The Division of Water Resources (the Division) hereby issues the attached NPDES permit for the subject
facility. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1
and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency dated October 15, 2007, or as subsequently amended.
The Division understands that you intend to make significant changes to your facility in the near future.
Therefore, we have made the following updates to your previous permit:
• added updates to facility map, outfall locations and parameter codes
• added new Outfall 010 with effluent limitations and monitoring requirements in Section A. (2.)
• added monthly Total Residual Chlorine (TRC) monitoring with limit.
We have made the following updates to the final permit:
• added the following statement to footnote 5 for TRC: Limit and monitoring only apply if the
facility uses chlorinated water for hydrostatic testing
• added instream turbidity monitoring that applies if effluent turbidity exceeds 50NTU.
Proposed federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and
specify that, if a state does not establish a system to receive such submittals, then permittees must submit
DMRs electronically to the Environmental Protection Agency (EPA). The Division anticipates that these
regulations will be adopted and is beginning implementation.
The requirement to begin reporting discharge monitoring data electronically using the NC DWR's
Electronic Discharge Monitoring Report (eDMR) intemet application has been added to your NPDES

If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable, you have the right to an adjudicatory hearing, upon written request submitted within thirty
(30) days after receiving this letter. Your request must take the form of a written petition conforming to
Chapter 150B of North Carolina General Statutes, and you must file it with the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is
made, this permit shall remain final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Resources or any
other Federal, State, or Local governmental permits that may be required.

In compliance with the provisions of North Carolina General Statute 143-215.1, other lawful standards
and regulations promulgated and adopted by the North Carolina Environmental Management
Commission, and the Federal Water Pollution Control Act, as amended,
Blanchard Terminal Company, LLC
is hereby authorized to discharge wastewater from outfalls located at the
Blanchard Terminal Company, LLC — Charlotte Terminal
7401 Old Mount Holly Road, Charlotte 28214
Mecklenburg County
to receiving waters designated as an unnamed tributary to Paw Creek, subbasin 03-08-34 within the
Catawba River Basin in accordance with effluent limitations, monitoring requirements, and other
conditions set forth in Parts I,11, III and IV hereof.
This permit shall become effective July 1, 2015.
This permit and authorization to discharge shall expire at midnight on June 30, 2020.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked, and as of this issuance, any previously issued permit bearing this number is no longer effective.
Therefore, the exclusive authority to operate and discharge from this facility arises under the permit
conditions, requirements, terms, and provisions described herein.
Blanchard Terminal Company, LLC
is hereby authorized to:
1. continue to operate a Surface -Water Pollution Prevention System for stormwater in proximity to
aboveground storage tanks (ASTs) providing surface bulk -storage of petroleum hydrocarbon
fuels in excess of one million gallons, and fuel -truck loading racks; utilizing
• secondary -containment basins (for ASTs)
• point -source discharge valve (normally closed — manually controlled)
• retention pond (Outfall 010)
located at the Blanchard Terminal Company, LLC — Charlotte Terminal, 7401 Old Mount Holly
Road, near Charlotte, Mecklenburg County, and
2. discharge from said treatment works at a point, designated on the attached map, via Outfalls 009
and 010 into an unnamed tributary to Paw Creek [stream segment I 1-124], a waterbody currently
classified C within subbasin 03-08-34 of the Catawba River Basin.

1. No later than 270 days from the effective date of this permit, the permittee shall begin submitting
discharge monitoring reports electronically using the Division's eDMR application system
[see A. (5)].
2. E = Effluent; I = Influent; U = upstream at least 50 feet from the outfall; D = downstream at least 50
feet from the outfall.
3. Flow - During periods of no flow, the Permittee shall submit a monthly Discharge Monitoring
Report (DMR) indicating "No discharge." Flow must be measured with each discharge event and
may be monitored in one of four ways:
a) measure flow continuously;
b) calculate flow based on total rainfall per area draining to the outfall; exclude built -
upon area [See Section A. (4.)]; best method for facilities with large runoff -
collection ponds;.
c) estimate flow at 20-minute intervals during the entire discharge event; or
d) report flow based on discharge pump logs.
4. Oil and Grease - Where possible, the grab sample for oil and grease should be skimmed from
the surface of a quiescent zone.

5. Limit and monitoring only apply if the facility uses chlorinated water for hydrostatic
testing. The Division shall consider TRC effluent values reported below 50 µg/L to be
compliant with the permit. However, the Permittee shall continue to record and submit all
values reported by a North Carolina -certified laboratory method (including field certified), even
if these values fall below 50µg/L.
6. Turbidity - Effluent shall not cause receiving stream turbidity to exceed 50 NTU. If receiving
stream background turbidity exceeds 50 NTU, effluent shall not cause this background value to
increase.
7. Upstream and downstream Turbidity — Monitoring only applies if effluent turbidity exceeds
50 NTU. Upstream and downstream monitoring shall be used to determine occurrence of
stream impacts.
8. Naphthalene - Monitoring requirement applies to facilities that store, or historically stored,
diesel or other heavy fuels on site.
9. Acute Toxicity (Fathead Minnow, 24-hour P/F), Annual [see Special Condition A. (1)]. .
Permittee shall sample for acute toxicity and BTEX concurrently.
Comments:
The Permittee shall discharge no floating solids or foam visible in other than trace amounts.
The Permittee shall discharge no tank solids, tank bottom water, or the rag layer.
There shall be no direct discharge of tank (or pipe) contents following hydrostatic testing unless
benzene concentration is less than 71.4 µg/L and toluene concentration is less than I I µg/L.

A. (3.) ACUTE TOXICITY MONITORING (ANNUAL)
[15A NCAC 02B .0500 et seq.]
The permittee shall conduct acute toxicity tests on an annual basis using protocols defined as definitive
in EPA Document EPA-821-R-02-012 entitled "Methods for Measuring the Acute Toxicity of Effluents
and Receiving Waters to Freshwater and Marine Organisms." The monitoring shall be performed as a
Fathead Minnow (Pimephales promelas) 24 hour static test. Effluent samples for self -monitoring
purposes must be obtained during representative effluent discharge and shall be performed at the
NPDES permitted final effluent discharge below all waste treatment processes.
The parameter code for Pimephales promelas is TAE6C. All toxicity testing results required as part of
this permit condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it
was performed, using the appropriate parameter code. Additionally, DWR Form AT-1 (original) is to be
sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Water Sciences Section no later than 30
days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following the
month of the initial monitoring.

A. (4.) FLOW MEASUREMENT RATIONAL [G.S. 143-215.1(b)]
The Rational uation: Q=KuCIA, where:
Q = flow (peak flow rate (cfs or m3/sec)
Ku = units conversation factor = 1.008 for U.S. standard units (usually ignored
because it is so close to 1), or 0.278 for SI units
C = dimensionless runoff coefficient for the watershed, loosely defined as the
ratio of runoff to rainfall
I = intensity of rainfall taken from the intensity -duration -frequency curves
for the specified design return period at the time of concentration, tc
(in/h or mm/h). tc = time of concentration (time after the beginning of
rainfall excess when all portions of the drainage basin are contributing
simultaneously to flow at the outlet).
A = area of tributary watershed (acres or km2)
The rational equation is used to calculate the runoff from a region, given:
• the runoff coefficient which accounts for infiltration and other potential
losses in the region,
• the rainfall intensity to the region,
• the time it takes for runoff to travel from the region's upper reaches to its
outlet, and the region's drainage area.

A. (5.) ELECTRONIC REPORTING OF DISCHARGE MONITORING
REPORTS [G.S. 143-215.1(b)]
Proposed federal regulations require electronic submittal of all discharge monitoring reports (DMRs)
and specify that, if a state does not establish a system to receive such submittals, then permittees must
submit DMRs electronically to the Environmental Protection Agency (EPA). The Division anticipates
that these regulations will be adopted and is beginning implementation in late 2013.

1. Reporting (Supersedes Section D. (2.) and Section E. (5.) (a)1
Beginning no later than 270 days from the effective date of this permit, the permittee shall begin
reporting discharge monitoring data electronically using the NC DWR's Electronic Discharge
Monitoring Report (eDMR) internet application.
Monitoring results obtained during the previous month(s) shall be summarized for each month and
submitted electronically using eDMR The eDMR system allows permitted facilities to enter
monitoring data and submit DMRs electronically using the internet. Until such time that the state's
eDMR application is compliant with EPA's Cross -Media Electronic Reporting Regulation
(CROMERR), permittees will be required to submit all discharge monitoring data to the state
electronically using eDMR and will be required to complete the eDMR submission by printing,
signing, and submitting one signed original and a copy of the computer printed eDMR to the
following address:

If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility
being physically located in an area where less than 10 percent of the households have broadband
access, then a temporary waiver from the NPDES electronic reporting requirements may be granted
and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1. 1, 2, 3) or
alternative forms approved by the Director. Duplicate signed copies shall be submitted to the
mailing address above.
Requests for temporary waivers from the NPDES electronic reporting requirements must be
submitted in writing to the Division for written approval at least sixty (60) days prior to the date the
facility would be required under this permit to begin using eDMR. Temporary waivers shall be valid

for twelve (12) months and shall thereupon expire. At such time, DMRs shall be submitted
electronically to the Division unless the permittee re -applies for and is granted a new temporary
waiver by the Division.

Regardless of the submission method, the first DMR is due on the last day of the month following
the issuance of the permit or in the case of a new facility, on the last day of the month following the
commencement of discharge.
2. Si oatory Requirements [Supplements Section B (11) (b) and supersedes Section B (11) (d)1
All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part 11,
Section B. (I 1.)(a) or by a duly authorized representative of that person as described in Part II,
Section B. (I 1)(b). A person, and not a position, must be delegated signatory authority for eDMR
reporting purposes.
For eDMR submissions, the person signing and submitting the DMR must obtain an eDMR user
account and login credentials to access the eDMR system. For more information on North
Carolina's eDMR system, registering for eDMR and obtaining an eDMR user account, please visit

Certification. Any person submitting an electronic DMR using the state's eDMR system shall make
the following certification [40 CFR 122.22]. NO OTHER STATEMENTS OF CERTIFICATION
WILL BE ACCEPTED:
"I certify, under penalty of law, that this document and all attachments were prepared under my
direction or supervision in accordance with a system designed to assure that qualified personnel
properly gather and evaluate the information submitted. Based on my inquiry of the person or
persons who manage the system, or those persons directly responsible for gathering the information,
the information submitted is, to the best of my knowledge and belief, true, accurate, and complete. I
am aware that there are significant penalties for submitting false information, including the
possibility offnes and imprisonment for knowing violations. "
3. Records Retention [Supplements Section D. (6.)1
The permittee shall retain records of all Discharge Monitoring Reports, including eDMR
submissions. These records or copies shall be maintained for a period of at least 3 years from the
date of the report. This period may be extended by request of the Director at any time [40 CFR
122.41].

• Thank you Derek. I just missed it. I am slipping up there on my reading ability.
• That would be good if the TRC for hydrostatic testing only. That would be the only time we would have any
possible chlorine present in the discharge.

Tom,
The NPDES standard conditions Section D. 3. say once per year for flow meter calibration. The standard
conditions can be found on our website and will be attached to the final permit.
I may add something to the footnote about TRC for the final. Some W WTP that install UV and still have
Chlorination equipment not used have a special footnote to monitor only if Cl is used. Something similar could
be put in the TRC footnote for hydrostatic tests. Have to wait and see if my supervisor agrees.

2. We plan to install flow meters on both Outfalls. Is there a required or suggested calibration of the meters
listed in one of the NC Guidance or Rules that we can establish Protocol and Standard to make sure it meets the
Divisions requirements?

I made the corrections and some of the changes you suggested. I left TRC in the table and added a sentence to the
footnote. I also added up and down stream sampling for turbidity with a footnote. Adding another section for two
outfalls for hydrostatic tests seemed to make this permit too complicated in my opinion. I wanted to be consistent with
formatting I have used for others permits that simply made addendums to footnotes. I placed the bullet notes at the end
under the header "comments" to be consistent with other permits I have seen. I also assumed the point -source
discharge value applied to 009, but I did not want to limit the permittee if they planned on installing a similar valve to
outfall 010. Therefore, I omitted any reference to outfall 009. However, the retention pond was unique to outfall 010.
I will correct the factsheet. I believe I got PC-1 from BIMS (not sure as I am working from home today). I will have to
check with Steve Reid if BIMS in not up-to-date.

Hi Derek,
Here are my comments regarding the draft permit for the Blanchard bulk terminal facility. If you have any questions
please let me know. I would like to discuss my comment regarding the turbidity testing noted below in blue with you
and possibly John in more detail since this is standard language in your bulk storage permitting guidance document and
any changes to it would affect multiple permits. As I note below, as written it does not give the regional office clear
guidance on enforcing this permit requirement.
Aboveground is commonly spelled as one word not two hyphenated words (above -ground)
On the Supplement to permit cover sheet page section 1 it specifically notes that Outfall 010 is for the retention
pond. I assume the point -source discharge valve is describing Outfall 009 so perhaps we should add this descriptor
On the Supplement to permit cover sheet page section 2 it notes "discharge from said treatment works at a point';
they will have two discharge points going forward so adjust to "at points designated on the attached map"
To aid in eDMR completion please add units of measure to the following parameters: flow, oil & grease, benzene,
toluene, ethyl benzene, xylene, ethanol and naphthalene
The parameter code for total suspended solids needs to be changed from 000530 to CO530
The parameter code for turbidity needs to be changed from 00076 to 00070
The bullets that appear below footnote 7 on page 3 appear to be related to this footnote (0) since there is no
space between the two lines. However, these bullets are related to general conditions of the permit or to discharges of
hydrostatic tank testing water. Add space between information and perhaps remove bullets. I would also suggest
separating the hydrostatic testing requirements and moving them into a separate section noted as A. (6.). since it
appears that all bullets are related to each other and there are separate and distinct permit requirements.
Since any discharges from Outfalls 009 or 010 would not contain chlorine as a pollutant unless the water originated
from hydrostatic tank testing I would suggest we remove the total residual chlorine monitoring from A.(1.) and associate
TRC monitoring requirements with discharges only of hydrostatic tank testing water (in suggested section A.(6.).
While I understand the turbidity footnote as written is taken directly from the bulk storage permitting guidance
document, as written it does not lend itself to easy enforcement by the regional office. The footnote does not clearly
tell the permittee that they need to conduct upstream and downstream turbidity monitoring to demonstrate they have
not raised the turbidity of the stream above 50 NTU. The question becomes does the regional office issue an NOV or
NOD if the permittee's effluent has a turbidity>50 NTU (since it is listed as a daily maximum limit) or do we defer that
decision until after we review any instream turbidity readings taken by the permittee? The permittee had exceedances
of 50 NTU in their effluent but no instream turbidity monitoring was performed so the regional office was unsure of
what enforcement actions to take due to the current wording of the footnote. Footnote #5 would be more effective if it
was rewritten so that the 50 NTU in the effluent is a trigger that requires upstream/downstream monitoring to
determine if any stream impacts occurred. Enforcement would then only occur if there were instream turbidity impacts
not just a daily maximum turbidity of 50 NTU were exceeded.
The factsheet notes that the facility is classified as PC-1. However, this classification was removed by TACU in 2012
since there is no physical/chemical treatment of the effluent.
The facility summary notes the facility is a minor "municipal" facility, which is incorrect.
The facility summary section notes the addition of outfall 011; this should be noted as outfall 010
Line 5 notes "storm water conveyance carrying stormwater"; the word "system" should be inserted between
conveyance and carrying
Outfall 009 should be noted at the end of the bulleted line that begins with "point -source discharge"...

The NPDES standard conditions Section D. 3. say once per year for flow meter calibration. The standard
conditions can be found on our website and will be attached to the final permit.
I may add something to the footnote about TRC for the final. Some WWTP that install UV and still have
Chlorination equipment not used have a special footnote to monitor only if Cl is used. Something similar could
be put in the TRC footnote for hydrostatic tests. Have to wait and see if my supervisor agrees.

I appreciated both of your responses. I have one more question/clarification on this project.
Question/Cla rification
1. In that your Division is able to modify the existing permit for the additional Outfall, it is my understanding that
the permit must be issued prior to us discharging out the new Outfall? Correct —since your current permit only
authorizes discharges through Outfall 009 to waters of the state, Blanchard must wait until an additional outfall
is included in the reissued permit before discharging through it. Please refer to North Carolina General Statute

2. If that is not the case and we can begin to discharge prior to the issuance, then we would keep records on the
discharge flow and sample for the current parameters?
3. If we need to wait on the permit's issuance prior to utilizing the new Outfall, then we can divert the new tertiary
containment's water through the existing Outfall 009. Yes you may divert water from the new outfall to the
permit authorized outfall until the permit is reissued.
I just want to make sure that we are within NPDES compliance and not jumping the gun on discharging out the new
Outfall.

I hope you both had good holiday season and new year. Florida has been cooler than normal but still within the
pleasant range. Plus, based on what I have been viewing on the Weather Channel I will not complain. With this email I
am following up on our December 16, 2014, on -site walk around and NPDES discussion.
1. 1 understand that your Division received the NPDES Permit Number NCO021971 Renewal Application for the
Blanchard Terminal Company LLC—Charlotte Terminal.
2. 1 understand from MPC's Project Lead, Eli Reichenbach, that he is currently working with Mecklenburg County
on a Land Disturbance Permit.
3. It is my understanding (please correct me if I have it wrong), that since the Blanchard Terminal has a NC NPDES
Permit, once we receive Mecklenburg County's Land Disturbance Permit, the construction and reworking of the
terminal's drainage flow and tertiary retention pond creation can commence.
4. It is my understanding from our December 16, 2014, meeting that Derek and you were going to investigate
whether or not a permit modification or new permit application would be required for creating another outfall
to discharge the water from the new tertiary retention pond into the unnamed tributary to Paw Creek. As we
discussed, this is the same tributary that Outfall 009 currently discharges into. The water captured and retained
in the new tertiary pond is from the same water sources that now discharged via Outfall 009. The projectis to
eliminate potential TSS and Turbidity concerns due to the current steep slope and subsequent run-off of storm
water moving rapidly across and through the terminal property.
5. 1 understand that Blanchard cannot discharge via this new Outfall until the Division of Water Quality has decided
on whether a permit for the new Outfall is required and issued, or that a "no permit application required"
decision is made (by just adding it to the current permit). This new Outfall would have the same permit
parameters and limits as NPDES Permit Number: NC002971.
Look forward to working with your Division on this TSS and Turbidity control type project. Let me know if you need any

I appreciate the time that you and Derek have provided to discuss Marathon's plans to revise the Storm Water flow at
our Blanchard Terminal in Charlotte, NC. (Mecklenburg County). As we discussed, I have completed the renewal
application for the Blanchard Terminal Company LP's Charlotte Terminal (Charlotte East). It is in Findlay for
Management Signature. It is projected to be submitted to the Division of Water Quality-NPDES Unit the week of
November 17, 2014. The required deadline for the submittal is December 31th.
I have been discussing Marathon's plan to revise the Storm Water flow at the Blanchard Terminal with Derek over the
past month. I also included a short write up on the plan in the Charlotte East NPDES Permit Renewal. We plan on
revising the Storm Water flow, installing a retention pond, developing a Storm Water conveyance to carry storm water
around the outside of the terminal and creating a new Outfall. This Outfall will handle the same water as currently exits
Outfall 009 and it will discharge into the same receiving steam as Outfall 009 (unnamed tributary to Paw Creek).
As we discussed today, it would be great if you and Derek could meet us at the Charlotte East Terminal for a walk -about
and "Plan Review". Based on your, my and the terminal management's schedule, the week of December 15`h would
work best. I suggest a Tuesday, December 16v' meeting. If that does not work, then perhaps a Monday, December 15r6
date. You stated that Derek was busy on the 17`h. Thursday, December 18'h would be another choice but that would be
pushing it close to the Christmas travel period. Not a good time to be in the air.
Let me know which date works best for you and Derek. Once you confirm, then I can book my flight and hotel. Look
forward to covering our plan to reduce the potential for TSS and/or Turbidity concerns at the Blanchard Terminal. Thank

Facility Summary
This facility is a minor municipal facility (flow <1 MGD) that receives 100% industrial from a Surface -
Water Pollution Prevention System for stormwater in proximity to above -ground storage tanks (ASTs)
providing surface bulk -storage of petroleum hydrocarbon fuels in excess of one million gallons, and fuel -
truck loading racks. Significant changes to this facility since the last permit renewal is the addition of
Outfall 011, which consists of a retention pond, a revised storm water conveyance carrying storm water
around the outside of the terminal. The facility consists of the following wastewater treatment units:
• secondary -containment basins (for ASTs)
• point -source discharge valve (normally closed— manually controlled)
• retention pond (Outfall 010)
Monthly average FLOW (MGD) —Last 22 months 1762012-Nov2014:
[Ave 0.045 MGD; Maximum, Monthly average flow = 0.132 MGD]
Toxici —This permit requires Acute Toxicity Monitoring testing using Pimephales promelas to be
performed on an annual basis as a 24-hour static [TAE6C]. The facility has passed toxicity monitoring for
over the past five years. See attached data spreadsheet and compliance history.
Compliance History— The facility received on NOD for a 10/17/13 TSS exceedance with 51 mg/L (45
mg/L limit). The turbidity limit of 50 ntu was exceeded, with "no action, BPY, three (3) times on
12/29/13, 02/20/13 and 03/19/13 with values of 51.4, 84.5 and 58.8 ntu, respectively.

RPA — A Reasonable Potential Analysis (RPA) was conducted on toluene, benzene, ethyl benzene,
naphthalene and xylene (mixture) effluent parameters data with no reasonable potential to exceed standards
because Discharge Monitoring Reports (DMRs) reported concentration below method -detection levels
(MDLs) for June2010-Nov2014 data. [See attached RPA summary sheets.]

Blanchard Terminal Company LLC (Blanchard), a subsidiary of Marathon Petroleum Company LP
(Marathon), owns and operates the Petroleum Bulk Storage and Distribution Terminal located at 7401
Old Mount Holly Road in Charlotte. The facility is covered under the above -referenced National
Pollutant Discharge Elimination System Permit (NPDES).
The subject permit is scheduled to expire on June 30, 2015. Blanchard is hereby requesting that the
permit be renewed. As required, Blanchard is including one (1) original and two (2) copies of the
application.

Blanchard's Charlotte Terminal does not generate sludge as part of a manufacturing process. Due to the
fad that the majority of the terminal is open to the environment, there is sludge (dust, dirt, grime)
which occasionally builds up within the facility drains. If the sludge originates in an area of the facility
where contact with petroleum products is possible, the sludge is collected, drummed, evaluated, labeled
and properly disposed of at an off -site location.
As discussed with Mr. Derek Denard, Specialist with the North Carolina NPDES Permitting Staff,
Marathon/Blanchard assumed ownership of the Charlotte Terminal from BP Products North America,
Inc. on February 1, 2013. Blanchard only has the DMR submittals from the purchase date and was not
able to obtain past BP DMR submittals. Mr. Denard confirmed that the NC NPDES Permitting Section
would be able to use their copies of the BP DMR submittals for the renewal of this permit.
