Dear Ms. Ward:
The Division received your application for a wastewater discharge permit on March 31, 1997.
Division personnel have reviewed and approved your application. Accordingly, we are forwarding herewith
the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North
Carolina General Statute 143-215 .1 and the Memorandum of Agreement between North Carolina and the
U.S. Environmental Protection Agency dated December 6, 1983, and as subsequently amended.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this letter. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings,
Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is made, this
decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. Complete and
submit the enclosed Permit Name / Ownership Change Form if a change in ownership or control of this
discharge occurs. The Division may require modification or revocation and reissuance of the permit.
This permit does not affect the legal requirements to obtain other permits which may be required
by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.

This is a permit renewal for a package wastewater treatment plant for an apartment complex. Files
and data indicate that the facility is generally in compliance with permitted limits with only a few
exceptions. The facility has had some operational difficulties (the chlorinator was leaking before),
but seems to be ok now. The application for renewal has not been submitted yet, but the permit requires
an alternatives analysis with the submittal. Also, the permittee was advised during the last
compliance inspection that they will need to submit the analysis. If no alternatives are available, the
ammonia limit will be set at 2.0 mg/1 summer and 4.0 mg/1 winter, and the permittee will be given the
choice between this limit and a chronic tox. test at 90%. The data suggest that the facility can meet
the ammonia limit on a regular basis. P&E recommends renewal with changes noted above.

Update: The region withdrew the dechlorination requirement since the facility is not
required to meet a TRC limit. The flow sample box requirement has been withdrawn
because the box has been repaired. The facility will get ammonia limits of 2&4 to be
phased in in twelve months. Permit will be issued to Renae Ward the owner and not the
facility Sunset Apartments.

5. Directions to Site: Take 421 to Boone, NC. Continue straight on 421, which turns into King Street
through the middle of Boone. Travel about 'h mile from the downtown area on King Street. The
treatment plant is on the right side of the road. The apartment complex is back off of King Street on
the right NCSR 1104 (Old Bristol Road). If you are at the stoplight to turn on 105 Bypass, you've
gone too far. The apartments are just before the stoplight on the right, next to a small white house on
a gravel road.

We have no alternative analysis evaluation (AAE) from this facility. I have called the permittee and
written letters, explaining the AAE.
5. Other Special Items: None
PART IV - EVALUATION AND RECOMMENDATIONS
A review of the self -monitoring results for 1996 indicates compliance with all current final effluent permit
limits. The proposed 5 mg/1 BOD5 and 2 mg/1 ammonia limits for discharges to zero flow streams will be
difficult for this plant to meet, based on the past self -monitoring data. The plant will possibly need to upgrade
to meet more stringent limits.
The following items need to be included in the permit:
1. A 12 month compliance schedule for the facility to meet the effluent limitations of the permit.
2. A statement requiring the permittee to obtain an authorization to construct to upgrade the existing
facilities to include dechlorination, flow sample box and to meet the effluent limitations of the
permit.
Recommendation is made to renew the permit in accordance with division policy.
