see Section 2.0 for North Carolina's legal loads). Provide the size and number
of barrels as indicated on the plans. Detail the culvert with cast -in -place wings walls and
footings. Precast wing walls and footings will not be allowed. Provide a precast box culvert
that meets the requirements of Section 1077 and any other applicable parts of the Standard
Specifications.
The design and rating of the precast and cast -in -place members is the responsibility of the
Contractor and is subject to review, comments and approval. Submit two sets of detailed
plans and rating sheets for review. Include all details in the plans, including the size and
spacing of the required reinforcement necessary to build the precast box and cast -in -place
members. Have a North Carolina Registered Professional Engineer check and seal the plans,
rating sheets and design calculations. After the plans, rating sheets and design calculations
are reviewed and, if necessary, the corrections made, submit one set of plans and rating sheets
on 22" x 34" sheets to become part of the contract plans.
Culvert shall be designed and installed in accordance with the attached "Guidance for When
to Use Sills/Baffles in Box Culverts" Appendix F-Item 1 dated 01/06/2014.

Guidance for When to Use Sills/Baffles in Box Culverts
The following is to be used as a guide to help the engineer in determining when to use sills/baffles in box
culverts. The guide is intended primarily for reinforced concrete box culverts but may also be applicable to
larger Aluminum Box Culverts, Corrugated Steel Pipes and Corrugated Steel Pipe Arches. The Culvert Avoidance
and Minimization Design Guidance memo dated 4/24/12 should be referenced for criteria to evaluate in culvert
design. The Native Material Specification Memo dated 1/6/14 should also be referenced for material to be used
to backfill sills/baffles.
Sills are vertical extensions attached to the culvert bottom placed at the inlet and outlet of the culvert. Baffles
are vertical extensions attached to the culvert bottom placed at designed intervals inside the culvert beyond the
sills located at the inlet and outlet. Sills can be used to retain the native material in the culvert as well as to help
prevent head cutting. Sills may be used at the inlet and outlet of the higher flow barrels of multiple barreled
culverts to help maintain the natural stream width and depth through one or more of the barrels. Baffles can be
used together with sills to help retain native material in culverts on steeper slopes. Sills and baffles may also be
used to help slow velocities in very steep culverts. Baffles can also be used together with sills to help create a
low flow channel in the culvert by varying the dimensions (height and width) of the sills/baffles. See figure 1
below for example of sill/baffle detail:

It should be noted that baffles and sills do not have to be alternating as shown in the above detail. Each stream
crossing should be evaluated by the engineer to determine the appropriate design. The engineer should
evaluate the need for using sills/baffles based on factors such as culvert width, stream width, culvert slope,
stream slope, culvert length, stream stability, bed material, propensity to head cut and the need for floodplain
benches. The following criteria may be used as a guide in determining when to use sills/baffles in box culverts.
Evaluate Culvert Width vs. Stream Width
Designing the culvert width to match the stream's low flow width is preferred if possible. The designer should
look up and down stream of an existing structure to determine the stream's low flow width, as the width of the
stream close to the existing structure is in many cases wider. If the culvert barrel width when compared to the
existing streams low flow width is such that the stream's low flow width and depth cannot be maintained
through the culvert, then the use of sills and baffles will be required to establish a continuous low flow channel
through the culvert barrel. The height of the sills and baffles should vary across the width of the culvert barrel to
provide a continuous low flow channel through the culvert similar to the natural streams low flow width and
depth. See Figure 2 for reference. The sills and baffles should be spaced throughout the length of the culvert to
hold the bed material and maintain adequate flow depth during low flow conditions. The culvert should be
buried a minimum of 1 foot and backfilled with native material. The top of the low flow sills/baffles should
match the stream bed elevation in the low flow channel.

Evaluate Culvert Slope vs. Stream Slope
If the culvert barrel dimensions are such that the stream's low flow width and depth can be maintained through
the culvert, then the culvert slope/stream slope should be evaluated to determine if sills and or baffles are
required to help retain the bed material in the culvert. In this case the dimensions of the sills/baffles does not
need to vary since the width and slope of the culvert will maintain the stream's low flow width and depth. The
purpose of the sills and baffles is to hold the bed material in the culvert and help prevent head cutting. The
following general guidance may be used when determining the need for sills and baffles based on culvert
slope/stream slope (stream stability and bed material should be considered also as noted below).
• If the culvert slope/stream slope is less than 1%, then sills and baffles are generally not required. Burying the
culvert a minimum of 1 foot below the stream bed and allowing it to fill in on its own should suffice. If the
stream is very unstable and the stream slope varies up and downstream of the culvert then the engineer
should evaluate if sills and baffles should be used. Typically unstable streams with less coarse bed materials
(sand and silt) may require the use of sills and baffles at slopes less than 1%.
• If the culvert slope/stream slope is between 1% and 2% then sills and baffles are generally required to help
retain the native material in the culvert barrel. The culvert should be buried a minimum of 1 foot below the
stream bed with sills and baffles. The sill and baffle height should match the burial depth and they should
be backfilled with native material. If the stream is very stable and if the stream slope is constant throughout
the length of the culvert as well as up and downstream of the culvert then the use of sills and baffles may
not be required. Typically stable streams with coarser bed materials (gravel, cobbles and boulders) would
be more likely to not require sills and baffles until you reach slopes above 2%.
• If the culvert slope/stream slope is greater than 2%, then sills and baffles are required to help retain the
native material in the culvert barrel. The culvert should be buried a minimum of 1 foot below the stream
bed with sills and baffles. The sill and baffle height should match the burial depth and they should be
backfilled with native material.
Floodplain Benches
For multiple barrel culverts where high flow barrels are required with floodplain benches at the inlet and outlet,
sills should be used. Sills should be placed at the inlet and outlet of the high flow barrel(s) and the barrel(s)
should be backfilled to the sill height with native material. The sill height at the inlet and outlet of the high flow
barrel should be above the low flow normal water surface elevation. See Figures 3 for reference. Figure 3
shows a multi barrel culvert with one barrel that matches the low flow stream width and the other barrel with
sills and floodplain benches at the inlet and outlet. The low flow barrel for this detail matches the streams low
flow width and does not require sills to retain the bed material. Figure 4 below is a picture of a multiple barrel
culvert with floodplain bench.

Wide single span culverts such as Aluminum Box Culverts may require floodplain benches at the inlet and outlet
to maintain the natural stream width up and downstream of the culvert. The sills for these types of structures
should be detailed to provide a low flow notch to match the stream's low flow width. See figure 5 below for
example detail:

Sill Spacing
Sills/baffles in culverts are typically spaced at approximately 25' intervals. On slopes steeper than 2%, the
spacing may be shortened to an interval length of 0.5' divided by the slope of the culvert or as deemed
appropriate by the engineer. 10' is typically the minimum spacing used. The engineer should space the sills to
hold the bed material and maintain adequate flow during low flow conditions.
The engineer should detail the dimensions, locations and spacing of the sills/baffles on the CSR (or on a detail to
be included with the CSR) and note which culvert barrels should be backfilled with native material.

Native Material Specification (Use only when called for on plans)
• Native Material consists of material that is excavated from the stream bed or floodplain at the
project site during culvert construction. Only material that is excavated from the stream bed
may be used to line the low flow culvert barrel. Rip rap may be used to supplement the Native
Material in the high flow culvert barrel(s). If rip rap is used to line the high flow culvert barrel(s),
Native Material should be placed on top to fill voids and provide a flat surface for animal
passage. Native Material is subject to approval by the engineer and may be subject to permit
conditions.
The above note may be modified as follows if there is no high flow culvert barrel:
• Native Material consists of material that is excavated from the stream bed at the project site
during culvert construction. Native Material is subject to approval by the engineer and may be
subject to permit conditions.
The above note may be modified as follows if native material is only required in the high flow culvert

project site during culvert construction. Rip rap may be used to supplement the Native Material

The appropriate note above should be placed on the Culvert Survey Report (CSR) when backfilling the

the CSR) and note which culvert barrels should be backfilled with native material.
Native material should be paid for as incidental to the culvert construction. Additional rip rap, if
needed, will be paid at the contract price of rip rap or negotiated price if not already in the contract.
APPENDIX F
ITEM 3
CULVERT AVOIDANCE AND MINIMIZATION DESIGN GUIDANCE
When designing a culvert, the engineer should ensure that the following avoidance and
minimization design criteria have been evaluated and implemented as much as practicable.
• Proposed culvert slope is consistent with the existing stream slope.
• Proposed low flow dimensions through the culvert are consistent with the existing low
flow channel dimensions in the stream. Alternating low flow sills/baffles may be
required to achieve this.
• Proposed low flow velocities through the culvert are consistent with the existing low flow
velocities in the stream.
• Proposed culvert is appropriately buried such that the bed material will be retained
throughout the culvert length. The use of alternating low flow sills/baffles should be
evaluated based on culvert slope, bed material and stream stability.
• The dimension and profile of the stream above and below the culvert should not be
modified by widening the stream channel or by reducing the depth of the stream in the
vicinity of the culvert. Establishment of a low flow floodplain bench should be evaluated
at the inlet and outlet of multiple barrel culverts.
• Culvert length has been minimized as much as possible.
• Culvert alignment avoids sharp bends at the inlet and outlet as much as practicable to
avoid bank erosion at the inlet and outlet. Stream realignment and/or armoring may be
warranted to improve culvert alignment and/or to mitigate potential stream bank erosion.
The amount of stream work to be done up and down stream should be minimized as
much as possible.
APPENDIX F
ITEM 4
Guidance for Modeline Aluminum Box Culvert (ABC) in HEC-RAS April 2012
Since the Corrugated Metal Box Culvert shape in HEC-RAS does not match the actual area of the ABC
when the span and rise of the ABC is input into the HEC-RAS model, the following methodology should
be used to model the ABC. The span of the ABC should be reduced while maintaining the rise until the
effective area of the ABC is approximated in the HECRAS model. It should be noted that although this
methodology is not considered to be exact, for most situations it should provide a more conservative
answer.
ABCs should be modeled in HEC-RAS as Corrugated Metal Box Culverts using the Culvert Data Editor as
follows:
Select culvert Shape as Box. The Span should be reduced as necessary (by trial and error) to provide a
culvert area opening that is reflective of the effective open area of the culvert. Use the ABC Size Chart
(attached) to determine the actual area of the ABC. If the culvert is buried or altered by other means
such as sills/baffles, low flow floodplain benches etc., then determine the effective open area by
subtracting out the blockage from the actual area of the ABC. The Rise should be the actual rise of the
proposed ABC and should not be adjusted. The computed open area of the culvert can then be
compared to the effective open area of the ABC. Chart # should be 16, 17, 18 or 19 depending on the
rise/span ratio noted in HDS-5 for the particular chart. The rise/span ratio should be based on the actual
dimensions of the ABC (do not use the reduced span length). Scale # 1 should be used based on 90
degree headwall. All other information should be appropriately filled in based on the proposed culvert.
Example: 15'-9" X 8'-0" ABC, buried 1' below stream bed.
Actual culvert area from ABC Chart = 111.8 ftZ, rise/span ratio = 0.5079, use Chart # 19, 90 degree
headwall, use scale #1.
Effective open area of culvert = Actual Culvert area — blockage.
15.75' bottom span x 1' (bury depth) = 15.75 ft2 blockage.

PRECAST REINFORCED CONCRETE Boa SECTIONS
The precast reinforced concrete box culvert sections shall match the size and hydraulic
opening indicated in the contract plans.
Design
Joints
Design Fill — The design earth cover is reported on the plans as the elevation difference
between the point of maximum fill and the bottom of the top slab.
Placement of Reinforcement — Provide a 1 inch concrete cover over the reinforcement
subject to the provisions of Section F. Extend the inside reinforcement into the
tongue portion of the joint and the outside reinforcement into the groove portion of
the joint. Detail the clear distance of the end wires so it is not less than 1/2 inch or
more than 2 inches from the ends of the box section. Assemble reinforcement per
the requirements of ASTM C1577 or the approved design. The exposure of the ends
of the wires used to position the reinforcement is not a cause for rejection.
Laps and Spacing — Use lap splices for the transverse reinforcement. Detail the
transverse wires so that the center to center spacing is not less than 2 inches or more
than 4 inches. Do not detail the longitudinal wires with a center to center spacing of
more than 8 inches.
Produce the precast reinforced concrete box section with tongue and groove ends.
Design and form these ends of the box section so, when the sections are laid together,
they make a continuous line of box sections with a smooth interior free of appreciable
irregularities in the flowline, all compatible with the permissible variations given in
Section F. The internal joint formed at the tongue and groove ends of the precast
units shall be sealed with either bitumenfbutyl sealant or closed -cell neoprene
material. The internal joint material shall be installed in accordance with the
manufacturer's recommendations. The material shall be shown on the shop drawings
when they are submitted for review.
Seal the external joint with an outside sealer wrap conforming to ASTM C877 that is
at least 12 inches wide and covers the joint on both the sides and the top of the box
section. Use ConWrap CS-212 from Concrete Sealants, Inc., EZ-Wrap from Press -
Seal Gasket Corporation, Seal Wrap from Mar -Mac Manufacturing Co., Inc.,
Cadilloc External Pipe Joint from Cadilloc, or an approved equal for the outside
sealer wrap. If the outside sealer wrap is not applied in a continuous strip along the
entire joint, a 12 inch minimum lap of the outside sealer wrap is permitted. Before
placing the outside sealer wrap, clean and prime the area receiving the outside sealer
wrap in accordance with the sealer wrap manufacturer recommendations. The joint
wrap manufacturer installation recommendations shall be included with shop
drawings submitted for review. The external joint wrap shall be installed in pieces,
as indicated on Figure 1 below:

Cover the external joint sealer with a 3 foot strip of filter fabric conforming to Type 4
requirements in Section 1056 of the Standard Specifications.
Place multiple lines of a precast reinforced concrete box culvert such that the
longitudinal joint between the sections has a minimum width of 3 inches. Fill the
joint between multiple lines of precast box sections with Class A concrete. Use
Class A concrete that meets the requirements listed in the Standard Specifications
except that Field Compressive Strength Specimens are not required.
Manufacture
Manufacture precast reinforced concrete box culvert sections by either the wet cast
method or dry cast method.
Mixture — In addition to the requirements of Section 1077 of the Standard
Specifications, do not proportion the mix with less than 564lb/yd3 of portland
cement.
Strength — Concrete shall develop a minimum 28-day compressive strength of
5000 psi. Movement of the precast sections should be minimized during the initial
curing period. Any damage caused by moving or handling during the initial curing
phase will be grounds for rejection of that precast section.
Air Entrainment — Air entrain the concrete in accordance with Section 1077 - 5(A) of
the Standard Specifications. For dry cast manufacturing, air entrainment is not
required.
Testing — Test the concrete in accordance with the requirements of Section 1077 - 5(B).
Handling — Handling devices or holes are permitted in each box section for the purpose
of handling and placing. Submit details of handling devices or holes for approval
and do not cast any concrete until approval is granted. Remove all handling devices
flush with concrete surfaces as directed. Fill holes in a neat and workmanlike manner
with an approved non-metallic non -shrink grout, concrete, or hole plug.
Physical Requirements
Acceptability of precast culvert sections is based on concrete cylinders made and tested
in accordance with ASTM C31 and ASTM C39.
Permissible Variations
Flatness — All external surfaces shall be flat, true, and plumb. Irregularities,
depressions, or high spots on all external surfaces shall not exceed 1/2 inch in 8 feet.
Internal Dimensions — Produce sections so that the internal and haunch dimensions do
not vary more than 1/4 inch from the plan dimensions.
Adjacent Sections - Internal, external, and haunch dimensions for connecting sections
shall not vary more than 1/2 inch.
Length of Tongue and Groove — The minimum length of the tongue shall be 4 inches.
The minimum length of the groove shall be 4 inches. The dimensions of the tongue
and groove shall not vary more than 1/4 inch from the plan dimensions.
Slab and Wall Thickness — Produce sections so that the slab and wall thickness are not
less than that shown on the plans by more than 5% or 3/16 inch, whichever is greater.
A thickness more than that required on the plans is not a cause for rejection.
Length of Opposite Surfaces — Produce sections so that variations in laying lengths of
two opposite surfaces of the box section meet the requirements of ASTM C 1577,
Section 11.3.
Length of Section — Produce sections so that the underrun in length of a section is not
more than 1/2 inch in any box section.
Position of Reinforcement — Produce sections so that the maximum variation in the
position of the reinforcement is f3/8 inch for slab and wall thicknesses of 5 inches or
less and f 1 /2 inch for slab and wall thicknesses greater than 5 inches. Produce
sections so that the concrete cover is never less than 5/8 inch as measured to the
internal surface or the external surface. The preceding minimum cover limitations
do not apply at the mating surfaces of the joint.
Area of Reinforcement — Use the design steel shown on the plans for the steel
reinforcement. Steel areas greater than those required are not cause for rejection.
The permissible variation in diameter of any wire in finished fabric is prescribed for
the wire before fabrication by either AASHTO M32 or M225.
N.
Marking
Each section shall be match -marked in order of intended installation as indicated on
the approved shop drawings. Ensure that pieces fit together neatly and in a
workmanlike manner. In order to ensure a good, neat field fit, the Department will
verify assembly of the first five adjacent sections or 20% of the total culvert length,
whichever is greater, at the producer's facility and match -mark the pieces. This will
require that a minimum of three adjacent sections of the culvert be fitted at the
production yard at a time and then match -marked. Once three sections have been
match -marked, the first section may be removed for shipment and a fourth section set
for marking. Continue in a progressive manner until all sections have been properly
match -marked. The producer shall document the GO -NO-GO dimensional
measurements of each box culvert section produced through the post -pour inspection
process.
Clearly mark each section of the box culvert in accordance with ASTM C 1577, Section
15. The information requirements of Section 15.1 shall be clearly marked on the
inner surface of each section.
Construction
Pre -installation Meeting — A pre -installation meeting is required prior to installation.
Representatives from the Contractor, the precast box manufacturer, and the
Department should attend this meeting. The precast box manufacturer representative
shall be on site during installation.
Foundation — Foundation for precast box culvert shall meet the requirements of Section
414 of the Standard Specifications. In addition, Type VI foundation material shall
be encapsulated in filter fabric conforming to Type 4 requirements in Section 1056
of the Standard Specifications. The filter fabric shall be placed perpendicular to the
culvert barrel. Provide sufficient overhang beyond the excavation to allow a
minimum lap of 3 feet when the foundation material is placed and fabric wrapped on
top. Perpendicular sections of fabric shall be continuous. A minimum lap of 2 feet
shall be provided between sections of fabric.
Installation — Sections shall be placed at the beginning of the outlet end of the culvert
with the groove end being laid upgrade. Tongue sections shall be laid into the groove
sections. Positive means shall be provided to pull each section firmly into the
previously placed section so that the joints are tightly homed. Use a "come -along",
box pullers or other approved methods to create a positive means of joining box
sections. Construction equipment shall not have direct contact with the box section.
The load of the box shall be suspended by lifting device during joining procedure.
Backfill — Complete backfill in accordance with Section 414 of the Standard
Specifications.

BASIS OF PAYMENT
The Precast Reinforced Concrete Box Culvert as described on the plans and in this Special
Provision will be paid for at the contract lump sum price for "Precast Reinforced Concrete
Box Culvert at Station 11+22
Such price and payment will be full compensation for all work covered by this Special
Provision, the plans and applicable parts of the Standard Specifications and will include, but
not be limited to, furnishing all labor, materials (including all filter fabric), equipment and
other incidentals necessary to complete this work. Such price and payment will also be full
compensation for concrete, reinforcing steel, labor, equipment and all other related materials
necessary for the completion of the barrel section, and the construction of the headwalls, end
curtain walls, wings and wing footings. Culvert Excavation and Foundation Conditioning
Material will be paid for in accordance with the Standard Specifications and will not be a
part of this pay item.

The Corps of Engineers believes that there may be jurisdictional aquatic resources in
the review area, and the requestor of this PJD is hereby advised of his or her option
to request and obtain an approved JD (AJD) for that review area based on an
informed decision after having discussed the various types of JDs and their
characteristics and circumstances when they may be appropriate.
In any circumstance where a permit applicant obtains an individual permit, or a
Nationwide General Permit (NWP) or other general permit verification requiring "pre -
construction notification" (PCN), or requests verification for a non -reporting NWP or
other general permit, and the permit applicant has not requested an AJD for the
activity, the permit applicant is hereby made aware that: (1) the permit applicant has
elected to seek a permit authorization based on a PJD, which does not make an
official determination of jurisdictional aquatic resources; (2) the applicant has the
option to request an AJD before accepting the terms and conditions of the permit
authorization, and that basing a permit authorization on an AJD could possibly result
in less compensatory mitigation being required or different special conditions; (3) the
applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can
accept a permit authorization and thereby agree to comply with all the terms and
conditions of that permit, including whatever mitigation requirements the Corps has
determined to be necessary; (5) undertaking any activity in reliance upon the subject
permit authorization without requesting an AJD constitutes the applicant's acceptance
of the use of the PJD; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps permit

and conditions contained therein), or individual permit denial can be administratively
appealed pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it
becomes appropriate to make an official determination whether geographic
jurisdiction exists over aquatic resources in the review area, or to provide an official
delineation of jurisdictional aquatic resources in the review area, the Corps will

On April 6, 2022, the United States Supreme Court issued an order staying a lower court's vacatur of the
Trump Administration's 2020 "Clean Water Act Section 401 Certification Rule" ("Federal Rule"). As a result of
the United States Supreme Court order, the Trump Administration's Federal Rule has sprung back into effect.
The Trump Administration's Federal Rule imposes additional procedural requirements on applicants for 401
Certifications and on DWR's processing of those applications. One requirement is that 401 applicants must
request a pre -filing meeting request at least 30 days prior to submitting their 401 application. [40 C.F.R.
§121.4] In turn, the Federal Rule requires that applicants include documentation of their pre -filing meeting

Pursuant to Section 106 of the National Historic Preservation Act, the Tribal Historic Preservation Office
(THPO) must review any project involving ground disturbance on federal lands, or utilizing federal
monies. The THPO makes an assessment of probability for archaeological and cultural resources for
each specific project. When applicable, the THPO will include recommendations for the protection of
significant cultural resources based on the individual site assessment.
The EBCI THPO reviewed the Will Scott Church Road Culvert Replacement Project located just outside of
Murphy, NC. A Phase I archaeological survey was not performed. Site #2 may be partially on EBCI Tribal
Lands and partially on NC lands. Given the topography and location of the culvert replacement, there is
a low probability for significant archaeological resources and considering the limited impact of the
project, the THPO predicts this undertaking will have no adverse effect to any unidentified cultural
resources. Regarding Site #1, it is outside of EBCI held land boundaries. Please contact Linda Hall at the

This document establishes a framework for cooperation and participation between the EBCI Natural Resources
and the Bureau of Indian Affairs (BIA) Division of Forestry regarding federally threatened and endangered
species, along with critical habitat, residing within EBCI lands. Any tract which trees will be cut must be
evaluated for Indiana Bat, Northern Long -Eared Bat, and Small Whorled Pogonia presence and habitat both
pre- and post -harvest. The Natural Resources Department is responsible for assisting other agencies and the
public in the conservation, protection, and enhancement of fish, wildlife, plants, and their habitats, in
accordance with the provisions of Section 7 of the Endangered Species Act of 1973. The Natural Resources
Department understands that the BIA is currently evaluating timber permits for the following project:
This is a culvert replacement project from Cherokee Department of Transportation project slated for the Wil
Scott Church Road on Parcel No. 85-E and non -tribal lands in Cherokee CO.— with less than 0.1 acre of impact
with 15 trees to be removed or trimmed but with a potential for 20 total trees removed along a roadway and
creek. Only 2 trees are large enough to be available for bat roosting. This was evaluated on 11/16/22 by BIA
Forestry Cherokee Agency to contain potential bat habitat and submitted to Cherokee Fish and Wildlife office
on 11/29/22.
The EBCI Natural Resources Department has reviewed the project above and has determined that the project:
"may affect"
federally listed bat species due to project timing and presence of bat habitat. However, the proposed project aligns
with the conditions set in the Programmatic Biological Assessment (PBA). Therefore, the project does not require
further consultation provided that the project follows conservation measures related to potential project stressors
outlined in the PBA and a post -assessment is conducted to ensure affected acreage is captured appropriately.
Affected acreage will be documented following procedures outlined in the PBA.

replacement project located at Will Scott Church Road, on Wit Scott Creek in the Murphy, Cherokee Co,
NC.
The Eastern Band of Cherokee Indians (EBCI) department of Natural Resources is requesting
authorization underthe Army Corps of Engineers 404 Nationwide Permit program as a representative of
the EBCI Department of Transportation for multiple culvert replacements on Wil Scott Creek in Cherokee
Co, NC.
The EBCI plans to perform road improvement work and culvert replacements on Wit Scott Church Road.
Wit Scott Church Road is a BIA road, but parts of it are not on Trust Land. The four stream crossings are
not on Trust Land. At site one, they will replace the existing 24' of 60" pipe with 24' of 95"x67" CS Pipe
arch, with end walls. This will have no new Impact. At site two, they will replace 20' of 36" CMP with
25' of 48" RCP, with end walls. There will be 5' of new Impact. At site three, they will replace 40' of
48" CMP with 115' of Double 5'x4' RCBC, with end walls. This will have 75' of new Impact. At site
four, they will replace two - 30' of 24" CMP with 40' of 87"x63" CS Pipe Arch, with end walls. This
will have 10' of new Impact. The calculated total of new impact will be 90 linear feet. All work will be
completed in the dry and all best management practices will be applied to the project area. This includes
the use of fibermatting, sediment basins, silt fence, and rip rap. Comments from the EBCI Natural
Resources program are offered for your consideration under provisions of the Clean Water Act of 1977
(33 U.S.C. 466 et. Seq.) and the Memorandum of Agreement (MOA) developed between the U.S. Army
Corps of Engineers (Wilmington District) and the EBCI.
The EBCI does have records of fish surveys from Wit Scott Creek. Wit Scott Creek holds a "C"
classification, meaning that these are waters protected for uses such as secondary recreation, fishing,
wildlife, fish consumption, aquatic life including propagation, survival and maintenance of biological
integrity, and agriculture. Secondary recreation includes wading, boating, and other uses involving human
body contact with waterwhere such activities take place in an infrequent, unorganized, or incidental
manner. The EBCI Natural Resources supports the permitting of this project with the following
recommendations:
1) Due to the potential presence of a variety offish species of conservation concern downstream of
the project site in the Hiwassee River, it is not feasible to avoid stream disturbance during critical
spawning periods simultaneously. Therefore, the duration of site disturbance should be
minimized to mitigate negative impacts to spawning aquatic organism reproduction and survival
downstream of the project.
2) Measures to control sediment and erosion should be installed before any ground -disturbing
activities occur to minimize effects on downstream aquatic resources. Herbaceous vegetation
should be planted on all bare soil within 15 days of ground disturbing activities to provide long-
term erosion control. Disturbed soils in steep slopes and riparian areas should be stabilized with
heavy fibermatting in addition to seeding. Matting should be secured in place with staples,
stakes, or wherever possible, live stakes of native trees. Discharging hydro -seed mixtures and
washing out hydro -seeders and other equipment in or adjacent to surface waters is prohibited.
3) Heavy equipment should be utilized from the stream bank and not in the channel whenever
feasible. All mechanized equipment operated near surface waters should be inspected and
maintained regularly to prevent contamination of stream waters from fuels, lubricants, hydraulic
fluids or other toxic materials. Uncured concrete must not contact the stream because this can kill
fish.
4) All work within the stream should be completed in the dry with the use of temporary diversion
structures. Materials used for flow diversions should be removed from the stream bed after
completing the construction work.
5) All culverts that will be installed for this project should be properly imbedded in the thalweg and
installed at the stream grade. This will allow proper aquatic organism passage.
6) Riprap placed for bank stabilization should be limited to the stream bank below the high-water
mark and vegetation should be used above. Rip rap should not be placed in the stream channel in
a manner that obstructs aquatic life passage.

Pursuant to CWA Section 401(33 U.S.C. 1251, 1341), the Eastern Band of Cherokee Indians (EBCI) is
required to certify whether the activity described below will not violate applicable water quality
standards. Accordingly, The EBCI Water Quality Office (WQO) requires reasonable assurance that the
activity will not violate provisions of EBCI Water Quality Standards, Administrative Procedure Act,
Cherokee Code, Chapter 150, provisions of EBCI Fish & Game Regulations and Guidelines, and other
EBCI water protection provisions, law or regulations.
The Eastern Band of Cherokee Indians Water Quality Office (WQO) issues this letter to serve as
notification of water quality certification as required for the multiple culvert replacements on Wil Scott
Creek in Cherokee Co, NC.
Based on information submitted as part of the application for a 401 Water Quality Certification, followed
by a Technical Review, the EBCI Water Quality Office and EBCI Fish & Game Office has concluded that
no significant adverse impacts to water quality are expected as a result in the multiple culvert
replacements on Will Scott Creek.
Therefore, the EBCI WQO is issuing this grant of 401 Certification, subject to the 401 General
Conditions attached. This certification is issued to the EBCI Department of Transportation for the
multiple culvert replacements on Wil Scott Creek in Cherokee Co, NC.

EBCI 401 CERTIFICATION GENERAL CONDITIONS.
1. Measures shall be taken to prevent or control spills of fuels, lubricants or other toxic
materials used in construction from entering the watercourse.
2. All dredged material shall be removed to an upland location and/or graded on adjacent
areas (so long as such areas are not regulated wetlands), to obtain original streamside
elevations, i.e. overbank flooding shall not be artificially obstructed.
3. In areas not riprapped or otherwise stabilized, revegetation of stream banks and
riparian zones shall occur concurrently with project progression. At a minimum,
revegetation will approximate pre -disturbance conditions.
4. To the maximum extent practicable, all instream work under this certification shall be
performed during low flow.
5. Heavy equipment, e.g. bulldozers, backhoes, draglines, etc., if required for this project,
should not be used or operated within the stream channel. In those instances where
such instream work is unavoidable, then it shall be performed in such a manner and
duration as to minimize suspension of sediments and disturbance to substrates and
bank or riparian vegetation.
6. Any fill or riprap including refuse fill, shall be of such composition that it will not
adversely affect the biological, chemical or physical properties of the receiving waters
and/or cause violations of water quality standards. If riprap is utilized, it is to be of
such weight and size that bank stress or slump conditions will not be created because
of its placement.
7. If there are water supply intakes located downstream that may be affected by increased
turbidity and suspended solids, the permittee shall notify the operator when work will
be done.
8. Removal of existing riparian vegetation should be restricted to the minimum necessary
for project construction.
9. Should evidence of stream pollution or jurisdictional wetland impairment and/or
violations of water quality standards occur as a result of this activity (either from a
spill or other forms of water pollution), the EBCI Water Quality Section shall be
notified immediately by calling 828-359-6772.
