On October 5, 2006, the Division of Water Quality (DWQ) received your application to
impact streams for the purpose of stream restoration and approval for unauthorized
impacts within the Grey Rock Subdivision. The DWQ has determined that your
application was incomplete andior provided inaccurate information as discussed below.
The DWQ will require additional information in order to process your application to
impact protected wetlands and/or streams on the subject property. Therefore, unless
we receive the additional information requested below, we will have to move toward
denial of your application as required by 15A NCAC 2H .0506 and will place this project
on hold as incomplete until we receive this additional information. Please provide the
following information so that we may continue to review your project.

1. Describe Overall Project in Detail
Under Section III. 10. of your submitted application, you have indicated that
sediment will be removed from a stream segment. As your consultant was notified
via a-mail on October 30, 2005, during the site visit by the DWQ and the Division of
Land Resources, at least 3 additional perennial streams with sediments impacts
were located on the property. A complete and thorough inspection of the site,
mapping of al/ streams on site, and submission of both a map of all streams, and
plans for the removal of sediments from all streams must be submitted as part of
the application.
2. Figure 3.
The provided Figure 3. for the installation of Plate Arch Bridges does not indicate
that the installation of the footers is of a sufficient distance to protect the stream
from moving and becoming unstable due to the installation. Additionally, the details
provided do not indicate the surficial water table which is providing hydrologic
recharge to the stream, it's relation to the proposed footers, and does not provide
protection to groundwater from such an installation. Amore detailed plan must be
provided such that the DWQ can be reasonably assured that waters of the state
shall not be effected.
3. stormwater
The stormwater discussion only addresses the construction of the main
infrastructure for the subdivision. The DWQ requires that the stormwater
discussion be for the life of the project and how stormwater will be managed in
perpetuity. You must provide a detailed discussion as to how stormwater will be
managed for all construction until buildout of the development and for how
stormwater will be managed for the life of the project such that waters of the state
will not be compromised.
Please respond within 15 business days of the date of this letter by sending this
information to me in writing, to Kevin Barnett of the DWQ Asheville Regional Office, and
4 copies to Mrs. Cyndi Karoly in the 401 Central Office. If we do not hear from you
within 15 business days, we will assume that you no longer want to pursue this project
and we will consider the project as withdrawn.

This letter only addresses the application review and does not authorize any impacts to
wetlands, waters or protected buffers. Please be aware that any impacts requested
within your application are not authorized (at this time) by the DWQ. Please call Mr.
Kevin Barnett at 828-296-4657 if you have any questions regarding or would like to set
up a meeting to discuss this matter.
