Don't see anything unusual.. The only comment I have relates to specifying flow. The last permit that addressed flow was
14 October 2004; with flow being identified on the permit page as.2.10 MGD. The permit issued 22 November 2013 has
no reference to flow at all, either on the permit page. or Attachment A..The last permit issued on 1 July 2014 identifies
flow in the Attachment A, but no value is presented. Since BIMS indicates the permit flow at 2.10 MGD, shouldn't that
rate be in the permit somewhere, i.e. in on the "permit page or the Attachment A?

(i) For irrigation sites, the applicant shall provide to the Division a project evaluation and a receiver, site agronomic
management plan and recommendations concerning cover crops and their ability to accept the proposed application rates
of liquid, solids, minerals and other constituents of the wastewater.
0) The applicant shall provide to the Division a residuals management plan as required by Rule .0802 of this Subchapter.
A written commitment is not required at the time of application; however, it shall be provided prior to operation of the
permitted system.
(k) The applicant shall provide a water balance to the Division that determines required storage based upon the most
limiting factor of the hydraulic loading based on either the most restrictive horizon or groundwater mounding analysis; or
nutrient management based on either agronomic rates for a specified cover crop or crop management requirements.

SECTION .0300 - EFFLUENT STANDARDS
15A NCAC 02U .0301 RECLAIMED WATER EFFLUENT STANDARDS
(a) Reclaimed water treatment processes classified as Type 2 by the rules in this Subchapter shall produce a tertiary
quality effluent (filtered or equivalent) prior to storage, distribution, or utilization that meets the parameter limits listed
below:
(1) monthly average BODS of less than or equal to 5 mg/l and a daily maximum BODS of less than or equal
to 10 mg/l;
(2) monthly average TSS of less than or equal to 5 mg/1 and a daily maximum TSS of less than or equal to
10 mg/l;
(3) monthly average NH3 of less than or equal to 1 mg/l and a daily maximum NH3 of less than or equal to
2 mg/l;
(4) monthly geometric mean Escherichia coli (E. coli) or fecal coliform level of less than or equal to 3/100
ml and a daily maximum E. coli or fecal coliform level of less than or equal to 25/100 ml;
(5) monthly geometric mean Coliphage level of less than or equal to 51100 ml and a daily maximum
Coliphage level of less than or equal to 25/100 ml;
(6) monthly geometric mean Clostridium perfringens level of less than or equal to 51100 ml and a daily
maximum Clostridium perfmgen level of less than or equal to 25/100 ml; and
(7) maximum Turbidity of 5 Nephelometric Turbidity Units (NTUs).

1. Per I5A NCAC 2U .0301(c), reclaimed water produced by industrial facilities is not required to meet the criteria (treatment standards) in this Rule if the reclaimed water is used at the facility in
an industrial process and the area of use has no public access and does not result in employee exposure. In the event that expanded uses of reclaimed water are desired, it may be necessary to
meet specified effluent limits for Type I or Type 2 reclaimed water.
2. 2/Month sampling frequency will occur during the months of April and October. During the remainder of the year, these parameters will be monitored monthly.

continued operation of a reclaimed water distribution system. which will allow the reuse of the treated
industrial wastewater (NPDES Pernut No. NC0078344) for the uses outlined in Appendix B;
to. serve the Smithfield Farmland Corporation, with no discharge of wastes to surface waters,.pursuant to
the application received May 28, 2014 and in conformity with the project plans, specifications, and other
supporting data subsequently filed and approved by the Department of Environment and Natural
Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until October 31, 2018, shall void Permit No.
WQ0010892 issued November 22, 2013, and shall be subject to the following specified conditions and
limitations:
I. SCHEDULES
1. No later than six mbnths,prior to the expiration of this permit, the Permittee shall request renewal of
this permit on official Division forms. Upon receipt of the request, the Division will review the
adequacy of the facilities described therein, and if warranted, will renew the permit for such period of
time and under such conditions and Iimitations as it may deem appropriate. Please note Rule 15A
NCAC 02T .0105(d) requires an updated site map to be submitted with the permit renewal
application.
II. PERFORMANCE STANDARDS
1. All reclaimed water shall meet the Reclaimed Water Quality Standards of Rule 15A NCAC 02U
.0301 (b), as applicable. Applicability is defined in Attachments A and B of this permit.
2. The subject reclaimed water facilities shall be effectively maintained and operated at all times so
there is no discharge to surface waters, nor any contravention of groundwater or surface water
standards. In the event the facilities fail to perform satisfactorily, including the creation of nuisance
conditions due to improper operation and maintenance, or failure of the utilization areas to

adequately assimilate the reclaimed water, the Permittee shall take immediate corrective actions
including Division required actions, such as the construction of additional or replacement reclaimed
water utilization facilities or cessation of reclaimed water utilization activities.
3. This perni t shall not relieve the Permittee of their responsibility for damages to groundwater or
surface water resulting from the operation of this facility.
4. This permit allows all or part of the reclaimed water authorized under this permit to be discharged
into the Pernnittee's wastewater treatment facilities separately authorized under NPDES Permit No.
NC0078344, if all the conditions of NPDES Permit No. NCO078344 are met. This authorization of
reclaimed water diversion does not alter the existing limits contained in NPDES Permit No.
N00078344 including, but not limited to, production limitation.
5. Effluent limitations for generated reclaimed water shall not exceed those specified in Attachment A.
6. Reclaimed water generation facilities producing Type 2 reclaimed water, as defined in 15A NCAC
02U .0301,• shall provide dual -disinfection methods consisting of ultraviolet disinfection and
chlorination, or equivalent dual disinfection processes.
7. Reclaimed water may only be distributed to the sites I uses listed in Attachment B without prior
approval by the Division of Water Resources.
8. The conjunctive use of reclaimed water permitted herein in no way negates, precludes, or invalidates
the most recent reissuance of the Permittee's NPDES permit (Permit No. NC0078344), and the
Permittee shall continue to comply with all conditions provided for therein.
9. The following shall be requirements for the reclaimed water utilization facilities:
a. All reclaimed water valves, storage facilities and outlets shall be tagged or labeled to warn the
public or employees that reclaimed water is not intended for drinking. Where appropriate, such
warning shall inform the public or employees to avoid contact with reclaimed water.
b. All reclaimed water piping, valves, outlets and other appurtenances shall be color -coded, taped or
otherwise marked to identify the source of the water as being reclaimed water.
i. All reclaimed water piping and appurtenances shall be either colored purple (i.e., Pantone
522) and embossed or integrally stamped or marked "CAUTION: RECLAIMED WATER -•
DO NOT DRINK" or be installed with a purple (i.e., Pantone 522) identification tape or
polyethylene vinyl wrap. The warning shall be stamped on opposite sides of the pipe and
repeated every three feet or less.
ii. Identification tape shall be at least three. inches wide and have white or black lettering on
purple (i.e., Pantone 522) field stating "CAUTION: RECLAIMED WATER — DO NOT
DRINK." Identification tape shall be installed on reclaimed water pipelines in a visible
manner, fastened at least every 10 feet to each pipe length and run continuously the entire
length of the pipe.
iii. Existing underground distribution systems retrofitted for the purpose of distributing
reclaimed water shall be taped or otherwise identified as noted above. This identification
need not extend the entire length of the distribution system, but shall be incorporated within
10 feet of crossing any potable water supply line or sanitary sewer line.
c. All reclaimed water valves and outlets shall be of a type, or secured in a manner, that permits
operation by authorized personnel only.
d. Hose bibs shall be located in locked, below grade vaults that shall be labeled as being of non -
potable quality. As an alternative to the use of locked vaults with standard hose bib services, other
locking mechanisms such as hose bibs which can only be operated'by a tool may be placed above
ground and labeled as non -potable water.

10. No direct cross -connections shall be allowed between reclaimed water and potable water systems,
unless such connection has been approved by the Department pursuant to 15A NCAC 18C .0406.
11. The reclaimed water shall not be used for irrigation within the fenced area of the wastewater
treatment facility.
12. The Compliance Boundary for the disposal system is specified by regulations 15A NCAC 2L,
Groundwater Classifications and Standards. The Compliance Boundary is for the disposal system
constructed after December 31, 1983 and is established at either (1) 250 feet from the waste disposal
area, or (2) 50 feet within the property boundary, whichever is closer to the waste disposal area. An
exceedanee of Groundwater Quality Standards at or beyond the Compliance Boundary is subject to
immediate remediation action in addition to the penalty provisions applicable under General Statute
143-215.6A(a)(1).
13. In accordance with 15A NCAC 2L, a Review Boundary is established around the disposal system
midway between the Compliance Boundary and the perimeter of the waste disposal area. Any
exeeedance of standards at the Review Boundary shall- require remediation action on the part of the
Pernuttee.
14. The Pennittee shall apply for a permit modification to establish a new compliance boundary prior to
any sale or transfer of property affecting a compliance boundary.
15. hi accordance with 15A NCAC 02L .0107(d), no wells, excluding Division approved monitoring
wells, shall be constructed within the compliance boundary except as provided for in 15A NCAC 02L
.0107(g).
M. OPERATION AND MAINTENANCE REQUIREMENTS
1. The reclaimed water systems shall be properly maintained and operated at all times. The systems
shall be effectively maintained and operated as a non -discharge system to prevent the discharge of
any reclaimed water or partially treated effluent resulting from the operation of the systems, unless.
the conditions and limitations of NPDES Permit No. NCO078344 are met
2. The onsite reuse water system shall be operated in accordance with the 15A NCAC 02T .0900
regulations.
3. The domestic (sanitary) wastewater shall remain separate from the reclaimed water system.
4. The Pernuttee shall maintain an Operation and Maintenance Plan pursuant to 15A. NCAC 02U .0801,
which at a minimum shall include the following:
1. Description of the system in sufficient- detail to show what operations are necessary for the
system to function and by whom the functions will be conducted;
2. A map of all distribution lines and record drawings of all utilization systems under the
Permittee's control;
3. Description of anticipated maintenance activities;
4. Include provisions for safety measures including restriction 'of access to sites and equipment; and
5. Spill control provisions including response to upsets and bypasses including control, containment,
remediation, and contact information for plant personnel, emergency responders and regulatory
agencies.

Upon the Water Pollution Control System Operators Certification Commission's (WPCSOCC)
classification of the subject non -discharge facilities, in accordance with 15A NCAC 08G .0200 the
Permittee sliall designate and employ a certified operator in responsible charge (ORC) and one or
more certified operator(s) as back-up ORC(s). The ORC or their back-up shall visit the facilities in
accordance with 15A NCAC 08G .0200, and shall comply with all other conditions specified in the
previously cited rules. At the time of this permit issuance, a certified ORC is not required for
conjunctive reclaimed water users.
6. An operator certified by the Water Pollution Control System Operators Certification Commission
(WPCSOCC) of a grade equivalent or greater than the facility classification shall be on call 24 hours
per day.
7. Only reclaimed water generated at the Smithfield Farmland Corporation (Permit No. WQ00108921
NC0078344) shall be utilized in accordance with this permit.
8. An automatically activated standby power source or other means to prevent improperly treated
Wastewater from entering the storage, distribution, or utilization system shall be provided.
9. Public access to the reclaimed water generation facilities shall be prohibited.
10. Public access to reclaimed water utilization sites shall be controlled during active site use. Such
controls may include the posting of signs showing the activities being conducted at each site.
11. Diversion or bypassing of untreated or partially treated wastewater from the .treatment facilities is
prohibited unless diverted to an alternate treatment or collection system.
12. ffluent shall be discharged in accordance with Permit No. NCO078344 if the limit for fecal coliform
(e.g., daily maximum concentration of 25 colonies per 100 mL) or turbidity (e.g., instantaneous
maximum of 10 NTU) is exceeded, until such time as the reclaimed water standards are met at the
generating facility.
13. The Permittee shall develop and implement an education program to inform users (including
employees) about the proper use of reclaimed water. Educational material shall be provided to all
residents and/or other facilities provided with reclaimed water, and these materials shall be
maI
ntained consistent with the reclaimed water uses.. All educational materials shall be made
available to the Division upon request.
14. In accordance with 15A NCAC 02U..0501, the Penhittee shall provided notification to the public
and/or employees about the use of reclaimed water, and that reclaimed water is not intended for
drinking. Such notification shall be provided to employees in a language they can understand.
15. The residuals generated from the wastewater treatment facilities shall be disposed or utilized in
accordance with 15A NCAC 02T .1100. The Permittee shall maintain a residual management plan
pursuant to 15A NCAC 02U .0802 for any residuals from the reclaimed water systems that are not
returned to the wastewater treatment system.
16. Reclaimed water used for activities other than land application shall not be used in a manner that
causes exposure to aerosols.
17. Reclaimed water shall not be used for swimming pools, hot tubs, spas, or similar uses.
18. Reclaimed water shall not be used for direct reuse as a potable water supply.

IV. MONITORING AND REPORTING REQUIRMENTS
1. Any Division required monitoring (including groundwater, plant tissue, soil and surface water
analyses) necessary to ensure groundwater and surface water protection shall be established, and an
acceptable sampling reporting schedule shall be followed.
2. Per 15A NCAC 02H .0800, a Division certified laboratory shall conduct all laboratory analyses for
the required effluent, groundwater or surface water parameters.
3. Flow through the reclaimed water generating facility shall be continuously monitored, and daily flow
values shall be reported on Form NDMR.
The Permittee shall install and maintain an appropriate flow measurement device to ensure the
accuracy and reliability of flow measurement consistent with accepted engineering and scientific
practices. Selected flow measurement devices shall be capable of measuring flows with a maximum
deviation of less than ten percent from true flow; accurately calibrated at a minimum of once per year;
and maintained to • ensure- the accuracy -of - measurements -is consistent with the selected device's
accepted capability. The Permittee shall maintain records of flow measurement device calibration on
.file for a period of at least five years. At a minimum, documentation shall include:
a. Date of flow measurement device calibration,
b. Name of person performing calibration, and
c. Percent from true flow.
4. The Permittee shall monitor the reclaimed water from the generating facility at the frequencies and
locations for the parameters specified in Attachment A.
5. The Permittee shall maintain adequate records tracking the amount of reclaimed water distributed to
each user and shall include the following information:
a. Date of reclaimed water distributed; and
b. Volume of reclaimed water distributed to each approved offsite user facility (monthly total).
Monthly tracking records for all users shall be sunned and reported on Form NDMR (see
Attachment A) under parameter WQ01 (Flow, Reclaimed Water Distributed). This value shall
represent the total volume of reclaimed water distributed to all users for that month.
6. A maintenance log shall be maintained at this facility. This log shall be maintained at.the facility for
a period of no less than five years, and shall be made available to the Division upon request. At a
minimum, this log shall include:
a. Visual observations of treatment plant and plant site;
b. • Date of calibration of flow measurement device(s);
c. 'Record of preventative maintenance (e.g., changing/adjusting of equipment, pump and valve
maintenance, cross connection control, testing, inspections and cleanings, etc.; and
d. Record of all unpermitted releases of reclaimed water to surface water or land surface including
date of occurrence, estimated volume of release, cause, and corrective action taken.
7. Two copies of all effluent monitoring data and reclaimed water distribution data (as specified in
Conditions IV.3., IVA, and IV.5.) shall be submitted on Form NDMR for each PPI listed in
Attachment A. Two copies of all applicable data (as specified in Condition IV.5.) shall be submitted
on Form NDMR for each application listed in Attachment B. Reporting forms shall be submitted on
or before the last day of the following month. If no reclaimed water distribution activities occurred
during the monitoring month, monitoring reports documenting the absence of the -activity are still
required to be submitted. All effluent monitoring data shall be submitted to the following addresses:

The Permittee shall report by telephone to the Fayetteville Regional Office, telephone number (910)
433-3300, as soon as possible, but in no case more than 24 hours, or on the next working day
following the occurrence or first knowledge of the occurrence of any of the following:
a. Any occurrence at the facility resulting in the treatment of significant amounts of wastes that is
abnormal in quantity or characteristic, including the known passage of a hazardous substance.
b. Any process unit failure (e.g., mechanical, electrical, etc.), due to known or unknown reasons,
rendering the facility incapable of adequate wastewater treatment.
c. Any failure resulting in a discharge of reclaimed water directly to surface waters or any
unpermitted release of reclaimed water to land surface greater than or equal to 5,000 gallons.
Unpermitted"releases less than 5,000 gallons to land surface shall be documented by the permittee
in accordance with Condition IV A but do not require Regional Office notification.
d. Any failure, due to known or unknown reasons, that renders the reclaimed water distribution
line(s) incapable of adequately transporting the reclaimed water (e.g., mechanical or electrical
failures, line blockages or breaks, etc.);
e. Any time self -monitoring indicates the facilities permitted herein have gone out of compliance
with the limitations contained in this permit.
£ Ponding in or runoff from the reclaimed water utilization sites.
Any emergency. requiring immediate reporting (e.g., discharges to surface waters, imminent failure of
a storage structure, etc.) outside normal business hours shall be reported to the Division's Emergency
Response personnel at telephone number (800) 662-7956, (800) 858-0368, or (919) 733-3300.
Persons reporting such occurrences by telephone shall also file a written report in letter form within
five days following fast knowledge of the occurrence. This report shall outline the actions taken or
proposed to be taken to ensure the problem does not recur.
INSPECTIONS
1. The Permittee shall provide adequate inspection and maintenance to ensure proper operation of the
wastewater treatment and reclaimed water generation and utilization facilities.
2. The Permittee or their designee shall inspect the wastewater treatment and reclaimed water generation
and utilization facilities to prevent malfunction, facility deterioration and operator errors resulting in
discharges, which may cause the release of wastes to the environment, a threat to human health or a
public nuisance. The Permittee shall maintain an inspection log that includes, at a minimum, the date
.and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken.
The Permittee shall maintain this inspection log for a period of five years from the date of the
inspection, and this log shall be made available to the Division upon request.
Any duly authorized Division representative may, upon presentation of credentials, enter and inspect
any property, premises or place on or related to the wastewater treatment and reclaimed water
generation and utilization facilities permitted herein at any reasonable time for the purpose of
determining compliance with this permit; may inspect or copy any records required to be maintained
under the terms and conditions of this permit, and may collect groundwater, surface water or leachate
samples.

VI. GENERAL CONDITIONS
1. Failure to comply with the conditions and limitations contained herein may subject the Permittee to
an enforcement action by the Division in accordance with North Carolina General Statutes 143-
215.6A to 143-215.6C.
2. This permit shall become voidable if the permitted facilities are not constructed in accordance with
the conditions of this permit, the Division approved plans and specifications, and other supporting
documentation.
3. This permit is effective only with respect to the nature and volume of wastes described in the permit
application; Division approved plans and specifications, and other supporting documentation. No
variances to applicable rules governing the construction or operation of the permitted facilities are
granted, unless specifically requested and approved in this permit pursuant to 15A NCAC 02T
.0105(n).
4. The issuance. of this permit. doesnot.exempt the Permittee from complying .with any and all statutes,
rules, regulations, or ordinances, which may be imposed by other jurisdictional government agencies
(e.g., local, state, and federal). Of particular.. concern to the Division are applicable river buffer rules
in 15A NCAC 02B .0200, erosion and sedimentation control requirements in 15A NCAC Chapter 4
and under the Division's General Permit NCGO10000; any requirements pertaining to wetlands under
15A NCAC 02B *.0200 and 02H .0500; National Pollutant Discharge Elimination System (NPDES)
requirements under 15A NCAC 0211.0100, and documentation of compliance with Article 21 Part 6
of Chapter 143 of the General Statutes.
5. In the event the permitted facHifies change ownership or the Permittee changes their name, a written
permit modification request shall be submitted to the Division. This request shall be made on official
Division forms, and shall include appropriate property ownership documentation and other supporting
documentation as necessary. The Permittee of record shall remain fully responsible for maintaining
and operating the facilities permitted herein until a permit is issued to the new owner.
6. The Permittee shall retain a set of Division approved plans and specifications for the life of the
facilities permitted herein.
7. The Permittee shall maintain this permit until all permitted facilities herein are properly closed or
permitted under another permit issued by the appropriate permitting authority pursuant to 15A NCAC
02T .01050).
8. This permit is subject to revocation or unilateral modification upon 60 days notice from the Division
Director, in whole or part for the requirements listed in 15A NCAC 02T .0110.
9. Unless the Division Director grants a variance, expansion of the permitted facilities contained herein
shall not be granted if the Permittee exemplifies any of the criteria in 15A NCAC 02T .0120(b).
10. The Permittee shall pay the annual fee within 30 days after being billed by the Division. Failure to
pay the annual fee accordingly shall be cause for the Division to revoke this permit pursuant to 15A
NCAC 02T .0105(e) (3).

The Fayetteville Regional Office (FRO) doesn't have any comments at this time regarding the -proposed name change for
Smithfield —Tar Heel plant. As noted on the bottom of the form, this permit will be up for renewal in a month or so. I
plan_to visit the Smithfield —Tar Heel facility next week or the following to collect sludge samples from the anaerobic
lagoons for.PFOA/PFOS/Dimer Acid (GenX) sampling. I'll do a. site visit with the ORC for the reclaimed water permit at
that time and prepare:a staff report and submit it when the. permit renewal request form is submitted to FRO.

Please note the Permittee has been changed from the Smithfield Packing Company, Inc. to the
Smithfield Farmland Corporation.
This permit shall be effective from the date of issuance until October 31, 2018, shall void Permit
No. WQ0010892 issued November 22, 2013, and shall be subject to the conditions and limitations as
specified therein. Please pay particular attention to the monitoring requirements listed in Attachments A
and B for they may differ from the previous permit issuance. Failure to establish an adequate system for

continued operation of a reclaimed water distribution systemwhich will allow the reuse of the treated
industrial wastewater (NPDES Permit No. NC0078344) for the uses outlined in Appendix B;
to -serve the Smithfield Farmland Corporation, with no discharge of wastes to surface waters,•pursuant to
the application received May 28, 2014 and in conformity with the project plans, specifications, and other
supporting data subsequently filed and approved by the Department of Environment "and Natural
Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until October 31, 2018, shall void Permit No.
WQ0010892 issued November 22, 2013, and shall be subject to the following specified conditions and
limitations:
I. SCHEDULES
1. No later than six months.piior to the expiration of this permit, the Permittee shall request renewal of
this permit on official Division forms. Upon receipt of the request, the Division will review the
adequacy of the facilities described therein, and if warranted, will renew the permit for such period of
time and under such conditions and limitations as it may deem appropriate. Please note Rule 15A
NCAC 02T .0105(d) requires an updated site map to be submitted with the permit renewal
application.
H. PERFORMANCE STANDARDS
1. All reclaimed water shall meet the Reclaimed Water Quality Standards of Rule 15A NCAC 02U
.0301 (b), as applicable. Applicability is defined in Attachments A and B of this permit.
2. The subject reclaimed water facilities shall be effectively maintained and operated at all times so
there is no discharge to surface waters, nor any contravention of groundwater or surface water
standards. In the event the facilities fail to perform satisfactorily, including the creation of nuisance
conditions due to improper operation and maintenance, or failure of the utilization areas to

adequately assimilate the reclaimed water, the Pernittee shall take immediate corrective actions
including Division required actions, such as the construction of additional or replacement reclaimed
water utilization facilities or cessation of reclaimed water utilization activities.
3. This permit shall not relieve the Permittee of their responsibility for damages to groundwater or
surface water resulting from the operation of this facility.
4. This permit allows all or part of the reclaimed water authorized under this permit to be discharged
into the Permittee's wastewater treatment facilities separately authorized under NPDES Permit No.
NC0078344, if all the conditions of NPDES Permit No. NCO078344 are met. This authorization of
reclaimed water diversion does not alter the existing limits contained in NPDES Permit No.
N00078344 including, but not limited to, production limitation.
5. Effluent limitations for generated reclaimed water shall not exceed those specified in Attachment A.
6. Reclaimed water generation facilities producing Type 2 reclaimed water, as defined in 15A NCAC
02U .0301,- shall provide dual -disinfection methods consisting of ultraviolet disinfection and
chlorination, or equivalent dual disinfection processes.
7. Reclaimed water may only be distributed to the sites / uses listed in Attachment B without prior
approval by the Division of Water Resources.
8. The conjunctive use of reclaimed water permitted herein in no way negates, precludes, or invalidates
the most recent reissuance of the Permittee's NPDES permit (Permit No. NC0078344), and the
Permittee shall continue to comply with all conditions provided for therein.
9. The following shall be requirements for. the reclaimed water utilization facilities:
a. All reclaimed water valves, storage facilities and outlets shall be tagged or labeled to warn the
public or employees that reclaimed water is not intended for drinking. Where appropriate, such
warning shall inform the public or employees to avoid contact with reclaimed water.
b. All reclaimed water piping, valves, outlets and other appurtenances shall be color -coded, taped or
otherwise marked to identify the source of the water as being reclaimed water.
i. All reclaimed water piping and appurtenances shall be either colored purple (i.e., Pantone
522) and embossed or integrally stamped or marked "CAUTION: RECLAIMED WATER --
DO NOT DRINK" or be installed with a purple (i.e., Pantone 522) identification tape or
polyethylene vinyl wrap. The warning shall be stamped on opposite sides of the pipe and
repeated every three feet or less.
ii. Identification tape shall be at least three.inches wide and have white or black lettering on
purple (i.e., Pantone 522) field stating "CAUTION: RECLAIMED WATER — DO NOT
DRINK." Identification tape shall be installed on reclaimed water pipelines in a visible
manner, fastened at least every 10 feet to each pipe length and run continuously the entire
length of the pipe.
iii. Existing underground distribution systems retrofitted for the purpose of distributing
reclaimed water shall be taped or otherwise identified as noted above. This identification
need not extend the entire length of the distribution system, but shall be incorporated within
10 feet of crossing any potable water supply line or sanitary sewer line.
c. All reclaimed water valves and outlets shall be of a type, or secured in a manner, that permits
operation by authorized personnel only.
d. Hose bibs shall be located in locked, below grade vaults that shall be labeled as being of non -
potable quality. As an alternative to the use of locked vaults with standard hose bib services, other
locking mechanisms such as hose bibs which can only be operated by a tool may be placed above
ground and labeled as non -potable water.

10. No direct cross -connections shall be allowed between reclaimed water and potable water systems,
unless such connection has been approved by the Department pursuant to 15A NCAC 18C .0406.
11. The reclaimed water shall not be used for irrigation within the fenced area of the wastewater
treatment facility.
12. The Compliance Boundary for the disposal system is specified by regulations 15A NCAC 2L,
Groundwater Classifications and Standards. The Compliance Boundary is for the disposal system
constructed after December 31, 1983 and is established at either (1) 250 feet from the waste disposal
area, or (2) 50 feet within the property boundary, whichever is closer to the waste disposal area. An
exceedance of Groundwater Quality Standards at or beyond the Compliance Boundary is subject to
immediate remediation action in addition to the penalty provisions applicable under General Statute
143-215.6A(a)(1).
13. In accordance with 15A NCAC 2L, a Review Boundary is established around the disposal system
midway between the Compliance Boundary and the perimeter of the waste disposal area. Any
exceedance of standards at the Review Boundary shall- require remediation action on the part of the
Pernuttee.
14. The Permittee shall apply for a permit modification to establish a new. compliance boundary prior to
any sale or transfer of property affecting a compliance boundary.
15. hi accordance with 15A NCAC 02L .0107(d), no wells, excluding Division approved monitoring
wells, shall be constructed within the compliance boundary except as provided for in 15A NCAC 02L
.0107(g).
III. OPERATION AND MAINTENANCE REQUIREMENTS
1. The reclaimed water systems shall be properly maintained and operated at all times.' The systems
shall be effectively maintained and operated as a non -discharge system to prevent the discharge of
any reclaimed water or partially treated effluent resulting from the operation of the systems, unless
the conditions and limitations of NPDES Permit No. NCO078344 are met
2. The onsite reuse water system shall be operated in accordance with the 15A NCAC 02T .0900
regulations.
3. The domestic (sanitary) wastewater shall remain separate from the reclaimed water system.
4. The Permittee shall maintain an Operation and Maintenance Plan pursuant to 15A NCAC 02U .0801,
which at a minimum shall include the following:
1. Description of the system in sufficient- detail to show what operations are necessary for the
system to function and by whom the functions will be conducted;
2. A map of all distribution lines and record drawings of all utilization systems under the
Permittee's control;
3. Description of anticipated maintenance activities;
4. Include provisions for safety measures including restriction'of access to sites and equipment; and
5. Spill control provisions including response to upsets and bypasses including control, containment,
remediation, and contact information for plant personnel, emergency responders and regulatory
agencies.

5. Upon the Water Pollution Control - System .Operators Certification Commission's (WPCSOCC)
classification of the subject non -discharge facilities, in accordance with 15A NCAC 080 .0200 the
Permittee shall designate and employ a certified operator in responsible charge (ORC) and one or
more certified operator(s) as back-up ORC(s). The ORC or their back-up shall visit the facilities in
accordance with 15A NCAC 08G .0200, and shall comply with all other conditions specified in the
previously cited rules. At the time of this permit issuance, a certified ORC is not required for
conjunctive reclaimed water users.
6. An operator certified by the Water Pollution Control System Operators Certification Commission
(WPCSOCC) of a grade equivalent or greater than the facility classification shall be on call 24 hours
per day.
7. Only reclaimed water generated at the Smithfield Farmland Corporation (Permit No. WQ0010892 /
NC0078344) shall be utilized in accordance with this permit.
8. An automatically activated standby- power source or other means to prevent improperly treated
wastewater from entering the storage, distribution, or utilization system shall be provided.
9. Public access to the reclaimed water generation facilities shall be prohibited.
10. Public access to reclaimed water utilization sites shall be controlled during active site use. Such
controls may include the posting of signs showing. the activities being conducted at each site.
11. Diversion or bypassing of untreated or partially treated wastewater from the .treatment facilities is
prohibited unless diverted to an alternate treatment or collection system.
12. Effluent shall be discharged in accordance with Permit No. NCO078344 if the limit for fecal coliform
(e.g., daily maximum concentration of 25 colonies per 100. mL) or turbidity` (e.g., instantaneous
maximum of 10 NTU) is exceeded, until such time as the reclaimed water standards are met at the
generating facility.
13. The Permittee shall develop and implement an education program to inform users (including
employees) about the proper use of reclaimed water. Educational material shall be provided to all
residents and/or other, facilities provided with reclaimed water, and these materials shall be
maintained consistent with the reclaimed water uses.. All educational materials shall be made
available to the Division upon request.
14. In accordance with 15A NCAC 02U .0501, the Permittee shall provided notification to the public'
and/or employees about the use of reclaimed water, and that reclaimed water is not intended for
drinking. Such notification shall be provided to employees in a language they can understand.
15. The residuals generated from the wastewater treatment facilities shall be disposed or utilized in
accordance with 15A NCAC 02T .1100. The Permittee shall maintain a residual management plan
pursuant to 15A NCAC 02U .0802 for any residuals from the reclaimed water systems that are not
returned to the wastewater treatment system.
16. Reclaimed water used for activities other than land application shall not be used in a manner that
causes exposure to aerosols.
17. Reclaimed water shall not be used for swimming pools, hot tubs, spas, or similar uses.
18. Reclaimed water shall not be used for direct reuse as a potable water supply.

IV. MONITORING AND REPORTING RE(QUIRMENTS
1. Any Divisioni required monitoring (including groundwater, plant tissue, soil and surface water
analyses) necessary to ensure groundwater and surface water protection shall be established, and an
acceptable sampling reporting schedule shall be followed.
2. Per 15A NCAC 02H .0800, a Division certified Iaboratory shall conduct all laboratory analyses for
the required effluent, groundwater or surface water parameters.
3. Flow through the reclaimed water generating facility shall be continuously monitored, and daily flow
values shall be reported on Form NDMR.
The Penmince shall install and maintain an appropriate flow measurement device to ensure the
accuracy and reliability of flow measurement consistent with accepted engineering and scientific
practices. Selected flow measurement devices shall be capable of measuring flows with a maximum
deviation of less than ten percent from true flow; accurately calibrated at a minimum of once per year;
and maintained to • ensure- the accuracy -of -measurements -is consistent with the selected device's
accepted capability. The Permittee shall maintain records of flow measurement device calibration on
.file for a period of at least five years.: At a minimum, documentation shall include:
a. Date of flow measurement device calibration,
b. Name of person performing calibration, and
c. Percent from true flow.
4. The Permittee shall monitor the reclaimed water from the generating facility at the frequencies and
. locations for the parameters specified in Attachment A.
5. The Permttee shall maintain adequate records tracking the amount of reclaimed water distributed to
each user and shall include the following information:
a. Date of reclaimed water distributed; and
b. Volume of reclaimed water distributed to each approved offsite user facility (monthly total).
Monthly tracking records for all users shall be summed and reported on Form NDMR (see
Attachment A) under parameter WQO1 (Flow, Reclaimed Water Distributed). This value shall
represent the total volume of reclaimed water distributed to all users for that month.
6. A maintenance log shall be maintained at this facility. This log shall be maintained at. the facility for
a period of no less than five years, and shall be made available to the Division upon request. At a
minimum, this log shall include:
a. Visual observations of treatment plant and plant site;
b. - Date of calibration of flow measurement device(s);
c. 'Record of preventative maintenance (e.g., changing/adjusting of equipment, pump and valve
maintenance, cross connection control, testing, inspections and cleanings, etc.; and
d. Record of all unpermitted releases of reclaimed water to surface water or land surface including
date of occurrence, estimated volume of release, cause, and corrective action taken.
7. Two copies of all effluent monitoring data and reclaimed water distribution data (as specified in
Conditions IV.3., IVA. and IV.5.) shall be submitted on Form NDMR for each PPI listed in
Attachment A. Two copies of all applicable data (as specified in Condition IV.S.) shall be submitted
on Form NDMR for each application listed in Attachment B. Reporting forms shall be submitted on
or before the last day of the following month. If no reclaimed water distribution activities occurred
during the monitoring month, monitoring reports documenting the absence of the - activity are still
required to be submitted. All effluent monitoring data shall be submitted to the following addresses:

The Permittee shall report by telephone to the Fayetteville Regional Office, telephone number (910)
433-3300, as soon as possible, but in no case more than 24 hours, or on the next working day
following the occurrence or first knowledge of the occurrence of any of the following:
a. Any occurrence at the facility resulting in the treatment of significant amounts of wastes that is
abnormal in quantity or characteristic, including the known passage of a hazardous substance.
b. Any process unit failure (e.g., mechanical, electrical, etc.), due to known or unknown reasons,
rendering the facility incapable of adequate wastewater treatment.
c. Any failure resulting in a discharge of reclaimed water directly to surface waters or any
unpermitted release of reclaimed water to land surface greater than or equal to 5,000 gallons.
Unpermitted'releases less than 5,000 gallons to land surface shall be documented by the pemnittee
in accordance with Condition IV.6. but do not require Regional Office notification.
d. Any failure, due to known or unknown reasons, that renders the reclaimed water distribution
line(s) incapable of adequately transporting the reclaimed water (e.g., mechanical or electrical
failures, line blockages or breaks, etc.);
e. Any time self -monitoring indicates the facilities permitted herein have gone out of compliance
with the limitations contained in this permit.
f. Ponding in or runoff from the reclaimed water utilization sites.
Any emergency. requiring immediate reporting (e.g., discharges to surface waters, imminent failure of
a storage structure, etc.) outside normal business hours shall be reported to the Division's Emergency
Response personnel at telephone number (800) 662-7956, (800) 858-0368, or -(919) 733-3300.
Persons reporting such occurrences by telephone shall also file a written report in letter form within
five days following first knowledge of the occurrence. This report shall outline the actions taken or
proposed to be taken to ensure the problem does not recur.
INSPECTIONS
1, The Permittee shall provide adequate inspection and maintenance to ensure proper operation of the
wastewater treatment and reclaimed water generation and utilization facilities.
2. The Permittee or their designee shall inspect the wastewater treatment and reclaimed water generation
and utilization facilities to prevent malfiniction, facility deterioration and operator errors resulting in
discharges, which may cause the release of wastes to the environment, a threat to human health or a
public nuisance. The Permittee shall maintain an inspection log that includes, at a nunimum, the date
.and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken.
The Permittee shall maintain this inspection log for a period of five years from the date of the
inspection, and this log shall be made available to the Division upon request.
3. Any duly, authorized Division representative may, upon presentation of credentials, enter and inspect
any property, premises or place on or related to the wastewater treatment and reclaimed water
generation and utilization facilities permitted herein at any reasonable time for the purpose of
determining compliance with this permit; may inspect or copy any records required to be maintained

VI. GENERAL CONDITIONS
1. Failure to comply with the conditions and limitations contained herein may subject the Permittee to
an enforcement action by the Division in accordance with North Carolina General Statutes 143-
215.6A to 143-215.6C.
2. This permit shall become voidable if the permitted facilities are not constructed in accordance with
the conditions. of this permit, the Division approved plans and specifications, and other supporting
documentation.
3. This permit is effective only with respect to the nature and volume of wastes described in the permit
application; Division approved plans and specifications, and other supporting documentation. No
variances to applicable rules governing the construction or operation of the permitted facilities are
granted, unless specifically requested and approved in this permit pursuant to 15A NCAC 02T
.0105(n).
4. The issuance. of this permit. does.not.exempt the Permittee from complying .with any and all statutes,
rules, regulations, or ordinances, which may be imposed by other jurisdictional goveinment agencies
_,..... (e.g., local, state, and federal). Of particular.. concern to the Division are applicable river buffer rules
in 15A NCAC 02B .0200; erosion and sedimentation control requirements in 15A NCAC Chapter 4
and under the Division's General Permit NCG010000; any requirements pertaining to wetlands under
15A NCAC 0213 '.0200 and 02H .0500; National Pollutant Discharge Elimination System (NPDES)
requirements under 15A NCAC 02H .0100, and documentation of compliance with Article 21 Part 6
of Chapter 143 of the General Statutes.
5. In the event the permitted facilities change ownership or the Pernttee changes their name, a written
permit modification request shall be submitted to the Division. This request shall be made on official
Division forms, and shall include appropriate property ownership documentation and other supporting
documentation as necessary. The Permittee of record shall remain fully responsible for maintaining
and operating the facilities permitted herein until a permit is issued to the new owner.
6. The Permittee shall retain a set of Division approved plans and specifications for the life of the
facilities permitted herein.
7. The Permittee shall maintain this permit until all permitted facilities herein are properly closed or
permitted under another permit issued by the appropriate permitting authority pursuant to 15A NCAC
02T .01050),
8. This permit is subject to revocation or unWateral modification upon 60 days notice from the Division
Director, in whole or part for the requirements listed in 15A NCAC 02T .0110.
9. Unless the Division Director grants a variance, expansion of the permitted facilities contained herein
shall not be granted if the Pemuttee.exemplifies any of the criteria in 15A NCAC 02T .0120(b).
10. The Permittee shall pay the annual fee within 30 days after being billed by the Division. Failure to
pay the annual fee accordingly shall be cause for the Division to revoke this permit pursuant to 15A
NCAC 02T .0105(e) (3).

CONTRIBUTION -AGREEMENT
This Contribution Agreement (this "Agreement") is entered into with an effective date and
time of 11:51 p.m., Eastern Time, on December 31, 2017 (the "Effective Time") by and between
Smithfield Packaged Meats Corp., a Delaware corporation (the "Contributing Party"), and
Smithfield Fresh Meats Corp., a Delaware corporation (the "Subsidiary").
RECITALS
. A. As of the Effective Time, the Contributing Party is the sole stockholder of the
Subsidiary.
B. Prior to the Effective: Time; the Contributing Party (i) directly.owns all of the issued
and outstanding membership interests (the "Interests") of Premium Pet Health, LLC, a Delaware
limited .liability company ("PPH'), and (ii) is the record and beneficial owner of those certain
distribution centers, fresh meat plants and fresh meat assets, properties and contract rights listed
on Exhibit A attached hereto (collectively, the -"Contributed Assets").
C. Prior to the Effective Time, PPH may hold certain liabilities and payables owed by
the Contributing Party, and by certain of its subsidiaries that are disregarded as separate from the
Contributing Party for U.S. federal income tax purposes CVREs"), to PPH (the "PPH
Receivables"), including, for the avoidance of doubt, liabilities and payables acquired or assumed
by, or otherwise transferred to, the Contributing Party (i) in connection with the merger of each of
Stefano Foods, Inc., Smithfield Global Products, Inc. and Smithfield Farmland Corp. with and into
the Contributing Partly, and (ii) pursuant to the Distribution Agreement entered into by and between
the Contributing Party and Armour-Eckrich Meats LLC dated as of October 29, 2017.
D. Prior to the Effective Time,. PPH may also hold certain liabilities and payables (the
"PPH Payables") owed to Smithfield Foods, Inc., the Contributing Party and certain of their direct
and indirect subsidiaries (collectively, "Smithfield").
E. The ,Contributing Party has agreed to contribute the Contributed Assets . to the
Subsidiary in accordance with the terms and conditions set forth below.
NOW,. THEREFORE, in. consideration of the premises and for good and valuable
consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as
follows:
ARTICLE I
TRANSACTIONS
1.1 Pre -Contribution Assignments
(a) Distribution. and Acceptance. Immediately prior to the Effective Time, PPH
hereby distributes, assigns, conveys and delivers to the Contributing Party all of PPH's right, title
and interest in and to any and all PPH Receivables, and the Contributing Party hereby accepts such

distribution, assignment, conveyance and delivery of such PPH Receivables, the composition and
amount of which is to be determined immediately prior to the Effective Time (the " l3ish ibution").
(b) Assumption. Immediately prior to the Effective Time, the Contributing
Party assumes any and all PPH Payables, the composition and amount of which is to be determined
immediately prior to the Effective Time.
1.2 Contribution.
(a) Contribution _and Acceptance. Effective as of the Effective Time, the
Contributing Party hereby assigns, transfers, conveys and delivers to the Subsidiary, and the
Subsidiary hereby accepts the assignment, transfer, conveyance and delivery of, the Contributed
Assets, and assumes the related obligations, as a contribution to the capital of the Subsidiary (the
"Contribution").
(b) Excluded Assets. The parties hereby acknowledge and agree that the
Contributing Party owns certain assets and properties in addition to the Contributed Assets
(collectively, the "Excluded Assets"), and that the Excluded: Assets are being retained by the
Contributing Party and are not being contributed or transferred as part of the Contribution.
(c) Acknowled_gment of RelationsW. The parties hereby acknowledge and
agree that the Contributing Party is the sole stockholder of the Subsidiary and that, as such, the
Contributing Party is the holder of 100% of the outstanding stock of the Subsidiary.
(d) General Representations and Warrantiesof the Contributing Party. The
Contributing Party hereby makes the following representations and warranties to the Subsidiary as
of the Effective Time: (i) the Contributing Party has the capacity and full authority to enter into
this Agreement and to perform the obligations of the Contributing Party under this Agreement;
and (ii) the Contributing Party has not made, and has not contracted for, any assignment, sale,
exchange or other transfer of the Contributed Assets or any portion of them (other than as set forth
in this Agreement).
1.3 Related Actions and Furtber Assurances.
(a) Related Actions. On and after the Effective Time, and after giving due
regard to subsections (b) and (c) immediately below, each party shall promptly take such actions
as may be reasonably requested in writing by the other party (including, without limitation, the
execution of additional agreements, instruments .or documents) for the purpose of evidencing or
effectuating the transactions contemplated by this Agreement (the "Related Transfer Actions").
(b) Specific Actions. Without limiting the scope of the Related Transfer
Actions, the parties specifically acknowledge and agree as follows: (i) if any Contributed Asset is
real property, the parties shall execute a mutually satisfactory deed for the conveyance of such real
property from the Contributing Party to the Subsidiary and shall cause such deed to be recorded in
compliance with applicable law; and (ii) if any Contributed Asset is evidenced by a necessary
instnunent of title (other than real property), the parties shall execute appropriate and mutually
satisfactory documentation for the transfer of such title, and shall cause such documentation to be
filed or recorded, as applicable, in accordance with applicable law.

(c) No Other Instruments of Transfer. The parties acknowledge and agree that,
except as required by subsection (b) immediately above with respect to any real property and any
property evidenced by a necessary instrument of title, their mutual execution and delivery of ibis
Agreement shall be sufficient to evidence and effectuate the Contribution, and the parties shall not
require any separate or additional instrument of transfer, in connection with the Contribution.
Notwithstanding the above, an additional instrument of transfer with respect to the Contribution
may be executed and delivered with the mutual consent of both the Contributing Party and the
Subsidiary (with the understanding that each such party, in such party's sole discretion, may grant
or withhold any such consent).
1A Governing Law and Amendment.
(a) GoveminQ Law. The laws of the State of Delaware (without regard to those
laws involving conflicts or choice of law) shall govern this Agreement and all matters that relate
to its interpretation or enforcement.
(b) Amendment. Amendments to this Agreement shall not be binding, valid or
enforceable unless they are approved in writing by authorized officers of each of the parties.
1.5 Other General Matters.
(a) Disregarded Transfer. It is the intention of the Contributing Party, PPH,
and the Subsidiary that the Pre -Contribution Assignments be disregarded for U.S. federal income
tax purposes_
(b) Section 351 Transfer. It is the intention of the parties that the transfer of any
property (within the meaning of section 351) pursuant to Contribution qualify as a transfer under
section 351 of the Internal Revenue Code of 1986, as amended.
(c) Miscellaneous. This Agreement shall be binding upon, and enforceable
against, the parties and all of their permitted assignees and successors in title or interest. Captions
and headings are used in this Agreement for convenience only and shall not affect its interpretation
or enforcement. Any terms such as "hereby," "herein" and similar references shall be deemed to
refer to this Agreement .as a whole, rather than to any particular provision. Terms defined in the
singular in this Agreement shall be deemed to include their respective plurals, and vice versa. Any
prior oral agreements with respect to the subject matter of this Agreement have been integrated
into this Agreement as deemed necessary by the parties and are superseded by this Agreement.
(d) Counterparts. This Agreement may be executed in counterparts, each of
which shall be deemed an original and all of which shall constitute, when taken together, a single
binding instrument.

Use Form W-9 only if you are a U.S. person (including a resident
alien), to provide your correct TIN.
