A final copy of the permit is attached to this letter for your records. `This permit is issued pursuant to the requirements of the North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated December 6, 1983. The following list-has been included to outline the changes that were addressed in the draft permit. These,changes remain unchanged in the final permit: ➢ A summer and winter limit for ammonia has been included in the permit renewal. These limits will become effective exactly one year from the effective date of the final permit. For the first year, the facility is only required to monitor for ammonia. In addition, the monitoring frequency has changed from 2/m6nth to weekly. This change is consistent with the requirements as specified in the North Carolina Administrative Code Section 15A NCAC 2B.0500 for class II facilities. ➢ The permit expiration date has been changed. The permit renewal will expire on July 31, 2003. The expiration dates have been revised so that an equal number of permit renewals will come in at any one time. This change will allow the Division to issue permits more efficiently. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of P.O. NC0.02.8975 Polk County Per our discussion today, the .A.RO is recommending that the City of Saluda' s permit be, renewed, based on the following information. 1 . A chrQnic ' (full range) toxicity test performed by the State on the WWTV, s effluent in October revealed toxicity due to chlorine disinfection. 2. Based can discussions with the operator and City mayor, the City has elected to have ammonia limits 'in lieu of toxicity limits. 2 . Based. on past DM'R data, it !a evident that the WWTP would not be able to most the proposed ammonia limits There- fore, it is recommended that the.. permit be issued with two mor�itnrircr_.Aimits nacres'. a. The draft permit includes limits for ammonia (2 .4 summer and 5 . 4 winter) . The current permit does not have any limits for ammonia. A review of the previous 12 months of DMR data indicates that the facility will NOT be able to consistently meet the draft limits . Because of past fecal coliform violations and short detention time in the chlorine contact chamber, the wastewater is currently being chlorinated at a higher than normal rate. This raises the question as to whether chronic toxicity tests could be passed by the facility. It is extremely doubtful . As you know, the City of Saluda in currently under a DOJ Consent Order because of an American Canoe Association third-party lawsuit . The City has been in compliance for the past 10 months and has 8 more months of continuous compliance to achieve to get out from under this decree and fines . The City has made tremendous strides toward achieving and maintaining compliance . To impose limits for parameters that we already know that the facility will be unable to meet under present conditions would not be prudent . We are in the process of discussing the ammonia vs . toxicity issue and necessary improvements to the treatment process with the mayor, engineer and ORC. We have scheduled a full range (IWC 36%) chronic toxicity test for week the week of October 26-30th. Please let us know if delaying this permit renewal will be a problem. 12/01/1998 09:55 4 PAGE 03.
