Peeler, Director of Public Works City of Lincolnton PO Box 617 Lincolnton, North Carolina 28093-0617 Subject: Final NPDES Permit Renewal Permit NC0025496 Lincolnton WWTP Lincoln County Class IV Facility Dear Mr. Peeler: Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly, we are forwarding the attached NPDES permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). In response to your comments the Division offers the following responses: • The Division considered your request to remove color monitoring and upon further review of the color data agrees to remove color from the permit monitoring requirements. • The Division will consider removing the requirements for bis (2-ethylhexyl) phthalate once the City implements the new sampling techniques and collects at least 8 data points. If the results of sampling show no reasonable potential to exceed the water quality criterion monitoring can be removed. The City should request a permit modification to remove the monitoring requirements. This final permit contains the following changes from your previous permit: • The NC 2007-2014 Water Quality Standard (WQS) Triennial Review was approved by the NC Environmental Management Commission (EMC) on November 13, 2014. The US EPA subsequently approved the WQS revisions on April 6, 2016 with some exceptions. The NC Division of Water Resources NPDES Permitting Unit is required to implement the new dissolved metal standards in all permits public noticed after April 6, 2016. The new standards for most metals include acute standards. Further, the freshwater standards for several metals are expressed as the dissolved form of the metals, and seven metals have hardness -dependent equations. Effluent hardness and instream hardness sampling, upstream of the discharge, has been added to this permit at a monitoring frequency of quarterly. • As a result of a reasonable potential analysis the following limits and monitoring requirements were implemented in your permit: o 3.5 & 4.5 MGD Flow Tiers: eliminated monitoring requirements for total phenolic compounds, eliminated limits for antimony, and added monitoring for total cadmium and bis (2-ethylhexyl) phthalate. o 6 MGD Flow Tier: eliminated monitoring requirements for total phenolic compounds, added monitoring for copper and bis (2-ethylhexyl) phthalate, added monthly average and daily maximum limits for total cadmium, and maintained the limits for antimony and monitoring for silver. o There was one detection for silver at the MDL which is above the water quality standard, monitoring will remain in the permit. The Division recommends that the City reviews and implement clean sampling and analysis techniques and split silver samples with another lab. In many cases, taking additional care and quality assurance steps when sampling may sufficiently reduce the perceived problem. Some steps that can be investigated: • Identify potential sources of contamination (sampling location access, laboratory use of fans, high dust areas) • Examine basic sample handling processes (field sampling, laboratory handling and analysis) • Examine sampling equipment cleaning procedures (jugs/bottles/samplers/strainers/reagent quality) • Examine laboratory equipment for potential sources of contamination (digestions, containers, talc free gloves) • Examine solvents/rinsates for potential contamination (reagent quality, special metallic removing soaps) • Collect field reagent blanks for monitoring purposes • Purchase "clean room gloves"; eliminate "paper towels" — replace with clean room wipes • Assure that sampling personnel are non-smokers If silver hits continue the City should look at SIU's or perform a collection system survey to look for possible sources. A permit limit will be implemented during the next permit renewal if effluent levels show reasonable potential or exceed the Total allowable silver concentration of 0.91 µg/1. • Limits for ammonia were added for the three flow tiers. In the past the Division maintained existing limits or monitoring in the permit if the facility demonstrated compliance with the whole effluent toxicity test. In recent developments the EPA has objected to the use of this practice. Ammonia limits are being implemented based on the ammonia criteria of 1.0 mg/l. The limits for 3.5 MGD are 12 mg/1 monthly average and 35 mg/1 weekly average. At 4.5 MGD the limits are 9 mg/1 monthly average and 27 mg/1 weekly average. For 6 MGD limits are 7 mg/1 monthly average and 21 mg/1 weekly average. , Page I • A mercury evaluation was conducted in accordance with the Permitting Guidance developed for the implementation of the statewide Mercury TMDL to determine the need for a limit and/or a Mercury Minimization Plan (MMP). No limit is required but you will be required to develop a MMP. See Special Condition A. (6). • The whole effluent toxicity test special condition was modified to include the IWC for the three permitted flow tiers. See Special Condition A. (4). • Starting December 21, 2016, federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and specify that, if a state does not establish a system to receive such submittals, then permittees must submit DMRs electronically to the Environmental Protection Agency (EPA). The final NPDES Electronic Reporting Rule was adopted and became effective on December 21, 2015. The requirement to begin reporting discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring Report (eDMR) internet application has been added to your NPDES permit. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699- 6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Resources or any other Federal, State, or Local governmental permits that may be required. Discharge from said treatment works at the location specified on the attached map into the South Fork Catawba River, which is classified a WS-IV water in the Catawba River Basin. There shall be no discharge of floating solids or visible foam in other than trace amounts. A. (4). CHRONIC TOXICITY PERMIT LIMIT (QUARTERLY) [15A NCAC 02B .0200 et seq.] The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 6% (3.5 MGD) / 8% (4.5 MGD) / 11 % (6 MGD). The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised December 2010, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised- December 2010) or subsequent versions. The tests will be performed during the months of March, June, September, and December. These months signify the first month of each three-month toxicity testing quarter assigned to the facility. Effluent sampling for this testing must be obtained during representative effluent discharge and shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -December 2010) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWR Form AT-3 (original) is to be sent to the following address: Attention: North Carolina Division of Water Resources Water Sciences Section/Aquatic Toxicology Branch 1621 Mail Service Center Raleigh, NC 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Water Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test Page 8 of 15 • Permit No. NC0025496 form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Water Sciences Section at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Assessment of toxicity compliance is based on the toxicity testing quarter, which is the three month time interval that begins on the first day of the month in which toxicity testing is required by this permit and continues until the final day of the third month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Resources indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. Page 9 of 15 Permit No. NC0025496 A. (5.) EFFLUENT POLLUTANT SCAN [G.S. 143-215.1(b)] The Permittee shall perform a total of three (3) Effluent Pollutant Scans for all parameters listed below. One scan must be performed in each of the following years: 2017, 2018, and 2019. Analytical methods shall be in accordance with 40 CFR Part 136 and shall be sufficiently sensitive to determine whether parameters are present in concentrations greater than applicable standards and criteria. Samples should be collected with one quarterly toxicity test each year, and must represent seasonal variation [i.e., do not sample in the same quarter every year]. Unless otherwise indicated, metals shall be analyzed as "total recoverable." The US EPA requires four (4) toxicity tests for a test organism other than the test species currently required in this permit. The multiple species tests should be conducted either quarterly for a 12-month period prior to submittal of the permit renewal application, or four tests performed at least annually in the four and one half year period prior to the application. These tests shall be performed for acute or chronic toxicity, whichever is specified in this permit. (6) MERCURY MINIMIZATION PLAN [G.S. 143-215.1(b)] The permittee shall develop and implement a mercury minimization plan during this permit term. The MMP shall be developed within 180 days of the NPDES Permit Effective Date, and shall be available for inspection on -site. A sample MMP was developed through a stakeholder review process and has been placed on the Division website for guidance (htt�:/mortal.ncdenr.org/web/wq/swp/ps/npdes, under Model Mercury Minimization Plan). The MMP should place emphasis on identification of mercury contributors and goals for reduction. Results shall be summarized and submitted with the next permit renewal. Performance of the Mercury Minimization Plan will meet the requirements of the TMDL (Total Maximum Daily Load) for mercury approved by USEPA on October 12, 2012, unless and until a Waste Load Allocation specific to this facility is developed and this NPDES permit is amended to require further actions to address the Waste Load Allocation. A. (7) ANNUAL FLOW REPORTING [G.S. 143-215.66] In addition to monthly flow reporting, the Permittee shall report annual average flow for the calendar year on the December Discharge Monitoring report (DMR). If this annual average flow requires a move to the next effluent sheet, the Permittee shall notify the Division that they are now subject to a new effluent sheet. A.(8) ELECTRONIC REPORTING OF DISCHARGE MONITORING REPORTS [G.S. 143- 215.1(b)] Federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and program reports and specify that, if a state does not establish a system to receive such submittals, then permittees Page 11 of 15 Permit No. NC0025496 must submit monitoring data and reports electronically to the Environmental Protection Agency (EPA). The final NPDES Electronic Reporting Rule was adopted and became effective on December 21, 2015. The City would like to request that color be dropped altogether from the permit. The City has conducted Upstream/Downstream and effluent color samples for many years and we believe that our effluent discharge does not significantly impact the South Fork River. The City of Lincolnton has lost several large textile manufacturers in the past two years that contributed significant amounts of color to our influent. Since these industries have closed, our effluent color discharge has been noticeably decreased. Therefore, we ask that you review our request to remove color from our final NPDES Permit. Monitoring for bis (2-ethylhexyl) phthalate was added for monitoring to the draft permit. This was due to hits on our PPA Analysis and the reasonable potential analysis. After looking at possible sources of bis (2- ethylhexyl) phthalate and discussing sampling techniques with our contract labs, we believe that our PPA samples could possibly have been contaminated by our own sample containers. We used LDPE sample containers to collect our samples and these type containers could possibly be the source of the bis (2- ethylhexyl) phthalate. In the future, we will collect our bis (2-ethylhexyl) phthalate sample in glass containers to see if this makes a difference in our lab results. If in fact this does make a difference in our lab results, we would like to request a reopener for this pollutant to be removed from the permit. This test is very expensive to perform, ranging from S125.00 to S250.00 per sample. Please consider this request for this pollutant. Average discharge flows are around 2 MGD. The current permit expired on July 31, 2015. The City submitted an application for renewal on January 30, 2015. The Lincolnton WWTP treatment system consists of grit removal, oxidation ditch, aeration tanks, dual final clarifiers, chlorination and dechlorination. Lincolnton has a full pretreatment program through the Division of Water Resources PERCS Unit receives wastewaters from four non -categorical users and three categorical industrial users. The pretreatment program will continue to be implemented in accordance with the permit. II. RECEIVING STREAM This facility discharges to the South Fork Catawba River in the Catawba River Basin, classified WS-IV waters, HUC 03050102. The Catawba River is not listed as impaired for this section in the NC 2014 303(d) list. III. DATA REVIEW AND VERIFICATION OF EXISTING CONDITIONS A. DMR Review DMRs were reviewed for the period of January 2013 to April 2016. Data are summarized in Table 1. Mercury Evaluation A mercury evaluation was conducted in accordance with the permitting guidance developed for the implementation of the statewide Mercury TMDL to determine the need for a limit and/or Mercury Minimization Plan (MMP). Based on stream dilution the water quality based effluent limitation (WQBEL) for mercury is 182 ng/1. The technology based effluent limit (TBEL) is 47 ng/1. None of the annual averages exceeds the WQBEL or TBEL, therefore no limit will be implemented. The facility had detections above 1 ng/1 over the past five years, therefore a Mercury Minimization Plan will be required in the permit. A condition will be added to the permit describing the requirements for the MMP. See the attached mercury evaluation spreadsheet. Table 2. RPA: A reasonable potential analysis was conducted on effluent toxicant data collected between April 2013 to April 2016. For the flow tier of 3.5 MGD, the following permitting actions are proposed for this permit as a result of the analysis: • Monitoring Only: o The following parameters will receive a monitor -only requirement since they did not demonstrate reasonable potential to exceed applicable water quality standards/criteria, but the maximum predicted concentration was >50% of the allowable concentration: total cadmium, total antimony. o There was one detection for silver at the MDL which is above the water quality standard, monitoring will remain in the permit. The Permittee should review and implement clean sampling and analytical techniques and spilt silver samples with another lab. If hits continue the Permittee should look at SIU's or perform a collection system survey to look for possible sources. o There is limited data for bis (2-ethylhexyl) phthalate which was detected in the PPA, quarterly monitoring was added to the permit. • No Limit or Monitoring: The following parameters will not receive a limit or monitoring, since they did not demonstrate reasonable potential to exceed applicable water quality standards/criteria and the maximum predicted concentration was <50% of the Page 2 allowable concentration: total phenolic compounds, total copper, total cyanide, total lead, total nickel, total selenium, total zinc. The flow tiers for 4.5 MGD and 6 MGD were also evaluated to determine if limits are necessary. The results of the RPA for 4.5 MGD provided the same limits and monitoring conditions as described above for 3.5 MGD. The results for the 6 MGD RPA resulted in the need to maintain the limit for antimony, add a limit for total cadmium and additional monitoring for copper. A spreadsheet of the RPA results is attached to this Fact Sheet. D. Priority Pollutant Analysis: The application includes the results of three priority pollutant analyses. No priority pollutants except for bis (2-ethylhexyl) phthalate were detected in the analysis. Since there is limited data for this parameter quarterly monitoring was added to the effluent monitoring requirements. E. Aquatic Toxicity Testing: Permit requires chronic toxicity, ceriodaphnia dubia, 11%. The facility passed 17 out of 19 tests. The application included four second species toxicity tests with passing results. The toxicity test requirements were updated to reflect the IWC at the lower flow tiers. F. Instream Monitoring: The permit requires instream monitoring for color during the summer at one upstream location and two downstream locations. Instream data shows similar color values upstream and downstream of the discharge. The permittee is not a member of the Yadkin -Pee Dee River Basin Association. IV. The hardness -based standards require some knowledge of the effluent and instream (upstream) hardness and so must be calculated case -by -case for each discharge. Metals limits must be expressed as `total recoverable' metals in accordance with 40 CFR 122.45(c). The discharge -specific standards must be converted to the equivalent totalvalues for use in the RPA calculations.
