REASON FOR VARIANCE REQUEST — Include type of well(s) to be constructed; rule for which the variance is being requested; description of how the alternate construction will not endanger human health and welfare and the environment; and reason why construction and/or operation in accordance with the standards is not technically feasible and/or provides equal or better protection of the groundwater (refences to attached documents are acceptable). Current regulations require monitor wells to be abandoned by filling well casing with bentonite or cement type grout from the bottom of the casing up to the land surface. The Division of Waste Management, in their Permit to Construct, requires monitor wells within the proposed landfill footprint to be abandoned such that the grout is terminated below current land surface, to the proposed landfill subgrade elevation. A variance from 15A NCAC 2C .0113(d) (2) will be required for 11 monitor wells to allow grout to be terminated below land surface. Additionally, two wells completed within bedrock have grout extending 8.5ft and 9ft below Top of Rock (TOR) within the annular space. 15A NCAC 2C .0113(d)(3) requires loft of grout to extend below TOR. Request variance to loft requirement since the wells will have 8.5ft and 9ft of grout, and to avoid added costs to mobilize an air rig to drill wells an extra 1 — 1.5ft with minimal added protection value offered. Grout will extend from the base of the subgrade excavation, to either the bottom of the well or for the 2 wells in bedrock, to either 8.5 or 9 ft. into the bedrock. The landfill liner constructed on top of the abandoned wells will consist of 2 ft of compacted clay, a GCL liner (bentonite clay), a 40 mil HDPE liner and 2 ft of soil for added protection. E. (2) Detailed site map with scale showing location of proposed well relevant to septic system(s), building foundations, property lines, water bodies, potential sources of contamination, other wells, etc. (3) Submit a copy of the local well permit application and site evaluation map (if applicable). (4) Any other information relevant to the variance request such as a well construction diagram showing proposed well liner or atypical construction materials/methods. F. A variance applicant who is dissatisfied with the decision of the Director may commence a contested case by filing a petition as described in G.S. 150E-23 within 60 days after receipt of the decision.
