Good afternoon,
The Division of Energy, Mineral and Land Resources received and accepted a State Stormwater Management Permit
Application for the subject project on May 25, 2021 and requested additional information on September 3, 2021 and
January 25, 2022. A review of the file and delivery logs indicates that, as of this date, the information requested on
January 25, 2022 has not been received in this Office within the stipulated timeframe. Per the requirements of Title 15A
NCAC 02H .1042(3)(a)(ii) of the Stormwater Management Rules, this Office is hereby returning the subject application as
incomplete. The $505.00 application fee has been forfeited and a new fee will need to be provided if you choose to
resubmit this application in the future.

"The O&M Agreement shall be referenced on the final plat and shall be recorded with the county Register of Deeds
upon final plat approval." (15A NCAC 02H .1050(11))
It needs to be both recorded with the Register of Deeds and referenced on the final plat.

Thanks for the clarification Jim, I did not realize the original review was deficient. I had talked with Corey about adapting
the current Wet Pond to the expansion. Sounds like current MDC 2 and MDC 5a could be handled within the existing
pond and through modification to the Outlet Structure.
The other items were not originally requested but we will provide with next submission.

I am aware of the previous request for information letter sent by my former co-worker (I'm not going to speak to the
quality of his review), but I reviewed what was provided and came up with those comments that I provided to you. If you
believe that any of my comments were made in error, we can discuss that (I did try to provide the relevant statutes and
examples where applicable so that you knew where the comments were coming from). Since this is a major modification
that increases the size of the SCM from what was originally permitted (see attached) and adds new BUA to the project
(in excess of what was originally permitted, including the "future" BUA), the SCM must be compliant with the 2017 rules.
Alternatively, you could direct the new BUA to it's own SCM that is compliant with the current rules and leave the
previously permitted wet pond/drainage area alone (We would accept that since the existing wet pond would not be
changed from what was originally permitted, even if that does not meet the current standards).
You should be able to meet Wet Pond MDC 2 by increasing the permanent pool elevation up to 851 and using Equation
3 to calculate the average depth. You should be able to meet Wet Pond MDC 5a by increasing the sediment storage
depth in the forebays to reduce the forebay volume. The other comments were inconsistencies that were noted during
the review and items that ought to have been provided with the submission, but were not.
