Ms. Dobbins: The Division of Water Quality concurs with your stated opinion that the properties of butane do not
qualify it as a parameter of concern when evaluating your facility's potential to impact surface waters of the state. Your
blending equipment and surface storage therefore require no amendment or modification at this time to your active
NPDES permit. We have filed your letter, and may add reference to butane to the facility description, but likely not until
permit renewal.
I trust this is sufficient reply to your inquiry?

BP Products North America (BP) owns and operates the petroleum bulk storage and
distribution terminal located at 7401 Old Mt. Holly Road in Charlotte. The terminal is a,"
operated under the above -referenced National Pollutant Discharge Elimination System
(NPDES) Permit.
BP is planning on installing butane storage and blending equipment at the terminal in the
spring of 2010. The equipment will include one 60,000-gallon pressurized storage tank,
two 250-gallon product tanks, blending skids, and assorted piping.
Butane does not meet the definition of a hazardous or toxic substance contained within
the Clean Water Act. BP is therefore requesting that the Department consider the butane
storage and blending equipment to be exempt from permitting.
