Good morning all,
I spoke with the applicant (Bednarz) this morning and we have agreed to rescind the DWR
Certificate of Coverage for "non jurisdictional" wetlands based on the new Jurisdictional
Determination from the USACE (attached). The project is to continue as planned which is to
fill 404 wetlands with 0.2 acres mitigation landward of the 75' AEC in the form of a CAMA
Major Permit.
After the rescission of the "COC" we are seeking the Individual Water Quality Certificate
from DWR to accompany the USACE nationwide permit.

Please let us know what you need from the applicant once you receive documentation from
NC DWR. Ex) Receipt of the completed mitigation? Please let us know the order of operations
at this point.
