Dear Mr. Vinson:
The following information is provided in response to your letter dated November 14, 2022, and received by the Town
on December 1, 2022, related to the Town of Clayton's actions to correct and prevent future SSO occurrences. Please
see below.
Incident Number 202201563
The subject SSO occurred at Buckhorn Branch pump station on October 11, 2022. This is a new station that was
being built by Axis Utilities (utility contractor) to support development by Mungo Homes. At the time of the spill the
pump station had not been certified by the engineer of record nor accepted by the Town of Clayton. The spill was
discovered by Town staff at approximately 10:00 am on October 11, 2022, who immediately took action to stop all
inflow and dispatched the contractor to the site to begin clean-up efforts. Upon investigation, the cause of the spill
was determined to be failure of the new check valves, allowing sewer from an upstream force main to back feed into
the new wet well, which subsequently breached. An upstream valve on the existing force main was inadvertently left
in the "on" position, without the Town's knowledge or authorization, which allowed wastewater into the new line.
The contractor was able to recover a majority of the discharged wastewater via pumps and manual labor and
subsequently return a large majority back into the collections system. All contaminated ABC stone and surrounding
soils were properly excavated and disposed of as part of the clean-up efforts. Per Section 157.300 of the Town of
Clayton's Ordinance related to Illicit Discharges, the Town issued an Illicit Discharge letter to the developer, Clayton
Properties Group, Inc, on October 11, 2022, requesting corrective actions. The Town also issued a Notice of Violation
to the owner, Capital Fund, LLC, on October 14, 2022, outlining the standard provisions required on their behalf
during the construction process. The site has since been returned to its original condition, with no evidence of further
or continuing harm to the surrounding environment. Since the discharge, the station has been certified and is in now
technically in operation and being monitored by Town staff on a regular schedule.

If an SSO is ongoing, please notify the appropriate Regional Office on a daily basis until SSO can be stopped.
Per G.S. 143-215.1C(b), the responsible party of a discharge of 1,000 or more of untreated wastewater to surface waters
shall issue a press release within 24-hours of first knowledge to all print and electronic news media providing general
coverage in the county where the discharge occurred. When 15,000 gallons or more of untreated wastewater enters surface
waters, a public notice shall be published within 10 days and proof of publication shall be provided to the Division within 30
days. Refer to the reference statute for further detail.
The Director, Division of Water Resources, may take enforcement action for SSOs that are required to be reported to
Division unless it is demonstrated that:
1) the discharge was cause by sever natural conditions and there were no feasible alternative to the discharge; or
2) the discharge was exceptional, unintentional, temporary and caused by factors beyond the reasonable control of the
Permittee and/or owner, and the discharge could not have been prevented by the exercise of reasonable control.

Property Owner:
The Town of Clayton's Engineering Department has identified you as the responsible
party for an illicit discharge as defined in the Town's Illicit Discharge Ordinance (Town
Municipal Code, Chapter 157, attached). Illicit discharges are violations of Section
Section 157.300 of this ordinance. Town staff inspected your property on October
11, 2022 and the following information supports our determination:
1. Sewer lift station had overflowed allowing sewage to escape silt fence
outlets for the site into Neuse River Riparian Buffer and into Buckhorn
Branch surface water
In accordance with Section 157.300 of this ordinance, you must take corrective
actions such that the discharge is contained, controlled, collected, and removed
promptly and all affected areas are restored to their preexisting condition. Corrective
actions must be completed by October 18, 2022 at 12:00pm. It is your responsibility
to make sure that corrective actions are fully implemented and inspected by Town
Engineering staff before this date and time. If corrective actions are completed and
accepted by Town staff by this date and time, the Town will take no further legal
action.
If corrective actions and inspection by the Town have not been completed before this
date and time, the Town may assess a civil penalty of up to $5000.00 per day per
violation, in accordance with Section 157.300 of the ordinance. This civil penalty
may be assessed from the date of your receipt of this Notice of Violation.
The Town is seeking your cooperation and would like to avoid taking further
enforcement action. It is your responsibility to understand and comply with the

Re: Notice of Violation — Town of Clayton CD Standard Provisions
Dear Property Owner:
On October 11, 2022, the Town of Clayton (Town) was notified of a potential Sanitary Sewer Overflow
(SSO) in the vicinity of the pump station currently under construction located within the subject property,
NCPIN 166800-64-8874. Upon investigation, Town Staff confirmed an SSO had occurred with an estimated
discharge of approximately 2,000 gallons of untreated wastewater to adjacent land, buffers, and surface
waters. The Town has determined the project known as "Buckhorn Branch Park Construction Drawings"
(project) to be in violation of the Standard Provisions issued with the final approval of on August 31, 2021.
The following Standard Provisions supports our determination:
1. The applicant shall comply with all applicable federal, state, and local regulations, and obtain all
necessary federal, state, and local permits, including but not limited to USACE, NCDEQ Johnston
County, and the Town of Clayton.
2. It shall be responsibility of the applicant to determine and verify the exact location of all utilities
within all areas of construction. The applicant shall be responsible for notifying other utility owners
and providing protection and safeguards to prevent damage or interruption to existing facilities and
to maintain accessibility to existing utilities.
In accordance with the Standard Provision #1 mentioned above, the project has been found to be in
violation of the conditions of the Wastewater Collection System Extension Permit (WQ0042608)
submitted by Jones & Cnossen Engineering, PLLC, the Engineer of Record for the project, on behalf of the
Town of Clayton. The Wastewater Collection System Extension Permit (WQ0042608) was approved with
the following conditions:
Condition 11.1: This permit shall not be automatically transferable; a request must be made and approved.
Condition 11.4: Requires that the wastewater collection facilities be properly operated and maintained in
accordance with 15A NCAC 02T.0403 or any individual system -wide collection system permit issued to the
Permittee.
Condition 11.7: Upon completion of construction and prior to operation of these permitted facilities, the
completed Engineering Certification form with checklist attached to this permit shall be submitted with
the required supporting documents to the address provided on the form. Permit modifications are
required for any changes resulting in non-compliance with this permit, regulations, or the Minimum
Design Criteria. [15A NCAC 02T.0116]

It has been determined the project is not in compliance with Condition 11.4 and 11.7 of the approved
Wastewater Collection System Permit (WQ0042608) for lack of proper operation and maintenance in
accordance with 1SA NCAC 02T .0403 "(1) The collection system shall be effectively maintained and
operated at all times to prevent discharge to land or surface waters and to prevent any contravention of
groundwater standards or surface water standards." It is the developers responsibility for operation and
maintenance of the aforementioned infrastructure until acceptance and certification by the Town of
Clayton.
In accordance with Standard Provision #2 mentioned above, it was determined the subject SSO was
contributable to an unbeknownst and unauthorized opening of an existing forcemain valve along US 70
Business, which resulted in wastewater entering a non -certified, approved, or operated wastewater
collection by the Town, and/or NCDEQ.
Immediate corrective action to ensure compliance with the conditions and provisions mentioned above
is imperative to ensure additional SSO's do not occur, risking the health and safety of the public. The Town
is seeking your cooperation and would like to avoid taking further enforcement action.

WQ0042608 dated July 27, 2021 to the Town of Clayton (Permittee) for the construction and operation
upon certification of the subject wastewater collection system extension. This permit shall be effective
from the date of issuance until rescinded and shall be subject to the conditions and limitations as specified
therein. This cover letter shall be considered a part of this permit and is therefore incorporated therein
by reference.
Please pay particular attention to the following conditions contained within this permit:

WASTEWATER COLLECTION SYSTEM EXTENSION PERMIT
In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as
amended, and other applicable Laws, Rules, and Regulations, permission is hereby granted to the
Town of Clayton
Johnston County
for the construction and operation of approximately 10,075 linear feet of 8-inch gravity sewer, 30 linear
feet of 12-inch gravity sewer, a 482—gallon per minute pump station with duplex pumps, on -site audible
and visual high water alarins, telemetry, and a permanent generator with automatic transfer switch, as
well as approximately 3,240 linear feet of 8-inch force main to serve 324 single family homes, pool, and
clubhouse as part of the Buckhorn Branch Park project, and the discharge of 81,356 gallons per day of
collected domestic wastewater into the Town of Clayton's existing sewerage system, pursuant to the
application received June 8, 2021 and in conformity with 15A NCAC 02T; the Division's Gravity Sewer
Minimum Design Criteria adopted February 12, 1996 and updated in March 2008, as applicable; the
Division's Minimum Design Criteria for the Fast -Track Permitting of Pump Stations and Force Mains
adopted June 1, 2000 as applicable; and other supporting data subsequently filed and approved by the
Department of Environmental Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the specified
conditions and limitations contained therein.

sewage and wastewater collected by this system shall be treated in the Town of Clayton's Little Creek
Water Reclamation Facility in accordance with Permit Number NC0Q25453.
Permitting of this project does not constitute an acceptance of any part of the project that does not meet
15A NCAC 02T; the Division's Gravity Sewer Minimum Desigp Criteria adopted February 12, 1996 as
applicable; and the Division's Minimum Design Criteria for the Fast -Track Permitting of Pump Stations and
Force Mains adopted June 1, 2000 as applicable, unless specifically mentioned herein. Division approval
is based on acceptance of the certification provided by a North Carolina -licensed Professional Engineer in
the application. It shall be the Permittee's responsibility to ensure that the as -constructed project meets
the appropriate design criteria and rules.
Construction and operation is contingent upon compliance with the Standard Conditions and any Special
Conditions identified below.

the Fast -Track Permitting of Pump Stations and Force Mains adopted June 1, 2000 as applicable; and

application and other supporting data. [15A NCAC 02T .0110]
4. The wastewater collection facilities shall be properly maintained and operated at all times. The
Permittee shall maintain compliance with an individual system -wide collection system permit for the
operation and maintenance of these facilities as required by 15A NCAC 02T .0403. If an individual
permit is not required, the following performance criteria shall be met:
a. The sewer system shall be effectively maintained and operated at all times to prevent discharge
to land or surface waters, and to prevent any contravention of groundwater standards or surface
water standards.

b. A map of the sewer system shall be developed and shall be actively maintained.
c. An operation and maintenance plan including pump station inspection frequency, preventative
maintenance schedule, spare parts inventory and overflow response has been developed and
implemented.
d. Pump stations that are not connected to a telemetry system shall be inspected every day (i.e. 365
days per year). Pump stations that are connected to a telemetry system shall be inspected at
least once per week.
e. High -priority sewer lines shall be inspected at least once per every six -months and inspections are
documented.
f. A general observation of the entire sewer system shall be conducted at least once per year.
g•
Overflows and bypasses shall be reported to the appropriate Division regional office in accordance
with 1SA NCAC 2B .0506(a), and public notice shall be provided as required by North Carolina
General Statute §143-215.1C.
h. A Grease Control Program is in place as follows:
1. For public owned collection systems, the Grease Control Program shall include at least
biannual distribution of educational materials for both commercial and residential users and
the legal means to require grease interceptors at existing establishments. The plan shall also
include legal means for inspections of the grease interceptors, enforcement for violators and
the legal means to control grease entering the system from other public and private satellite
sewer systems.
2. For privately owned collection systems, the Grease Control Program shall include at least bi-
annual distribution of grease education materials to users of the collection system by the
permittee or its representative.
3. Grease education materials shall be distributed more often than required in Parts (1) and (2)
of this Subparagraph if necessary to prevent grease -related sanitary sewer overflows.
Right-of-ways and easements shall be maintained in the full easement width for personnel and
equipment accessibility.
Documentation shall be kept for Subparagraphs (a) through (i) of this Rule for a minimum of three
years with exception of the map, which shall be maintained for the life of the system.
5. The Permittee shall report by telephone to a water resources staff member at the Raleigh Regional
Office, telephone number [phone], as soon as possible, but in no case more than 24 hours,
following the occurrence or first knowledge of the occurrence of either of the following:
a. Any process unit failure, due to known or unknown reasons, that renders the facility incapable
of adequate wastewater transport, such as mechanical or electrical failures of pumps, line
blockage or breakage, etc.; or
b. Any S5O and/or spill over 1,000 gallons; or
c. Any SSO and/or spill, regardless of volume, that reaches surface water
Voice mail messages or faxed information is permissible, but this shall not be considered as the initial
verbal report. Overflows and spills occurring outside normal business hours may also be reported to
the Division of Emergency Management at telephone number [phone] or [phone].
Persons reporting any of the above occurrences shall file a spill report by completing and submitting
Part I of Form CS-SSO (or the most current Division approved form) within five days following first

knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to
ensure that the problem does not recur. Part II of Form CS-SSO (or the most current Division approved
form) can also be completed to show that the 550 was beyond control. [G.S. 143-215.1C(a1)]
6. Construction of the gravity sewers, pump stations, and force mains shall be scheduled so as not to
interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater
to the surface waters of the State. [15A NCAC 02T.0108(b)]
7. Upon completion of construction and prior to operation of these permitted facilities, the completed
Engineering Certification form with checklist attached to this permit shall be submitted with the
required supporting documents to the address provided on the form. A complete certification is one
where the form is fully executed and the supporting documents are provided as applicable. Any
wastewater flow made tributary to the wastewater collection system extension prior to completion
of this Engineer's Certification shall be considered a violation of the permit and shall subject the
Permittee to appropriate enforcement actions.
If the permit is issued to a private entity with an Operational Agreement, then a copy of the Articles
of Incorporation, Declarations/Covenants/Restrictions, and Bylaws that have been appropriately
filed with the applicable County's Register of Deeds office shall be submitted with the certification.
A complete certification is one where the form is fully executed and the supporting documents are
provided as applicable. Supporting documentation shall include the following:
a. One copy of the project construction record drawings (plan & profile views of sewer lines & force
mains) of the wastewater collection system extension. Final record drawings should be clear on
the plans or on digital media (CD or DVD disk) and are defined as the design drawings that are
marked up or annotated with after construction information and show required buffers,
separation distances, material changes, etc.
b. One copy of the supporting applicable design calculations including pipe and pump sizing, velocity,
pump cycle times, and level control settings, pump station buoyancy, wet well storage, surge
protection, detention time in the wet well, and force main, ability to flush low points in force
mains with a pump cycle, and downstream sewer capacity analysis. If a portable power source or
pump is dedicated to multiple stations, an evaluation of all the pump stations' storage capacities
and the rotation schedule of the portable power source or pump, include travel timeframes, shall
be provided.
c. Changes to the project that do not result in non-compliance with this permit, regulations, or the
Minimum Design Criteria should be clearly identified on the record drawings, on the certification
in the space provided, or in written summary form.
Prior to Certification (Final or Partial): Permit modifications are required for any changes resulting
in non-compliance with this permit (including but not limited to pipe length changes of 10% or
greater, increased flow, pump station design capacity design increases of 5% or greater, and
increases in the number/type of connections), regulations, or the Minimum Design Criteria.
Requested modifications or variances to the Minimum Design Criteria will be reviewed on a case -by -
case basis and each on its own merit. Please note that variances to the Minimum Design Criteria
should be requested and approved during the permitting process prior to construction. After -

construction requests are discouraged by the Division and may not be approved, thus requiring
replacement or repair prior to certification & activation. [15A NCAC 02T .0116]
8. Gravity sewers installed greater than ten percent below the minimum required slope per the Division's
Gravity Sewer Minimum Design Criteria shall not be acceptable and shall not be certified until
corrected. If there is an unforeseen obstacle in the field where all viable solutions have been
examined, a slope variance can be requested from the Division with firm supporting documentation.
This shall be done through a permit modification with fee. Such variance requests will be evaluated
on a case -by -case basis. Resolution of such request shall be evident prior to completing and submitting
the construction certification. [ 15A NCAC 02T.0105(n)]
9. A copy of the individual permit and construction record drawings shall be maintained on file by the
Permittee for the life of the wastewater collection facilities. [15A NCAC 02T .0116]
10. Failure to abide by the conditions and limitations contained in this permit; 15A NCAC 02T; the
Division's Gravity Sewer Design Criteria adopted February 12, 1996 as applicable; the Division's
Minimum Design Criteria for the Fast -Track Permitting of Pump Station and Force Mains adopted June
1, 2000 as applicable; and other supporting materials may subject the Permittee to an enforcement
action by the Division, in accordance with North Carolina General Statutes §143-215.6A through §143-
215.6C, construction of additional or replacement wastewater collection facilities, and/or referral of
the North Carolina -licensed Professional Engineer to the licensing board. [15A NCAC 02T .0108(b-c)]
11. In the event that the wastewater collection facilities fail to perform satisfactorily, including the
creation of nuisance conditions, the Permittee shall take immediate corrective action, including those
as may be required by this Division, such as the construction of additional or replacement facilities.

12. The issuance of this permit shall not exempt the Permittee from complying with any and all statutes,
rules, regulations, or ordinances that may be imposed by the Division any other Federal, State, or Local
government agencies which have jurisdiction or obtaining other permits which may be required by
the Division or any other Federal, State, of Local government agencies. [G.S. 143-215.1(b)]

Standard Provisions
1. All improvements shall be constructed in accordance with the approved constructed plans.
Any proposed change to the approved drawings must be conducted in accordance with the
Town's current policy, and approved prior to construction.
2. An executed copy of this approval must be present at the construction site at all times during
construction. The Town of Clayton reserves the right to stop all work unless evidence of
approval can be shown.
3. Should the Town of Clayton, or other agencies fail to identify that the plans and specification
are not in compliance with respective Town ordinances, standards, specifications, and details,
or that the owner/developer has not addressed the comments made by either Town, whether
from lack of discovery or for any other reason, it shall in no way relieve the owner/developer
of their obligation thereof, nor obligate the Town of Clayton to correct such errors or
omissions. The presence of the Town of Clayton engineer or construction inspector at the
work site shall in no way lessen the owner's responsibility for conformity with the plans and
specifications.
4. Clayton does not guarantee any property lines or right-of-way, nor will it be responsible for
any claim for damages brought by any property owner by reason of this approval. It is the
responsibility of the applicant to verify all property lines and right-of-way and secure any
construction easements (temporary or permanent) from property owners affected by the
construction activities.
5. All property owners and residents within the project limits shall be notified in writing prior to
construction.
b. All construction activities must be conducted between the hours of 7:00 am and 9:00 pm in
accordance with Clayton's noise ordinance. Any activity which requires inspection by
Clayton's Engineering Division must be scheduled prior and then conducted between the hours
of 7:00 am and 4:00 pm, Monday through Friday.
7. The traveling public will be warned of construction with complete and proper signing and
traffic control devices in accordance with the current Manual on Uniform Traffic Control
Devices (MUTCD). No work shall be performed in any public or private right-of-way unless
this requirement is satisfied. Clayton reserves the right to require a written traffic control plan
for any activity within a right-of-way.
8. Two-way traffic must be maintained at all times. No lane of traffic shall be closed or restricted
before 9:00 am or after 4:00 pm. Clayton reserves the right to further limit, restrict, or suspend
operation within the right-of-way if, in the opinion of Clayton, safety or traffic conditions
warrant such action.

9. The applicant shall comply with all applicable federal, state, and local regulations, and obtain
all necessary federal, state, and local permits, including but not limited to USACE, NCDEQ,
Johnston County, and the Town of Clayton.
10. It shall be responsibility of the applicant to determine and verify the exact location of all
utilities within all areas of construction. The applicant shall be responsible for notifying other
utility owners and providing protection and safeguards to prevent damage or interruption to
existing facilities and to maintain accessibility to existing utilities.
Conditions for STORMWATER PERMIT
1. Approved plan and permit shall become null and void if substantial progress is not made within
one (1) year of the date of this letter. A single, one (1) year extension may be requested if
written request is submitted before the expiration of the approved plan. [code section
158.203(2)].
2. Impervious surface limits for each lot to be noted on recorded plat.
3. All Stormwater Control Measures (SCMs) are to be located in private drainage easements with
access to a public right of way (ROW) and should be shown on associated recorded plats [code
section 158.407].
4. Declaration of Maintenance Covenant and Grant of Protective Easements for Stormwater
Control Facilities must be recorded, as appropriate, and reference on appropriate, subsequent
plats [code section 158.401].
5. Upon completion of project and before a certificate of occupancy shall be granted, certification
of Stormwater manangement plan and "as -built" plans for drainage and Stormwater Control
Devices shall be submitted and approved by the Town [code section 158.202(3)].

Brandon arrived at 10:05 am and found spill. He contacted Chris Rowland immediately and Stephen Norris at
10:13 am. Chris Rowland contacted Axis and Montague contractors. Brandon called Chris Snead to come help
and Chris Snead also contacted Chris Rowland. Contractor was to report clean up to Chris Rowland. Mitigated
time was 10:40 am. Kevin Watson arrived at 11:15, Jonathon Jacobs arrived at 11:28. Montague started clean
up at 11:55 am.

that the last I heard Jonathon Jacobs instructed Kevin Watson or Chris Rowland to make contact with the
state.I called Jonathon and asked him about it and he called Chris and called me back to tell me that Byron
had talked to Chris and that Chris was going to make contact with the state

Joshua B. called me at 1645hrs. to discuss reporting the SSO to the State. Chris Rowland or Kevin Watson
were supposed to call the State to advise them of the SSO and that the contractor was going to submit the
spill report. I texted Chris R. at 1715hrs to ask if they had contacted the State and he called me back at
1725hrs, they did not call the State but he just spoke to the contractor and he was preparing to submit the
report. I asked Chris to follow up with a phone call to the State in the morning to verify the report had been
submitted and get a copy of the report from the contractor for our records.
