Per my conversation and request from Ms. Cherri Smith, of the NCDWR
Raleigh Regional Office, enclosed is a summary of previously permitted and
newly proposed riparian buffer imapcts associated with the project known as
South Lake at Holding Village, within the Town of Wake Forest and drains to
Smith Creek within the Neuse River Basin.

• Riparian Buffer Authorization Form
PREVIOUSLY AUTHORIZED IMPACTS: The property was originally to
be developed by Planned Community Partners and East -West Partners in 2008
and a Neuse River Buffer Impact Permit was issued by DWQ on December 21,
2007, associated with the bridged road crossing and level- spreader impacts on
the west side of the property (DWQ Project # 07- 0295vl/v2). However, due to
economic conditions, the project was abandoned, and the property was
purchased by a land holding company American Land Fund (ALF) in August
2011. In an effort to reduce liability and insurance on the property associated
with the dam, a Nationwide Permit 3/ DWQ General Certification 3383, and

Company, Inc.
Neuse Buffer Authorization (DWR #07- 0295v3) was issued in 2012 in order to
re -build the dam and bring it into compliance with NC Dam Safety.

CURRENTLY PROPOSED IMPACTS: After realizing what an asset
Holding Lake will be to future residents, WSR HV LLC would like to construct
3 piers that would give the residents safe access to the lake. At this time Holding
Lake dam is currently under re- construction (which was previously permitted
DWR #07- 0295v3) to bring it up to code per NC Dam Safety standards, and is an
ideal opportunity to construct these piers while lake levels have been drawn
down. Once the dam is re- constructed and the lake has filled up, the riparian
buffer will be re- established around the lake edge, and an access through the
riparian buffer will be required in order to access each of the three piers.
PROPOSED IMPACTS: The access piers are proposed in three strategic
locations which would allow for uniform access from the greenway and the
amenity center, while maintaining the integrity of the dam. In order to
accommodate the pier access, a portion of the greenway in front of the amenity
center was modified, which altered the originally permitted location and slightly
increased the buffer impacts in this location. Table 2, above and the paragraph
below describe the currently proposed impacts.
Pier Access (Buffer) Impacts (Fig 4: Insets 12 -14): The pier access locations
are sited adjacent to the previously permitted greenway along the perimeter of
the lake, so additional access trails through the buffer are not required to reach
the proposed piers. Each of the pier accesses through the buffer are at near
perpendicular angles and total 1,113 sf, with 988 square feet of impact in zone 1
and 125 square feet of impact proposed in zone 2. Each pier will be tied into the
300 -ft contour along the perimeter of the lake and will be constructed using
wooden pilings and treated lumber, and are intended to be constructed while the
lake is drained for repairs. The access from the pier to the greenway will be a
boardwalk type of structure. The pier and access is considered to be a water
dependent structure and an allowable use within the Neuse River Riparian Buffer
Rules Table of Uses.

There are no impacts to jurisdictional streams and / or wetlands associated with
the pier(s) construction. There will be no footer, foundation for the pier
structure(s), or bulkhead placed below the normal pool of the lake, therefore no
404 permit will be required from USAGE.
Greenway Impacts (Inset 1): In order to accommodate the pier access, a portion
of the greenway in front of the amenity center was modified, which altered the
originally permitted location and slightly increased the buffer impacts to zone 2,
in this location, totaling 2,667 sf. The gradient is low to flat in most of the
greenway locations and the greenway will be slightly crowned to allow for
drainage to slope off on both sides of the greenway and diffuse the flow into the
pond. The only water draining off the greenway is limited to what water falls onto
the greenway, the remainder of the drainage flows from the project will be diffuse
through level spreaders. There are no jurisdictional streams or wetlands within
the project area and no stream or wetland impacts associated with the proposed
project.
AVOIDANCE and MINIMIZATION: Impacts to jurisdictional streams
and wetlands have been completely avoided while impacts to stream buffers
have been minimized to the maximum extent practicable. Retaining walls will
be placed along the rear of the lots where needed to completely avoid riparian
buffer impacts. The original trail layout was arbitrarily placed to stay mostly
within Zone 2 of the buffer, however, the centerline of the trail was recently
staked off out in the field by the applicant to avoid large diameter trees, while
staying under the canopy of large species in currently open areas and lesser
sloped areas. Although there are parallel buffer impacts along the edge of the
pond in Zones 1 and 2, this is a better alternative than keeping the original trail
alignment on the steeper slopes of Zone 2 and requiring more removal of native
vegetation. The greenway bridge and stormwater dissipaters are angled at a
near 90- degree angle minimizing riparian buffer impacts.

DIFFUSE FLOW: All stormwater flows within the project will flow in a
diffuse manner through the riparian buffer. All stormwater within the project
aside from the greenway will outlet through a level- spreader before discharging
into the riparian buffer. The gradient is low to flat in most of the greenway

slope off on both sides of the greenway and diffuse the flow into the pond. The
