I apologize, I should have done a betterjob explaining the DWR evaluation we've conducted so far. Yes, there will be
some building in Zone 1 buffers, however DWR is required to adhere to Session Law 2013-395 Section 2 which states
that (Part 11, Section 2(c)(2) "the piping of a stream allowed under a permit issued by the US Army Corps of Engineers
(USACE) shall be categorized as an allowable use". Therefore for us, it would not be a major variance. They will still
need to document a "no practical alternatives" which will be the same process to document "avoidance and
minimization" to the USACE before the agencies would be able to issue any authorizations. Most local governments
haven't updated their ordinances since that Session Law and therefore don't have this allowance (which is fine).

Thanks for the response. The plan submitted by UNC showed the proposed building in Zone 1 and 2 of the Jordan
Riparian buffer. I will leave for the DWR to make the decision, but I thought they have to show No PRACTICAL
ALTERNATIVE to what they are proposing and impervious are in the buffer will need a major variance approval.

Hi Ernest,
Colleen at our Raleigh Regional Office and I met with representatives of UnC to discuss the project a few months
ago. The buffer rules state that DWR is the buffer authority for projects conducted under by local or state entities. We
have always implemented that to include state funded entities like the State colleges and local school systems. We are
happy to dig into that further with the Town if needed.
As we don't have an application we can't comment on what may or may not be approved, but we did discuss the project
and they made substantial modifications after our discussion so that we thought it would not require a variance to the
rules.
Nothing we review or approve negates them from meeting local requirements other than only one of is should be
reviewing under the buffer rules.

I am reviewing an expansion of a building into stream and buffer. UNC Business School is proposing to fill the stream and
riparian buffer to allow this building expansion to occur. I requested a copy of permit approval from NC DEQ but was
told they are yet to submit the permit application however they also said the NCDEQ is in agreement with their plan of
expanding into the stream and buffer. I want confirmation from you about UNC proposal and why the State is allowing
this expansion. Find attached existing condition and proposed condition plan sheet for your review. Thanks and hope to
