("Pilot") has prepared this response on behalf of LeoTerra Johnson Street, LLC to address a Request for Additional Information from the USACE/NCDEQ dated December 29, 2022 (attached). The information requested and our responses/comments are included below. 1) Wetland Impact 1 would require a culvert to allow maintenance of hydrologic connectivity per NWP General Conditions 2 and 9, and NWP 29 Regional Condition B.9.a. Please update the plan view accordingly, and provide a profile view showing the culvert location, size, and grade. Response: A culvert has been added under the roadway. Please see the attached culvert exhibit. 2) Based on proposed grading and re-routing of drainage into stormwater ponds, the project appears to eliminate the drainage area/hydrology source for the remainder of the Wetlands WC and WE downslope of proposed fille slopes in the vicinity of proposed Wetland Impacts W3 and W4. Can measures be taken to re -introduce surface or subsurface hydrology to these wetlands at the toe of fill? Typical measures include a French drain from the seep point/wellpoint to an outlet at the toe of fill and/or low velocity discharge from a stormwater pond to the toe of fill. If such changes are practicable, please describe and update the plansheet(s) accordingly. PO Box 128, Kernersville, NC 27285 www.pilotenviro.com Request for Additional Information November 18, 2022 Unless otherwise justified per the above, the Corps would consider the remainder of the wetland downslope of the toe of fill as reasonably foreseeable indirect impacts (see NWP General Conditions "District Engineers Decision") resulting from a loss of hydrology. Compensatory mitigation would be required for such indirect impacts resulting in a loss of aquatic function, typically required at a 1:1 ratio depending largely on resource quality; Response: French drains have been incorporated into the design of the retaining walls (attached). The French drains will daylight beneath the retaining walls upgradient of the wetlands and supply hydrology back to the heads of the wetlands. Additionally, the hydrology of these wetlands also occurs from surfacing groundwater. While some of the surface hydrology may be rerouted during heavy rain events, the wetlands will continue to receive hydrology from the groundwater table. The drainage areas located up gradient of wetland WC will remain approximately 55 percent pervious and the drainage area upgradient of wetland WE will remain approximately 60 pervious. While some of the upgradient surface water may be redirected, there will be no dewatering or disturbance to the groundwater table. Over 55 percent of each of the wetlands drainage area will continue to recharge the groundwater table and the hydrology of these wetlands. As such, hydrology to wetlands WC and WE will continue to be supplied by the groundwater table in addition to the French drains that will daylight upgradient of these wetlands. No significant impacts to these wetlands are anticipated due to indirect impacts. Please see the attached exhibit of French drains that will discharge beneath the retaining walls up gradient of the wetlands. 3) It is your responsibility to contact the North Carolina Division of Water Resources (NCDWR) Winston Salem Regional Office to determine the 401 requirements for this project. Please note that, if an Individual 401 Water Quality Certification (WQC) is required from NCDWR (as appears to eb the case), the Corps cannot verify the use of any NWP without a valid 401 WQC. Response: Noted.
