Dear Mr. Shoaf:
Personnel from the City of Graham contacted the NPDES Unit to notify us that orthophosphate sampling
was no longer being conducted at their facility pursuant to a Memorandum of Understanding (MOU) with the
City of Burlington. The MOU for Instream sampling was finalized with the help of Division personnel in
March, 1996. These permit modifications are being issued to formally confirm the deletion of orthophosphate
sampling requirements from the subject permits.
Please find enclosed the amended Effluent Limitations pages and Instream Monitoring Requirements (Part
III, Condition G.) for each facility. These pages should be inserted into the respective permits. The old pages
should be discarded. All other terms and conditions contained in the original permits remain unchanged and in
full effect. These permit modifications are issued pursuant to the requirements of North Carolina General
Statutes 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental
Protection Agency.
If any parts, measurement frequencies or sampling requirements contained in these permit modifications are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days
following receipt of this letter. This request must be a written petition conforming to Chapter 150B of the
North Carolina General Statutes, filed with the Office of Administrative Hearings, Post Office Drawer 27447,
Raleigh, North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding.

All stream samples shall be grab samples
2 The monthly average BOD5 and Total Suspended Residue concentrations shall not exceed 15% of the respective influent value (85% removal).
3 The daily dissolved oxygen effluent concentration shall not be less than 5.0 mg/1.
4 Compliance shall be based upon a quarterly average of weekly samples.
5 Chronic Toxicity (Cerodaphnia) P/F at 36% - February, May, August & November (see Part III, Condition H.).
6 Conductivity samples shall be collected three times per week during June, July, August & September and once per week during April, May & October.
The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units and shall be monitored weekly at the effluent by grab sample.
There shall be no discharge of floating solids or visible foam in other than trace amounts.

2. Downstream at NC Highway 54 and at NCSR 2158 (above the dam).
All instream samples shall be grab samples.
REPORTING REQUIREMENTS
Data entered on a form approved by the Division and summarized in an annual report
due by January 1st of the year immediately following the summer period when sampling
occurred.
