HomeMy WebLinkAboutNC0023868_Wasteload Allocation_19871109P DIVISION OF ENVIRONMENTAL MANAGEMENT November 9, 1987 MEMORANDUM TO: Arthur Mouberry THROUGH: Steve Tedder FROM: Trevor Clements�� SUBJECT: Comments regarding City of Burlington's objections to the DRAFT permits for their East (NC0023868) and South (NC0023876) facilities I have reviewed the letters submitted by the City of Burlington regarding reissuance of the NPDES permits for their East and South facilities, and I offer the following comments for your consideration: 1. Instream monitoring -for NH3-N Instream monitoring is required for both forms of oxygen -consuming waste (BOD and NH3-N) because of the impact from Burlington's discharge. The East facility's discharge is permitted to comprise 36 percent of the water in the Haw River under low flow (7Q10) conditions. Therefore, the facility's discharge of NH3-N can influence downstream conditions substantially. Low instream values should not pose a problem since standard methods for measurement of NH3-N can detect at least 0.03 mg/1 (APHA, 1985). 2. Toxicity Limits End of pipe toxicity limits are required per EMC and EPA approved state procedures., 3. Metals All metals calculations were based upon Burlington's own headworks analysis for each of their plants. Limits are established by procedure if an average metal concentration in the effluent is expected to be at least one tenth of the allowable concentration necessary to protect the instream standard. These lim- its should be implemented upon renewal of the permit. However, the facility may petition to remove a particular limit after it has demonstrated via monitoring that the limit is not needed (at least 12 consecutive months of data needed). Revised limits for Cd and Ni for the South facility have already been submitted. to you (see memo 10/8/87). 4. Phosphorus Limits Limits for phosphorus must be applied per direction of the EMC and the Division Director under the NSW implementation strategy for Jordan Lake (1987). JTC October 19, 1987 Mr. R. Metals (Nickel and Lead) - Limits are based on a limited amount ci data; therefore, limits should not be imposed at the present time. Monitoring to build --up a data base should be the only requirement at this time. Existing stream limits provides adequate enforcement and stream protection. 4. BOD.and TSS (85 per cent removal) - This requirement is contradictory to effluent limits established in the permit. Per cent removal serves -no useful purpose, since an "activated sludge" plant produces suspended solids and contains side streams high in BOD. We are opposed to such a requirement. Mr. R. Paul Wilms Page 2 October 19, 1987 5. Priority Pollutants - The section dealing with the requirements for evaluating priority pollutants lacks clarity. The requirements should be more specific in regard to laboratory analysis. 6. Total Phosphorus - We are opposed to a phosphorus limit for the 'ollowing reasons: (a) Time is needed to evaluate the impact of the non - phosphate detergent law to be implemented January 1, 1988 (b) There is insufficient time to finance, design and construct phosphorus removal facilities by January 1, 1990. (c) A comprehensive phosphorus study on the Haw River by the "Piedmont Triad Council of Governments" indicates that "point source" phosphorus removal is not needed to protect the Haw River and take Jor uan If you have any questions regarding these comments, please contact '`,r. The North Carolina Ceriodaphnia chronic effluent bioassay proce- dure (North Carolina Chronic Bioassay Procedure - Revised *February 1987) or subsequent versions. The effluent concentration at which there may be no observable inhibi- tion of reproduction or significant mortality is j(j % (defined as treatment two in the North Carolina procedure document). The permit holder shall perform r monitoring using this procedure to establish compliance with the permit ondition. The first test will be performed within thirty days from issuance of this permit. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the appropriate parameter code.
