TATA SECRETARY Section 404 /NEPA Merger Project Team Meeting Concurrence Point No. 2A Modification TIP Project R -2536 WBS No. 34450.1.1, Federal -Aid Project No. NHF- 64(19) February 18, 2015 Project Description: The proposed project is a new location freeway that will bypass the City of Asheboro to the south. The new location freeway begins on US 64 west of Asheboro, just to the west of the Stutts Road intersection, and ends at US 64 east of Asheboro, just to the east of the Dewey Road intersection (Figure 1), hereinafter referred to as the proposed US 64 Asheboro Bypass. The proposed US 64 Asheboro Bypass will be a 16.1 mile long four - lane, median - divided road with full control of access divided into four sections — Section AA, Section AB, Section B, and Section C. The project also includes a new connector road from the proposed US 64 Asheboro Bypass to the North Carolina Zoological Park that is being referred to as the Zoo Connector (Section D). Background: The DEIS was approved by the Federal Highway Administration on July 23, 2002. Subsequent to approval of the DEIS, the NEPA/404 Merger Project Team reached concurrence on Point 2A, Approximate Length of Bridges on Detailed Study Alternatives, and selected the preferred alternative as the Least Environmentally Damaging Practicable Alternative ( LEDPA), Concurrence Point 3, on May 12, 2004. The LEDPA was submitted to the NCDOT Corridor Selection Committee, who recommended its selection as the Preferred Alternative in August 2004. On May 25, 2006, the Project Team reached concurrence on Point 4A, Avoidance and Minimization of Impacts. The Abbreviated FEIS was approved March 12, 2007, and the Record of Decision (ROD) was approved December 6, 2007. A Design Public Hearing (DPH) was held on March 11, 2008. Declining revenues caused a change in the project schedule and contributed to a delay after the approval of the Abbreviated FEIS and ROD. A Transportation Corridor Official Map Act Public Hearing was held on November 8, 2012 to present the proposed protected corridor for the Asheboro Bypass to the public. To date, the corridor has not yet been protected as a result of the project schedule being advanced. The proposed project is to be let to "Design Build" construction in May /June, 2015. Purpose of this Merger Team Meeting: The purpose of the Merger Team Meeting is to discuss the preliminary design revisions to the Zoo Connector and the modification to the Concurrence Point 2A form (signed May 2004) in reference to the proposed bridges and wildlife crossings over Little River, Vestal Creek and the North Prong of Richland Creek. The Zoo Connector (Section D) originally was not funded for construction in the State Transportation Improvement Program (STIP). DENR, the Zoo, and Friends of the Zoo asked NCDOT to investigate options that would lead to Section D being funded and included in a Design Build contract. The Zoo Connector was redesigned to reduce overall project costs while maintaining a comparable level of service for traffic operations. The modified design to the Zoo Connector connects to existing NC 159 at the Zoo Entrance Road and creates a new crossing over the North Prong of Richland Creek. Additionally, the crossings of Little River and Vestal Creek have proposed greenways, which require modifications to the Concurrence Point 2A form language. Design Revisions to Zoo Connector: The study area for Section D was expanded in 2013 to allow for the evaluation of a revised design for the Zoo Connector, which would connect to NC 159 north of the Zoo Parkway near Willow Downs Court. A single -lane roundabout was also being proposed at the existing intersection of NC 159 and the Zoo Parkway. As part of the revised Zoo Connector, the proposed Asheboro Bypass interchange with existing NC 159 (grade - separation) would be eliminated and future US 64 Asheboro Bypass traffic would be expected to use the Revised Zoo Connector to access NC 159 (Zoo Parkway). A short connector road would provide access from the Zoo Parkway to the Revised Zoo Connector and the proposed US 64 Asheboro Bypass (Figure 2). A Public Meeting was held on May 8, 2014 to allow the public to comment on the revised design for the Zoo Connector (Section D), which included the revised Zoo Connector and elimination of the NC 159 /proposed US 64 Asheboro Bypass interchange. Additionally, the public was notified of the proposed design changes to the interchange type at NC 49 and the proposed US 64 Asheboro Bypass. In the months after the Public Meeting, there were concerns and opposition to the Revised Zoo Connector design where the Revised Zoo Connector alignment coincided with existing NC 159 north of the Zoo Parkway intersection with existing NC 159. Page 2 As a result of the public input, NCDOT developed a Modified Zoo Connector design (January 2015) shown in Figure 3 which incorporates part of the Revised Zoo Connector design from Section B of the proposed US 64 Asheboro Bypass to the east to a point where the Modified Zoo Connector design intersects the original Section D alignment of the Zoo Connector which is on new location up to the intersection of the Zoo Parkway. On January 28, 2015, NCDOT met with some residents who live along the Zoo Parkway (NC 159) and discussed the revised alignment for the Modified Zoo Connector. All of the residents were receptive to the Modified Zoo Connector design and were appreciative of the work NCDOT has done to work out a design they all agree with. A second Reevaluation of the Abbreviated FEIS is currently underway to address the preliminary design revisions. As a part of these revisions, a bridge crossing over the North Prong of Richland Creek is no longer proposed. NCDOT is proposing to match an adjacent existing crossing over the North Prong of Richland Creek on NC 159 that is conveyed through a double 14'x10' barrel culvert. The following table shows the change in the proposed jurisdictional feature impacts for the project with the Original and Modified Zoo Connector alignments (Alternative 29). Proposed Jurisdictional Feature Impacts Modifications to CP2A Concurrence Form: Since Concurrence Point 2A was signed, the City of Asheboro has updated its' greenway plan to include greenways along both the Little River and Vestal Creek. Due to this change NCDOT met with USFWS and NCWRC (Gary Jordan and Travis Wilson) to discuss how these greenways should be accommodated, since both waterways also have wildlife crossings proposed. Below is the language from the original signed Concurrence Point 2A form (dated May 12, 2004). "Bridges of 3 spans @ 55 feet each (165 feet total) with 2 @ 30 feet wildlife crossings at each location for Little River, Vestal Creek and North Prong of Richland Creek. (30 feet is measured from top of bank to toe of fill slope)." Page 3 After coordinating with USFWS and NCWRC in December 2014 for the crossing at the Little River and Vestal Creek the following revised language is being proposed for the Concurrence Point 2A form. The bridges on the US 64 Bypass over Little River and Vestal Creek shall be of sufficient length and span arrangement to span the waterway and provide a minimum 60 foot clear span on the west side of both waterways from the top of the bank to the toe of fill slope and provide a minimum 30 foot clear span on the east side of both waterways from the top of the bank to the toe of fill slope. On each side of both waterways, a 30 foot clear span shall be provided for wildlife passage. The additional 30 foot clear span on the west side of both waterways shall provide a 15- foot buffer between the wildlife passage and a future 15-foot greenway. The minimum vertical clearance for both bridges shall be 10 feet above the existing natural ground surface. NCDOT also developed the following proposed Concurrence Point 2A language, which also notes the crossing of North Prong Richland Creek being eliminated The proposed bridge on the Zoo Connector (new location alignment) over the North Prong of Richland Creek would be eliminated and replaced with double barrel 14'x10' RCBC which is equal in size to the adjacent downstream culverts conveyed under existing NC 159 (approximately 1000 feet east) for the North Prong of Richland Creek. A new two -lane Zoo Connector will also be constructed from the proposed bypass to the North Carolina Zoo A concurrence meeting was held in the field with members of the Merger Team on February 18, 2015 to discuss the minor modification to the Bridges on US 64 Bypass over Little River and Vestal Creek, the minor re- alignment of the Zoo Connector (Section D). The NC 49 interchange design was modified to minimize impacts to Taylor Creek and two unnamed tributaries in its vicinity. The modified design includes a grade - separation with NC 49 crossing over the proposed Bypass. This change resulted in a lower profile from just east of Old NC 49 to near Mack Road. As a result, fewer overall embankments are needed along the streams in the interchange area, resulting in less overall linear stream impacts. Fill slopes were held at 2:1 streams and wetlands along the mainline and at grade - separations. Construction limits within and around interchanges were "tightened" to minimize potential stream impacts. A noise barrier will be constructed at Twelve Tree Road. Perpendicular crossings at streams were designed where possible to minimize stream impacts. Brian Yamamoto opened the meeting with introductions of the Project Team participants, PDEA staff involved in the project, and representatives from Earth Tech, the engineering firm responsible for the project's environmental document and preliminary design. He noted the status of the project and the prior Merger Concurrence Point approvals. 2. Richard Spencer noted the difference between the calculated mitigable impacts, specifically that different totals were related to mitigation likely to be required by DWQ or USACE, not their jurisdiction. He clarified that all stream impacts cited in the Merger Team packet were jurisdictional and that the higher impacts, the DWQ totals, would be those considered in the meeting. The total amount of linear feet of impacts for which mitigation would be required would be determined at the permit phase. He also noted that the wetland verification conducted for the project is over five years old and has expired. Re- verification would be required prior to the permit application, but not before then, given that the current let date is 2012. 3. Roger Lewis provided an overview of the project status and presented the preliminary design plans prepared for Alternative 29, the preferred alternative, using PowerPoint and aerial photography with design overlays provided in the merger team packet. He 9. Gary Jordan noted that another Schweinitz's sunflower survey would be needed prior to construction. Leza Mundt stated that a commitment to conduct the survey is included in the FEIS. 10. Gene Nocerino reviewed possible on -site mitigation areas identified by the NCDOT, including potential stream restoration sites at South Prong Richland Creek, northwest of the NC 159 Zoo Connector interchange and two sites along North Prong Richland Creek, one near NC 159 and one east of Business 220. Following brief introductions, it was agreed that Little River, Tantraugh Branch, North Prong Richland Creek, and Vestal Creek would be visited. A lunch break would happen between site visits, and the team would have a final meeting in the First Floor Training Room at the Randolph County Office Building to discuss the sites and review Concurrence Points 2A and 3. L101e River. A wildlife crossing was requested at this site based on the stream banks,. surrounding topography, and character of the entire area. 'In addition, fencing was mentione&as a'means of encouraging wildlife passage under the bridge and deterring wildlife from crossing the'new road. There would be no other opportunities forwildlife crossing between Mack Road and US 220 Bypass. Merger Team Red Meeting Minutes May 12. 2004 Page 2 of 3 US Fish and Wildlife Service and NC Wildlife Resource Commission requested 30 feet (from top of bank to toe of end bent slope) as a minimum width and 8 feet as the minimum vertical clearance for a wildlife crossing. The team visited the Alt. 13/14 Little River sites but declined to visit the Alt. 29 site after being informed that the vegetation and-topography are typical along Little River. The team agreed that the recommended wildlife crossing treatments would apply at the three proposed Little River crossings (Alts. 13, 14, and 29). Tantraugh Branch: Alternatives 13 and 14 were discussed prior to visiting this site. The proposed culvert under the Zoo Connector passes below several ramps; a bridge or bridges are not feasible at this site due to the proximity of the ramps to each other. The team walked through the Alt. 29 Seepage Wetland confirming this to be a low quality wetland. The adjacent Forested Wetland was identified as higher quality and more desirable for minimization efforts. The team continued across Tantraugh Branch. It was determined that the Forested Wetland to this point was typical of that found along Tantraugh Branch (on Alts. 13 and 14) and the team agreed to proceed to the next site. The team determined a bridge would not be requested at this site. North Prong Richland Creek . The team walked to this site and in reviewing the preliminary cost information, the bridge would be less expensive than the culvert, so a bridge was requested. The bridge estimated did not include wildlife crossing width. Vestal Creek The team reviewed preliminary cost information for this crossing and determined they would request a bridge at this site based on the closeness of costs. The team did not visit this site. Following the site visits, the team met at the Randolph County Office Building to review the project study area aerial and discuss Concurrence Point #2A and M. Fencing for the purpose of encouraging wildlife to use the bridge rather than crossing the new roadway was further discussed. Wildlife Resource Commission mentioned 1500 feet of fencing at all four quadrants of the Little River crossing, including one -way gates and/or deer leaps to prevent animals being trapped on the roadway side of the fence. This length (1500 feet) is flexible and should be further investigated during final design. After brief discussion, the team concurred with Point #2A, agreeing to a bridge at Little River, North Prong Richland Creek, and Vestal Creek, as detailed in the attached concurrence form. The team also chose Alternative 29 based on Concurrence Point #2A bridges and the quantities of stream impacts quoted in the meeting handout (attached), as detailed in the attached concurrence form. Page 1 of 3 January, 2007 TIP Project R -2536 Abbreviated Final Environmental Impact Statement Other actions, which must be completed prior to the start of project construction, include but are not limited to the following: • Preparation of an erosion control plan incorporating the NCDOT's Best Management Practices for Protection of Surface Waters. • Coordination with municipalities and public utilities for relocation and reconfiguration of utility systems will be conducted. • The Relocation Assistance Program will be implemented. • Approval of all required permits and certifications as outlined in Section 4.11, pages 4 -70 and 4 -71 of the DEIS will be obtained prior to construction. Project Development & Environmental Analysis Branch — Natural Environment Unit Follow -up surveys to determine suitable habitat for Schweinitz's sunflower within the Preferred Alternative construction limits will be conducted during the appropriate flowering season within two (2) years prior to project construction. If a population of the species is found, the NCDOT will enter into Section 7 consultation with the US Fish and Wildlife Service. The Mitigation Plan for jurisdictional impacts to streams and wetlands will be developed by the NCDOT during the Section 404 /Section 401 permit application processes. Once on -site opportunities are exhausted, compensatory mitigation will be provided by the NCDENR Ecosystem Enhancement Program pursuant to the tri -party Memorandum of Agreement between USACE, NCDENR, and NCDOT (July 2003). Project Development & Environmental Analysis Branch — Human Environment Unit The NCDOT committed to maintaining trees along the southeast edge of the historic Cox - Brown Farm property and extending a tree line along a new ramp and right -of -way line, to visually shield the historic property from the view of bypass Alternatives 1, 2, 13, and 14. Alternative 29 was selected as the Preferred Alternative. It is located nearly one mile south of the Cox -Brown Farm. None of the trees on the farm or in the adjacent wooded tract would be affected by the project. Therefore, selection of Alternative 29 fulfills this project commitment. A noise attenuation barrier was determined to be reasonable and feasible at the residential area along Twelve Tree Drive adjacent to the US 220 Bypass. A final decision on the installation of noise abatement measures will be made upon completion of the final roadway design and design public hearing for the project. As stipulated in a tri -party Memorandum of Agreement (MOA) between the NCDOT, the FHWA, and the SHPO, Data Recovery Plans will be prepared for archaeological sites 31 RD1398, 31 RD1399, and 31 RD1426/1426 ** ( ** denotes historic component) and submitted to the State Historic Preservation Office for review. The NCDOT will ensure that each Data Recovery Plan is implemented after right -of -way is acquired or once right -of -entry is secured from property owners and prior to construction activities within the site locations. The NCDOT will abide by all other stipulations pertaining to the data recovery efforts listed in the MOA signed by the NCDOT on June 26, 2006. Page 2 of 3 January, 2007 TIP Project R -2536 Abbreviated Final Environmental Impact Statement Roadway Design Unit, Division 8, and Roadside Environmental Unit To avoid downstream impacts to the Cape Fear Shiner due to sedimentation, in- stream construction in all tributaries of the Deep River, including Richland, Vestal, Squirrel, Gabriel's Creeks, Tantraugh Branch, and their tributaries should be avoided to the extent practicable. Where in- stream construction is unavoidable, the following measures will be implemented to ensure protection for all aquatic resources occurring downstream: 1. Installation of in- stream silt curtains weighted at the bottom, and stringent bank erosion control. 2. If tree removal is required, stumps and roots should remain intact for bank stabilization; 3. In- stream construction activities will be initiated only during low flow conditions that permit the effective deployment of the silt curtains; and, 4. In- stream construction activities will be avoided during the Cape Fear Shiner spawning period (between April 1 and June 30). Two wildlife crossings, 30 -feet in width, will be constructed under each of the dual bridges proposed over Little River, Vestal Creek, and North Prong Richland Creek. Appropriate fencing will be constructed to direct wildlife to the crossings. Roadway Design Unit, Roadside Environmental Unit, and Structure Design Unit The NCDOT will continue to work with the North Carolina Zoological Park to ensure the Zoo Connector and associated structures are designed to contribute aesthetically to the entrance to the North Carolina Zoological Park.
