The questions are related to aquatic life passage since Little Creek supports trout. On October 7, 2022, the Division of Water Resources (Division) received your application dated October 7, 2022, requesting a 401 Water Quality Certification from the Division for the subject project. The Division has determined that your application is incomplete and cannot be processed. The application is on-hold until the following information is received: 1. The slope of the double barrel RCBC is 3.9%. Per NCDOT guidance (Guidelines for Drainage Studies and Hydraulic Design, 2016), if the culvert slope is greater than 2%, then sills and baffles are required to help retain native material within the culvert. The Division has concerns that the proposed design with sills at the inlet/outlet will not retain bed load and may need additional baffles. Please redesign or provide justification for not having additional sills or baffles inside the culvert. \[15A NCAC 02H .0506(b)\] 2. Condition 11 of GC 4135 states “ Placement of culverts and other structures in streams shall be below the elevation of the streambed by one foot for all culverts greater than 48 inches”. The cross section and profile for the 87”x 63” CMPA indicates that the structure will be installed at grade and will not meet Condition 11. Slope is 4.8%. Please redesign or provide justification for the design. Also, can baffles or sills be utilized to retain material in the culvert? \[15A NCAC 02H .0506(b)\] 2 Pursuant to Title 15A NCAC 02H .0502 (c), the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received within 30 calendar days, of receipt of this email, the Division will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee.
