Skvarla, III Secretary Subject NPDES Permit Issuance Permit No. NCO022730 Grassy Gap Creek WWTP Facility Class H Watauga County Dear Mr. Feierabend: Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). The permit authorizes the Town of Beech Mountain to discharge up to 0.080 MGD of treated municipal wastewater from the Grassy Gap Creek W WTP to the Buckeye Creek, a class C trout water in the Watauga River Basin. The permit includes discharge monitoring requirements and/or limitations for flow, BODS, ammonia, total suspended solids, NH3 as N, and total residual chlorine along with other parameters. The following procedure has been implemented by DWQ: Total residual chlorine (TRC) compliance level changed to 50 ug/l. Effective March 1, 2008, the Division received EPA approval to allow a 50 ug/I TRC compliance level. This change is due to analytical difficulties with TRC measurements. Facilities will still be required to report actual results on their monthly discharge monitoring report (DMR) submittals, but for compliance purposes, all TRC 1617 Mail Service Center, Raleigh, North Carolina 27699-1617 Location: 512 N. A footnote regarding this change was added on the effluent limitations page in the permit. The following modification made in the draft permit of April 24, 2013 remains in the final permit: • Based on the completion and approval of the N.C. Statewide Mercury Total Maximum Daily Load (TMDL), the permit now requires one mercury analysis, using EPA Method 1631E, which must be completed within the twelve (12) months prior to the next permit renewal. This requirement is included on the effluent page and in the new special condition A. (2). If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this permit shall be final and binding. Please take notice that this permit is not transferable. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits, which may be required by the Division of Water Quality, or permits required by the Division of Land Resources, Coastal Area Management Act, or any other Federal or Local governmental permits may be required. Reeder Attachments cc: Winston-Salem Regional Office/Surface Water Protection Section Central Files NPDES File Permit NCO022730 STATE OF NORTH CAROLINA DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES DIVISION OF ENVIRONMENTAL MANAGEMENT PERMIT TO DISCHARGE WASTEWATER UNDER THE NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM In compliance with the provisions of North Carolina General Statute 143- 215.1, other lawful standards and regulations promulgated and adopted by the North Carolina Environmental Management Commission, and the Federal Water Pollution Control Act, as amended, Town of Beech Mountain is hereby authorized to discharge wastewater from a facility located at the Grassy Gap WWTP 204 Grassy Gap Creek Road Watauga County to receiving waters designated as Buckeye Creek in the Watauga River Basin in accordance with effluent limitations, monitoring requirements, and other conditions set forth in Parts I, II, III and IV hereof.
