Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 970401 dated July 16, 1997, for the construction of Cedar Point Building Supply. This permit shall be effective from the date of issuance until July 16, 2007, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. The stormwater control has been designed to handle the runoff from 124,582 square feet of impervious area. 3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. Deed restrictions must be recorded prior to the sale of any outparcel or future area shown on the approved plans to ensure that future owners are made aware of the built -upon area limitations. The following statement must be recorded: "To ensure continued compliance with the NC Division of Water Quality Stormwater Management Permit Regulations, 15A NCAC 2H.1000, the future area as shown on the approved plans is limited to a total of 34,848 square feet of built -upon area, inclusive of that portion of the right-of-way between the front lot line and the edge of the pavement, structures, pavement, walkways of brick, stone, slate, but not including wood decking or the water surface of swimming pools." "All runoff from the future built -upon area must be directed into the permitted.stormwater control system. " "Additional built -upon area will require a permit modification." 6. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. The following items will require a modification to the permit: . a. Any revision to the approved plans, regardless of size. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision of the project area. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. In addition, the Director may determine that other revisions to the project should require a modification to the permit. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 4 State Stormwater Management Systems Permit No SW8 970401 Il. SCHEDULE OF COMPLIANCE 1. The permittee will comply with the following schedule for construction and maintenance of the stormwater management system: a. The stonnwater management system shall be constructed in it's entirety, vegetated and operational for it's intended use prior to the construction of any built -upon surface except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 2. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times. 3. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 4. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 5. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility,. a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 6. A copy of the recorded deed restrictions must be submitted to the DWQ within 30 days of the date of the recording. The recorded copy must be signed by the permittee, dated, stamped with the deed book number and page, and bear the stamp of the Register of Deeds. 7. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 5 State Stormwater Management Systems Permit No SW8 970401 III. GENERAL CONDITIONS This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement Stormwater management systems. The permittee grants DEHNR Staff permission to enter the property for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. Permit issued this the 16th day of July, 1997. Inspect the infiltration basin(s) for erosion, trash accumulation, grass coverage, and general condition of the facility. 2. Repair eroded areas immediately, re -seed as necessary, keep side slopes and bottom mowed, and remove trash. 3. Check any inlet piping, swales and catch basins. Repair broken piping, reseed swales, and remove trash. 4. Inspect the bypass/overflow structure for blockage and deterioration. Remove blockage and repair structure to originally approved design specifications. 5. Check the depth of the basin(s) every six months. If siltation has occurred to the point that only 75% of the original design depth is provided, remove the excess silt to the original depth. Do not over - excavate, as this may cause the required water table separation to be reduced, and may affect the ability of the system to perform as designed. On no portion of the proposed infiltration basin was any soil colors indicative of seasonal high water table conditions found any shallower than 4.6', & most of the area has a depth of at least 5'. I am willing to attest to this finding in a Court of Law. In regards to the letter from Linda Lewis, I offer the following observations. The precise locations of the soil profile analysis by Vincent Lewis is absolutely critical in the determination that elevation 70 or 71 has a 36" depth to the seasonal high water table on this site. There is in fact portions of this and the adjacent tracts at the assumed elevation of 70' that has seasonal high water table depths substantially less than 36". As you are well aware, the surface topography of the seasonal high water table is often substantially different from land surface topography in the lower Coastal Plain. The soil evaluation must be performed on the same landscape body & position as the original soil evaluation to be a valid comparison. The technical competence of Vinoeat Lewis in determination of soil colors indicative of soil wetness is beyond question. Knowing Vincent's competence, I could only conclude that he did not evaluate the basin site. Based on this assumption I canvassed the infiltration basin area very carefully & could only find my original profile excavations, No significant changes have occurred to the site since my soil evaluation of 4 April 1997 and no additional soil profile excavations have occurred on the basin site since then. The recent grading of the roadway in front of the building supply site may have hidden his evaluation holes there. 9M-547.9036 120 Balsam Road Jacksonville NC 285A6.8508 page t ,PARKER & ASSOCIATES TEL:1-919-455-3441 Jun 24.97 18:13 No.015 P.03 The steal irons and PVC pipe covers strongly imply that the roadway clearing could be the marked corners of the building site whereas the actual building site has not been disturbed in many months, Based on the visual impression of the recently cleared roadway. I am willing to bet that if a soil evaluation was done in this geographic area, it was probably located in that roadway clearing. Based on this assumption, I took several samples from the concave landscape body in die roadway that is adjacent to the convex landscape body where the basin is proposed. The roadway clearing adjacent to the basin does have a 30" to 36" seasonal high water table as well as sandy loam Bt that is much shallower (18" versus 36") or nonexistent. I will bet a dollar to donut hole that the wrong location was evaluated. I will be more than willing to meet you, Pete, Linda and/or any other parties at the site to review the soil conditions. Please advise as to how you wish to resolve this problem. Parker and Associates PO Box 976 Jacksonville, NC 28541-0976 Subject: ACKNOWLEDGEMENT OF RECEIPT AND REQUEST FOR ADDITIONAL INFORMATION Stormwater Project No. SW8 970401 Cedar Point Building Supply Carteret County Dear Mr. Stewart: The Wilmington Regional Office received information from the Regional Soil Scientist soil investigation at Cedar Point Building Supply on June 12, 1997. According to Vincent Lewis, the seasoanl high water table is about 36" below current grade. The tests were conducted at two locations, one roughly elevation 70 and the other elevation 71. This means that the lowest elevation for the bottom of the basin is 70. Please revise the plans and proposed contours to reflect this change. The other information requested was received on June 2, 1997 and has been reviewed. Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to July 13, 1997, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. We have revised this project due to finding that the seasonal high groundwater elevation on the Southwestern side of the project is significantly lower than the seasonal high groundwater elevation on the Northeastern side of the property where we had originally placed the Infiltration Basin. We have now moved the parking and building areas to the Northeast and relocated the basin to the Southwest as shown on the plan. Please find enclosed a copy of a letter dated May 30, 1997 from Mr. Wayne Ragland with a brief description of the soil profile and his determination of the seasonal high water table depth in the new infiltration basin area. From this letter, we have determined that the elevation of the bottom of the basin should be 68.5. Please find enclosed, with the revised permit application sheet, the original signature page that you had previously returned to me. Per your inquiry, Mr. Safrit is a "Partner" of Safrit Properties, L.L.C., as is now labeled on the permit application. Similar to the original design, we sized the basin to handle approximately 0.8 additional acres of possible future impervious areas to allow for possible future expansion of the building and parking areas. Please find enclosed a marked up copy of sheet 1 of 2 delineating the possible future impervious area additions that I have used in my calculations. The location of the soil evaluation is indicated by the nomenclature "Hole #1' and "Hole 92" on the photo -copy of the "Topographic Worksheet With Preliminary Layout" provided by Parker & Associates Inc (copy attached). The excavated soil profiles are located in the proposed infiltration basin and is representative of the basin area. The soil conditions are a close coarse loamy taxadjunct to the Blanton soil series except that colors indicative of soil wetness was found at 5.25' in hole # 1 and almost 5' in hole Q. A copy of the standard NRCS soil description for the Blanton soil series is attached. The saturated hydraulic conductivities of the sands down to 48" ranges from 6" to 20" per hour. The underlying loamy sand to sandy loam Bt has a saturated hydraulic conductivity of 2" to 6" per hour. The E horizon has hue of 2.5Y to 7.5YR, value of 5 to 8, and chroma of 1 to 8. Texture is the same as the A horizon. The E horizon is 50 percent or more uncoated sand grains. Concerning comments 1 and 5, we have designed the Infiltration Basin to allow the owner to expand in the future. There is no exact location of possible future impervious at this time. I have revised the Stormwater Infiltration Basin Engineering Calculations in the back of the Specifications to show how the storage volume was arrived at and also to list the surface area at Elevation 74 per your request. 3. We have now revised the plan to show a catch basin accepting the drainage off the parking area and piping to the basin with a perforated piping system to distribute the runoff over the infiltration basin bottom. 4. We have now shown the small area of wetlands that have been delineated on site. 5. See # 1 above. 6. The amount 1.9 Acres in the old Engineering Calculations for the impervious area was incorrect. The actual amount is 1.79 Acres as shown in the revised calculations and as shown previously on the permit application form. Work necessary for the construction of the Stormwater Infiltration Basin includes but is not limited to clearing and grubbing, dewatering, excavation, backfill, constructin J swales, grassing, and erosion control as shown on the plans and as outlined hereinafter. 2. FIELD ENGINEERING A. OWNER will establish base lines for Project and two bench marks for use by the CONTRACTOR. OWNER will furnish boundary surveys if required. B. CONTRACTOR shall: Develop and make all detail surveys and measurements needed for construction including slope stakes, batter boards, and all other working lines, elevations and cut sheets. 2. Be solely responsible for all locations, dimensions and levels. No data other than written orders of the ENGINEER shall justify departure from the dimensions and levels required by the Drawings. 3. Safeguard all points, stakes, grade marks, monuments and bench marks made or established on the Work, re-establish same if disturbed and rectify all Work improperly installed because of not maintaining, not protecting or removing without authorization such established points, stakes, marks and monuments. 4. When requested by ENGINEER, provide such facilities as may be necessary for ENGINEER to check line and grade points placed by CONTRACTOR. Where applicable, CONTRACTOR shall do no excavation or embankment work until cross -sectioning necessary for determining pay quantities has been completed and checked by ENGINEER. GR-2 3. SUBMITTALS The CONTRACTOR shall submit a minimum of three (3) copies of all submittals, of the various materials and products, to the ENGINEER for approval. Of these, one (1) copy will be returned to the CONTRACTOR. Each set of submittals shall include but not be limited to: 1. Drawings showing all dimensions units and locations of all other accessory equipment, including a piping layout. 2. All technical information needed by the ENGINEER to determine if the proposed equipment meets the plans and specifications. 4. TESTING LAB SERVICES A. General: Testing of materials, testing for moisture content during placement and compaction of fill materials, and of compaction requirements for compliance with technical requirements of the specifications shall be performed by a testing laboratory. B. Testing Services: 1. Test the CONTRACTOR'S proposed materials in the laboratory and/or field for compliance with the specifications. 2. Perform field moisture content and density tests to assure that the specified compaction of backfill materials has been obtained. 3. Report all test results to the ENGINEER and the CONTRACTOR. C. Authority and Duties off Testing Agency: Technicians representing the testing laboratory shall inspect the materials in the field and perform tests, and shall report their findings to the ENGINEER and the CONTRACTOR. when the materials furnished or work performed fails to fulfill specification requirements, the technician will direct the attention of the ENGINEER and CONTRACTOR to such failure. The technician shall not act as foreman or perform other duties for the CONTRACTOR. Work will be checked as it progresses, but failure to detect any defective work or materials shall not in any way prevent later rejection GR-3 when such defect is discovered, nor shall it obligate the ENGINEER for final acceptance. Technicians are not authorized to revoke, alter, relax, enlarge, or release any requirements of the specifications, nor to approve or accept any portion of the work. D. Responsibilities and Duties of CONTRACTOR: The use of testing services shall in no way relieve the CONTRACTOR of his responsibility to furnish materials and construction in full compliance with the drawings and specifications. To facilitate testing services, the CONTRACTOR shall: 1. Secure and deliver to the testing agency, without cost, preliminary representative samples of the materials he proposes to use and which are required to be tested. 2. Furnish such casual labor as is necessary to obtain and handle samples at the project or at other sources of material. 3. Advise the testing agency sufficiently in advance of operations to allow for completion of quality tests and for the assignment of personnel. 5. INSPECTION/CERTIFICATION Parker & Associates, Inc., as ENGINEER, will provide inspection throughout the performance of this Contract. Inspections will be made periodically or on a full time basis as the work progresses to insure compliance with these specifications and with the specification requirements shown on the plans. When requested by the ENGINEER, CONTRACTOR shall provide his services to insure to the ENGINEER's satisfaction that all dimensions, lines and grades are as designed. In order for the ENGINEER to adequately inspect and approve this construction, testing services shall be provided by an approved testing laboratory. Inspection by the ENGINEER is required in order to issue the Certification of Construction as required by the Division of Environmental Management to assure the infiltration basin is built according to the plans and specifications. GR-4 6. GUARANTEE OF WORK A. Except as otherwise specified, all work shall be guaranteed by the CONTRACTOR and his sureties against defects resulting from the use of faulty or inferior materials, equipment, or workmanship for 12 months from the date of final completion of the work as signified by acknowledgement of receipt of Final Payment by the CONTRACTOR. B. If, within any guarantee period, repairs, or changes are required in connection with guaranteed work, which, in the opinion of the ENGINEER, are rendered necessary as the result of the use of materials, equipment, or workmanship, which are inferior, defective, or not in accordance with the terms of the CONTRACT, the CONTRACTOR shall, promptly upon receipt of notice from the OWNER, and without expense to the OWNER: 1. Place in satisfactory condition, in every particular, all of such guaranteed work. 2. Correct all defects therein. 3. Make good all damage to the site, which in the opinion of the ENGINEER, is the result of the use of materials, equipment, or workmanship which are inferior, defective, or not in accordance with the terms of the CONTRACT. 4. Make good any work or material, or the equipment and contents of said building site, disturbed in fulfilling any such guarantee. C. If in fulfilling the requirements of the CONTRACT or of any guarantee embraced therein or required thereby, the CONTRACTOR disturbs any work guaranteed under another CONTRACT, he shall restore such disturbed work to a condition satisfactory to the ENGINEER, and shall guarantee such restored work to the same extent as it was guaranteed under such other CONTRACT. D. If the CONTRACTOR, after notice, fails to 'proceed promptly to comply with the terms of the guarantee, the OWNER may have the defects corrected and the CONTRACTOR and/or his Surety shall be liable for all expenses incurred. E. All special guarantees applicable to definite parts of the work that may be stipulated in the specifications or other papers forming a part of the CONTRACT shall be subject to the terms of this section during the first year of the life of such special guarantee. 1 2. 3. SITE WORK CLEARING AND GRUBBING Clearing shall consist of the cutting, removal, and satisfactory disposal of all trees, down timber, project roots, stumps, lap wood rubbish, trash, and all other objectionable material within the construction limits as directed. Any specific trees or shrubs designated to be saved by the OWNER shall be protected from injury during construction. Grubbing shall consist of the excavation, removal, and disposal of all stumps, roots, logs, and other perishable and objectionable material within the construction limits as directed. All clearing and grubbing shall be accomplished in such a manner as not to injure or destroy any merchantable timber or other property on land adjacent to the project site. Before any burning of debris shall occur, CONTRACTOR shall contact OWNER and ENGINEER for permission and location and CONTRACTOR will be required to secure ANY and ALL burning permits required. All perishable material shall be burned in such a manner as not to injure trees or shrubs outside the project site or any tree or shrub designated to be saved. Any material that cannot be completely burned will be removed and disposed of at an off -site location at the expense of the CONTRACTOR. If burning is not allowed, CONTRACTOR is responsible to remove all material from the site. EXCAVATION AND GRADING All grading and excavation shall be in accordance with typical dimensions and cross -sections shown on the plans and specifications contained herein. During excavation, all topsoil suitable for reuse shall be stockpiled in an area designated by the OWNER. All soils suitable for reuse as backfill material shall be stockpiled in a separate area designed by OWNER. All soils unsuitable for reuse shall be stockpiled in a separate location as designated by the OWNER. Services of a testing laboratory shall be used to determine which soils are best suitable for reuse as backfill. In areas requiring backfill to construct the berms, a minimum of 12-inches of topsoil and subsoil stripping shall occur prior to the commencement of backfill. 1. The CONTRACTOR shall provide and maintain adequate dewatering equipment to remove and dispose of all surface and ground water entering excavations, trenches, or other parts of the work. Each excavation shall be kept dry during subgrade preparation and continually thereafter until the structure to be built, or the pipe to be installed therein is completed to the extent that no damage from hydrostatic pressure, flotation, or other cause will result. A. The working areas on the site (exclusive of sediment entrapment devices) shall be kept free of surface water at all times. The CONTRACTOR shall install drainage ditches and dikes and shall perform all pumping and other work necessary to divert or remove rainfall and all other accumulations of surface water from the excavations and fill areas. The diversion and removal of surface water shall be performed in a manner that will prevent the accumulation of water behind temporary structures or at any other locations within the construction area where it may be detrimental. B. water used for working or processing, resulting from dewatering operations, or containing oils or sediments that will reduce the quality of the water downstream of the point of discharge shall not be directly discharged. Such waters shall be diverted through a settling basin or filter before being discharged. C. The CONTRACTOR is responsible for the condition of any pipe, conduit or channel which he may use for drainage purposes and all such pipes, conduits or channels shall be left clean and free of sediment. 2. The CONTRACTOR shall provide, install, and operate sufficient trenches, sumps, pumps, hose, piping, wellpoints, deep wells, etc., necessary to depress and maintain the ground water level below the base of the excavations during all stages of construction operations. The ground water table shall be lowered in advance of excavation and maintained two feet below the lowest subgrade excavation made until the structure has sufficient strength and weight to withstand horizontal and vertical soil and water pressures from natural ground water. The system must be operated on a 24-hour basis and standby pumping facilities and personnel shall be provided to maintain the continued effectiveness of the system. If, in the opinion of the ENGINEER, the water levels are not being lowered or maintained as required by these specifications, the CONTRACTOR shall install additional or alternate dewatering devices as necessary, at no additional cost to the OWNER. 4. BACKFILL After completion of stripping the area to receive embankment backfill and compaction, the CONTRACTOR shall place compacted backfill to construct the berms for the infiltration basin in SW-3 accordance with typical dimensions and cross -sections shown on the plans and requirements contained in the specifications herein. Any soft areas of subgrade containing unsuitable, wet or yielding material not readily capable of site compaction shall be removed and replaced with compacted select borrow material. Services of a testing laboratory shall be used to determine which soils are suitable as select borrow material. All fill shall be placed in horizontal loose lifts not exceeding 8-inches in thickness and shall be mixed and spread in a manner assuring uniform lift thickness after placing. Each lift shall be compacted by not less than two (2) complete coverages of the specified compactor. The compaction of the complete area of the backfill shall have a minimum compacted density of 95 percent as obtained by test procedures in ASTM D 1557 (modified proctor). Services of a testing laboratory shall be required to provide the CONTRACTOR with the required compaction density results to insure compliance with the above required compaction density. No fill material shall be placed when free water is standing on the surface of the area where the fill is to be placed. No compaction of fill will be permitted with free water on any portion of the fill to be compacted. 'No fill shall be placed or compacted in a frozen condition or on top of frozen material. Any fill containing organic materials or other unacceptable material previously described shall be removed and replaced with approved fill material prior to compaction. Each lift of compacted fill shall be compacted by the designated number of coverages of all portions of the surface of each lift by a smooth -drum vibratory roller for granular material having a static weight not less than 5,500 pounds, a sheepsfoot roller for cohesive material exerting a pressure of 250 psi on the surface of the feet, or equivalent equipment approved by the ENGINEER prior to commencement of the work. One coverage is defined as the condition obtained when subjected to the direct contact of the compactor. The compactor shall be operated at a forward speed not exceeding 40 feet per minute. In some areas where soft soils are removed, it may be difficult to properly compact the first lift or two on the base of the undercut area. If the base is excessively wet, a working mat of compacted crushed stone shall be placed prior to placement and compaction of the fill. 5. GRASSING A. DIKES AND EMBANKMENTS The CONTRACTOR after grading and shaping the dikes and remaining areas as shown on the plans, shall furnish SW-4 labor, tools and equipment to till and seed any and all areas, as outlined hereinbefore under site work. The entire area shall be given one application of agricultural lime at the rate of 2,000 pounds per acre; super phosphate at 500 pounds per acre; a 12-4-8 grade fertilizer at the rate of 600 pounds per acre, all harrowed to a point that it is thoroughly mixed with the soil. The Contractor shall then furnish and sow, Rebel Fescue seed, at 'the rate of 100 pounds per acre mixed with 25 pounds per acre of Bermuda. A suitable cover of straw mulch shall be placed at a rate of 1.5 to 2 tons per acre on the entire area following the sowing operation. The CONTRACTOR shall then wet down the entire area to prevent the straw mulch from blowing away and to assist in earlier germination. In the case of extreme slopes, the straw mulch shall be stabilized by the application of an asphalt or other approved binding material. The Contractor shall guarantee a full stand of grass over the entire area. A stand of grass shall be considered acceptable when cover is at least 95 percent. 6. EROSION AND SEDIMENT CONTROL MEASURERS The erosion and sedimentation control measures shown on the plans and contained in the Contract Documents indicate the approximate locations of those measures on the basis of the existing topography within the area or on the basis of the predetermined need for any specific area. Upon commencement of the operations in those areas where measures are proposed, the ENGINEER may make minor adjustments in location. CONTRACTOR shall note and observe all conditions as outlined in the Erosion and Sedimentation Control Approval Letter. It will be the CONTRACTOR'S responsibility to provide the erosion and sediment control measures as shown on the plans or as otherwise specified in the Contract Documents or as directed by the Engineer. The CONTRACTOR is cautioned that these facilities will be installed as shown on the plans and/or as directed by the ENGINEER during the construction process. Any citations, penalties, or fines issued by the N.C. NCDEH&NR "Stormwater Runoff Disposal" rules and regulations (NCAC 15-21-1-1000) were used as guidelines in making this evaluation. The proposed project is greater than 1 acre In size, has >25% impervious surfaces, drains to Class S.A. or S.C. Waters, and is within 1/2 mile of class S.A. Waters. If a project drains to Class SC or Unclassified Waters, stormwater may be treated by detention ponds or infiltration basins. If the development project is within 1/2 mile of and drains direly to Class SA Waters or their unclassified tributaries, stormwater must be treated by infiltration basins or an equivalent alternative method. The tract has previousy been determined to be geographically located within 1/2 mile of Class S.A. Waters to the west and south and drains to an unclassified freshwater tributary, thus stormwater is to be treated through infiltration basins. This tract has broad sandy ridgetops, that slope (-3-10%) to poorly drained flats and a small channelized drainageway. Principle soil and site requirements for an infiltration system are: —the infiltration system's bottom must be 2 ft or greater from the seasonal high water table; —must be capable of complete draw -down within 5 days; —the soil's hydraulic conductivity must be >0.52 in/hr, —recent fill material is not usable. The enclosed land & soils map shows the various land/soil types found (see map). The following are brief descriptions of these land & soil types for stormwater infiltration usage: The "DOTTED" Areas are well drained to somewhat excessively drained, deep sandy soils. These soils have an estimated seasonal high water static water table +48 to 70 inches from the surface based upon soil wetness indicators. Estimated permeability is <5 - 20 min/in (3-12 Page 2. The better sites for stormwater infiltration system usage are on the higher elevations, with marginal to unsuitable sites being at intermediate to lower elevations. Careful planning and design should be exercised to insure usable soil areas are reserved for stormwater infiltration treatment, and relatively preserved in their natural state.
