Dear Kate Hefner, I have reviewed the PCN for the above referenced project and have the following questions/comments that need to be addressed. 1. NWP 14 is used for linear transportation projects for the purpose of getting people, goods or services from a point of origin to a terminal point. Based on the information provided it is unclear if the proposed activities meet the intent of the requested NWP 14 verification (linear transportation Project). Generally, when a stated project purpose and project description is to construct a residential development and to provide necessary roads and utilities to provide safe and reliable access to the area; the proposed activities are authorized under NWP 29. a. Based on a review of the PCN and plans the proposed project does not appear to be a linear transportation project and does not appear to have a point of origin or a terminal point that is not integrally tied to the proposed subdivision. Additionally, it appears that the proposed road locations and locations of road crossings appear to be integrally related to the subdivision design. b. In order for the Corps to verify the use of NWP 14 for the proposed project supporting information is needed to show that these proposed road crossings are for the purpose of transportation that is not integrally associated with the subdivision. 2. Based on comment 1 it appears that the project meets the intent of NWP 29, however, based on the proposed impacts the project exceeds NWP 29 threshold for loss of waters (> 0.5 acres). a. You may apply for the proposed project via the Standard Permit process. As an alternative, you may further avoid or minimize impacts proposed to show that cumulative impacts fit within the NWP impact thresholds. Please submit the above information within 30 days of receipt of this Notification or we may consider your application withdrawn and close the file.
