Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW8 961004, dated November 14, 1996, for the construction of Technology Court. This permit shall be effective from the date of issuance until November 14, 2006, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an ajudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. No lot owner/developer shall fill in, alter, or pipe any drainage feature (such as swales) shown on the approved plans as part of the stormwater management system without submitting a revision to the permit and receiving approval from the Division. 5. The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area. Once the lot transfer is complete, the built -upon area may not be revised without approval from the permittee, and responsibility for meeting the built -upon area Omit is transferred to the individual property owner. 6. The following items will require a modification to the permit: a. Any revision to the approved plans, regardless of size. - b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area. e. Further subdivision of the project area. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. In addition, the Director may determine that other revisions to the project should require a modification to the permit. 7. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 8. The 5 lots fronting Enterprise Drive, Lots 41, 47, 71, 57 and 70, must direct their runoff drainage away from the approved detention ponds. The ponds are not designed to accept this runoff. The recorded covenants provide Ammons-NorthChase with review authority of site plans. Ammons-NorthChase is required to review the proposed storm drainage for these lots and verify that the drainage is not entering the proposed pond system. ' II. SCIIEDULE OF COMPLIANCE 1. The permittee will comply with the following schedule for construction and maintenance of the stormwater management system: a. The stormwater management system shall be constructed in it's entirety, vegetated and operational for it's intended use prior to the construction of any built -upon surface except roads. b. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 2. The permittee grants permission to DEHNR Staff to enter the property for the purposes of inspecting the project for compliance with the conditions of this permit. 13 State Stormwater Management Systems Permit No. SW8 9610 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in it's entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of side slopes. d. Immediate repair of eroded areas. e. Maintenance of side slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device and catch basins and piping. g. Access to the outlet structure must be available at all times- 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. Prior to the sale of any lot, deed restrictions must be recorded which limit the built -upon area per lot to the amount as shown on the Project Data Sheet, per Part I k2. The recorded statements must follow the form: a. "The maximum built -upon area per lot, in square feet, has been restricted as follows: Lots 42-45, 59-64, 67-69 018,000; 46, 58, 65-66 @36,000; 48-49, 51-53, 55-56, @15,500; 50 & 54 @24,500; inclusive of that portion of the right-of-way between the lot line and the edge of pavement, structures, pavement, walkways of brick, stone, or slate, but not including open wood decking. " b. "The covenants pertaining to stormwater regulations may not be changed or deleted without concurrence of the State." C. "Alteration of the drainage as shown on the approved plan may not take place without the concurrence of the State." d. "Lots within CAMA's Area of Environmental Concern may be subject to a reduction in their allowable built -upon area due to CAMA regulations." e. "Roof drain gutters are required on all homes and must drain into the street." OR f. "Two-thirds of the lot must be graded toward the street." OR g. "Perimeter swales and ditches must pick up the runoff and direct it into the pond." 6. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. k State Stomwater Management Systems Permit Na SWR 961004 Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. 8. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of the recording. The recorded copy must be signed by the permittee, dated, stamped with the deed book number and page, and bear the stamp of the Register of Deeds. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. M. GENERAL CONDITIONS This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request form must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6(a) to 143-215.6(c). The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. Permit issued this the 14th day of November, 1996. Declarant shall mean Ammons Northchase Corporation, together with its successors and assigns. B. Buildinq shall mean and include the main portion of a structure built for permanent use on the property, together with all projections and extensions thereof, including but not limited to garages, outside platforms and docks, carports, canopies, shelters, storage areas and porches. Improvements shall mean and include, without limitation, buildings, outbuildings, roads, driveways, parking areas, fences, retaining walls, screening walls, signs, loading areas, stairs, decks, hedges, windbreaks, plantings, planted trees and shrubs, poles and all other structures or landscaping. ARTICLE III PURPOSES OF DECLARATION The property described in Article I hereof is subjected to the protective covenants and restrictions hereby declared to insure the best use and the most appropriate development and improvements of each parcel or lot hereof; to protect the owners of said parcels or lots against such improper use of surrounding lots as will depreciate the value of their property; to preserve, so far as practicable, the natural beauty of the property, to guard against the erection thereon of poorly designed or proportioned structures, and structures built of improper or unsuitable materials; to obtain harmonious and appealing appearance and function; to insure the highest and best development of the property; to encourage and secure the erection of buildings thereon, with appropriate location thereof on lots; to prevent haphazard and inharmonious improvement of the property; to secure and maintain proper setbacks from streets, and adequate free spaces between structures, and in general to provide adequately for a high type and quality of improvement in this property and thereby to enhance the values of investments made by purchasers of the parcels or lots therein; and specifically to provide a means for creating, maintaining, controlling and preserving the property as a high quality Business/Office/Industrial Park. ARTICLE IV ALTERATION OF LOT LINES Lots may be combined and lot lines altered with approval from Declarant, but no lots may be subdivided in order to create additional lots. Notwithstanding the foregoing, the Declarant or its assigns may combine lots, alter lot lines or create additional lots. soup PAGE 1488 0525 ARTICLE V Easements for installation and maintenance of utilities and drainage facilities are reserved as shown on the recorded plat of the Property and along all front, rear and side lines of each lot or parcel in the Property not to exceed ten (10) feet. within these easements, no improvement shall be permitted which may damage or interfere with the installation and maintenance of utilities and drainage facilities. The easement area of the Property and all improvement in it shall be maintained continuously by Owner except for those improvements for which a public authority or utility company is responsible. ARTICLE VI ANNEXATION OF ADDITIONAL PROPERTY The Property described in Article I hereof is a portion of a larger area of land owned by the Declarant and Declarant may from time to time cause separate and additional declarations and agreements to be filed subjecting other portions of the larger area of land to restrictions similar -to or different from those imposed upon the Property subject to this Declaration. In addition, Declarant may cause additional portions of such larger area of land to be subjected to the terms of this Declaration in the manner specified hereinafter. Only the Property described in Article I and such additional property as shall be specifically subjected to this Declaration shall be subject to this Declaration and neither anything contained in this declaration nor in any recorded or unrecorded plat, map, picture, drawing, brochure or other representation of a scheme of development, shall be construed as subjecting, or requiring Declarant, to subject to this Declaration, any property or land now or hereafter owned by it other than as herein defined. The fact that terms or provisions set forth in separate or additional declarations and agreements relating to the property or lands other than the Property described in Article I may be similar or identical, in whole or in part, to this Declaration shall not be construed to mean that it was the intent or purpose therein to subject any additional property of lands to this Declaration or any terms or provisions thereof. Declarant may, from time to time, in its absolute discretion, annex additional lands to the Property described in Article I and thereby subject the same to this Declaration, by execution and filing for recordation with the Register of Deeds of New Hanover County, North Carolina, an instrument expressly stating an intention so to annex and describing such additional lands to be so annexed. ARTICLE VII DEVELOPMENT PLAN REVIEW The following items shall be submitted to Declarant for review and approval thereof shall be received from Declarant prior to any construction or improvements to the Property: 3 BOUr SAGE 1488 C526 A. Site Engineering Plan for the Property, including all sedimentation and impoundment as required by local authorities. C. Architectural Plans for the Property including the following: (1) Building Plans (2) Elevations (3) Specifications (4) Signs (5) Exterior Lighting _ (6) Dumpster location and screening ARTICLE VIII METHOD OF APPROVAL Whenever required herein, approval shall be requested by Owner by submitting the same in writing to Declarant at Ammons Northchase Corporation, 2832 NorthChase Parkway West, Wilmington, North Carolina 28405, or at such other place as shall be from time to time designated by Declarant. Approval shall not be considered granted unless specifically given in writing by Declarant; however, Declarant shall not unreasonably withhold or delay its approval of plans, specifications, etc., and if the Declarant has not requested additional information or notified the applicant of disapproval with reasons therefor within twenty (20) days after the preliminary information requesting approval of plans is submitted to it, then such plans shall be deemed approved, and construction may commence. Neither Declarant nor its successors or assigns, shall be liable in damages to Owner by reason of mistakes in judgment, negligence, or non-feasance arising out of or in connection with the approval or disapproval or failure to approve any plans. Every person who submits plans to Declarant agrees that by submission thereof, he will not bring any action or suit against Declarant to recover any such damages. BOOr, PACE 1488 0527 Every owner or person who now or hereafter owns or acquires any rights, title or estate in any portion of the property is and shall be conclusively deemed to have consented and agreed to every covenant and restriction contained herein whether or not reference to this Declaration is contained in the instrument by which such owner or person acquired an interest in said property. ARTICLE IX DEVELOPMENT STANDARDS Declarant reserves the right to waive, alter or modify each standard set out, provided waiver is to be in writing and recorded. A. Use Use of the Property and all improvements thereon shall be the building, maintenance and operation of offices, small business facilities and manufacturing facilities. No improvement on the Property shall be used for shopping center and/or retail food sales without the approval of Declarant. Only high quality and environmentally controlled uses will be allowed, i.e., no noxious odors or fumes, no release of wastewater other than domestic strength to the on - site facilities and no use that creates excessive noise as determined by Declarant. - B. Building Materials No metal wall may be used on the front or side exterior elevations of any buildings, with the exception of temporary metal wall sections will be permitted to allow for future expansions. C. Outbuildings Outbuildings, with the exception of construction facilities during actual construction, must comply with all pertinent setback requirements and must be constructed of compatible materials with those utilized in the primary building construction on said lot. D. Setbacks All buildings shall be constructed to have a minimum set- back of fifty (50) feet from any street right-of-way to the face of the building. Notwithstanding the foregoing, lots of less than two hundred fifty (250) feet in depth shall have a minimum setback of thirty (30) feet unless specifically approved in writing by the Declarant. All buildings constructed to have a minimum setback of fifteen (15) feet from any property line (other than a street right-of-way) to the face of the building. 5 e00r. FArof 1 1488 0528 E. Percentage of Parcel Covered In no event shall more than fifty (50) percent of the area of any lot be covered by buildings. F. Parking Areas, Loading Areas and Driveways 1. All parking areas and driveways shall be constructed to have a minimum setback of ten (10) feet from any street right of way. 2. All parking areas and driveways shall be constructed to have a minimum setback of five (5) feet from any property line other than a street right of way. 3. Loading areas shall not encroach into setback areas, and shall be screened so as not to be visible from any street, and to minimize the effect of their appearance from neighboring property. 4. Loading areas shall, if facing on a street or highway, be a minimum of 100 feet back from the right-of-way line of that street or highway and shall be screened so as not to be visible from that street or highway and to minimize the effect of their appearance from neighboring property. G. Parking, Loading and Unloading No damaged vehicles shall be parked or stored in open areas of the Property. Delivery vehicles (trucks, trailers, and/or..vans) shall not be allowed to remain in the parking area located in front of any building for extended periods of time. No onstreet parking shall be allowed by any firm or business. H. Service Screening, Storage Areas Garbage and refuse containers will be concealed and contained within buildings, or shall be concealed by means of a screening wall or material similar to and compatible with that of the building. These elements shall be integral with the concept of the building plan, be designed so as not to attract attention, and shall be located in the most inconspicuous manner possible. Unless specifically approved by Declarant, no materials, supplies or equipment shall be stored on the property except inside a closed building. Exterior air- conditioning units and rooftop mechanical units shall be screened with approved materials. No outside storage or displays shall be allowed on the Property unless specifically approved in writing by Declarant. j soup. - ?AGE 1488 C529 I. Landscaping All property shall be landscaped according to plans approved by Declarant, within ninety (90) days following occupancy or completion of the building whichever first occurs. All shrubs, trees, grass and plantings of every kind shall be kept neatly trimmed, properly cultivated and free of trash and other unsightly material. Appropriate provisions shall be provided by Owner for watering and other maintenance of the grounds including the rights -of -way on which their property abuts. In the event Owner shall fail to comply with these requirements, Declarant shall, after first giving Owner ten (10) days notice in writing, have the right to carry out such work and/or maintenance and the total cost of same, including attorney fees, may be charged to the Owner and collected by proceedings at law, if necessary. J. Lighting All street and site lighting shall be approved by Declarant. Owner will be obligated for monthly light and maintenance bills for any street lights on its land or adjacent street right-of-way prior to the time fo city annexation and the assumption of these charges by the city. K. Advertising All signs for advertising or otherwise must comply with zoning regulations and be approved by Declarant. L. Antennas No mast or tower for an antenna, whether transmitting, receiving, or both, shall be placed on any site or building unless specifically approved by Declarant. In no event shall an antenna have a wooden mast or tower. M. Power and Communication Lines All secondary power- lines and communication lines on any site shall be placed underground and no portion of any line shall be situated so as to be in public view. N. Mailboxes No mailboxes shall be permitted on the Property. O. Storage Tanks No storage tanks, including but not limited to those used for storage of water or propane gas, shall be permitted on the Property. 7 .i BOO. PAGE 1488 0530 P. Mineral Exploration The property shall not be used in any manner to explore for or to use any oil, or other hydrocarbons, minerals of any kind, gravel, earth or any earth substance or other mineral of any kind. Q. Hobbies Hobbies or activities that tend to detract from the aesthetic character of the property and improvements used in connection with such hobbies or activities shall not be permitted in open areas unless carried out or constructed as directed by Declarant. This paragraph is intended to include, but not be limited to, such activities as automotive repair, boat repair and sports equipment placed on the Property. R. Nuisances No rubbish or debris of any kind shall be placed or permitted to accumulate upon any portion of the property and no odors shall be permitted to arise therefrom so as to render any portion of the property unsanitary, unsightly, offensive, or detrimental to any of the property or to the occupants thereof. Without limiting any of the foregoing, no speakers, horns, whistles, bells or other sound devices, except security devices used exclusively for security purposes shall be located, used or placed on the property. OPERATION OF DETENTION POND SYSTEM The detention pond is intended to provide some measure of sediment and nutrient filtration within the vegetation along the pond perimeter as well as promoting infiltration of runoff into the subsurface groundwater. The use of a pond allows a more intensive built -upon area to be developed and is a permitted method for stormwater treatment in compliance with the State of North Carolina Administrative code Section 15 NCAC 2H.1000, Stormwater Runoff Disposal. 3. MAINTENANCE RESPONSIBILITIES Routine maintenance as detailed below is required for the detention pond. To provide for this, the OWNER shall be responsible for all required maintenance. In lieu of performing the direct maintenance, the OWNER may contract this service to an independent maintenance entity; however, all responsibilities for enforcing these restrictive covenants shall reside with the OWNER. 4. The portion of the development west of NC Highway 132 (College Road) is traditionally known as the Park of Commerce due to the commercial nature of the majority of development. Sited outside the the jurisdiction of the City of Wilmington but within New Hanover County zoning, the project has already and will continue to have several reviews at various levels with respect to development. Total site acreage is 24.6 acres which includes two (2) tracts to be used for placement of the stormwater detention facilities. The site will be developed for commercial usage with deed restrictions placed on the maximum built -upon areas for each lot. Roadways are to be conveyed to the NCDOT upon completion. Water and Sewer shall be provided by New Hanover County Water and Sewer District. Stormwater shall be conveyed to two (2) stormwater ponds located on existing tracts east of the lots. The intent of this submittal is to provide design of the storm drainage for the site into the detention facility required by both County and State requirements. Also indicated on the Drawings are the locations of the water and sewer improvements to serve the project site. 2. EXISTING SITE: Site topography in the area of construction is relatively flat with an overall slope of less than one (1) percent. And existing system of ditches currently run along the northern and western property lines which discharge into the Smith Creek watershed which is currently classified C-Sw. All discharge appears to currently discharge into these ditches with ultimate discharge to the south. Due to the existing ditch system, no offsite drainage is capable of entering the proposed collection system. 3. PROPOSED IMPROVEMENTS: Grading and drainage improvements include filling of non -essential ditches, grading and paving of the roadway and installation of water and sewer facilities. Included are the installation of the drainage collection systems and detention ponds. Due to site area constraints, the ponds have been divided into two (2) areas with calculations for each provided. STORM DRAINAGE CALCULATIONS: Because of the need to meet State requirements, the calculations deal with the following areas of concern. These areas of concern include the following: a. Design piping to convey a 10-year storm event b. Storage of the first one (1) inch of runoff from all project areas c. Discharge of first one (1) inch within two (2) to five (5) days d. Design of overflow for designed to handle a 25-year storm event Piping has been sized based on the Rational Method and inputting the design parameters and data into Haestad Method's Stormcad design program. Pond storage was evaluated using the area averaging method of the proposed pond designs. Evaluation of the pond storage -elevation information determined the elevation required to handle the first inch or runoff. State regulations require a forebay to be used at the pipe inlets to the pond. Weirs have been provided within each forebay structure so that drainage does not enter the remaining pond area until the water surface in the forebays are at or above the required design surface elevation. Weirs, or openings above this level have been sized to handle the 25-year storm event. A similar weir has then been placed at the outlet end of the ponds to handle significant storm exceedence levels. Due to the potential for relatively short times of concentration, a Tc of five (5) minutes for all inlets has been used. This storm provided the greatest demand on the drainage system while requiring relatively little storage volume. Storms of this short intensity are not likely to generate sufficient runoff volumes to fill the stormwater ponds. Adding to this is the travel time through the piping and the ponds. For this reason, the pond outlets were sized using the runoff generated from a storm event with a Tc of ten (10) minutes. A detailed piping evaluation of the ten (10) year storm has been provided. In addition, evaluations of the 10-minute storm for the outlets as well as the flow from the 25-year storm for the weirs has been included. 5. EROSION CONTROL CONSIDERATIONS: Land disturbance will be extensive with much of the existing vegetation and topography being altered due to ditch filling and utility installations. The initial step of the work will be aimed at clearing and vegetation removal for the roadway areas as well as filling of ditches not required for the proposed construction.. Subsequent work will be aimed at construction of the detention ponds and utility installations within the roadway and pond areas. These details include but are not limited to the following: a. use of temporary seeding should construction be halted for the specified time limit (see plan) b. use of flared -end sections with rip -rap at the pipe ends c. use of end -of -day piping protection during construction of storm drainage piping d. use of silt fencing is indicated for the environmentally sensitive areas of the project area e. use of construction entrances at each connection to existing developed areas f. use of inlet protection at each inlet g. use of the detention pond as a sediment trap until all areas have been adequately stabilized 6. MAINTENANCE CONSIDERATIONS: During construction, the Contractor shall be required to inspect and repair as needed all erosion control devices after any significant rain event. Any measure found not performing it's intended function, shall be repaired immediately. Upon completion of construction and establishment of permanent ground cover, the Home Owner's Association shall be responsible for maintenance on the project site. Refer to Appendix B for the Storm Water Management Operation and Maintenance Plan for additional requirements during both initial construction and completion. CT 06708 (203) 755-1666 Page 1 of 1 SECTION 13 - ENVIRONMENT PROTECTION: SEDIMENTATION AND EROSION CONTROL AND AIR AND WATER QUALITY PROTECTION TECHNICAL SPECIFICATIONS SECTION 13: ENVIRONMENT PROTECTION: EROSION AND SEDIMENT CONTROL, AND WATER QUALITY PROTECTION T-13.01 GENERAL: The Contractor shall maintain all boundaries free from environmental Federal, State or local regulations. work areas within and outside the project pollution which would be in violation of any T-13.02 EROSION AND SEDIMENT CONTROL: All work shall comply with the regulations of the North Carolina Sedimentation Control Act of 1973. T-13-02.1 DISTURBED AREAS: No disturbed area shall be denuded for more than 30 calendar days unless it is under continuing active construction. T-13.02.2 AREAS UNDER ACTIVE CONSTRUCTION: When the length of time during which an area is under active construction for longer than 15 days, it may be necessary to install silt fences or other temporary sedimentation and erosion control devices to prevent off -site sedimentation damage. All erosion control devices shall be installed and maintained as required by the North Carolina Department of Environment, Health, and Natural Resources. Such measures may consist of berms, dikes, drains, and sediment basins, or use of fiber mats, woven plastic filter cloths, gravel, mulches, bituminous spray, and other erosion control devices or methods. Refer to drawings for minimum requirements for erosion and sediment control devices. T-13.02.3 FERTILIZING AND SEEDING: Refer to drawings T-13.02.4 SILT FENCE: Silt fence shall be used as a permeable barrier that retains sediment on the construction site. Use a synthetic filter fabric which is certified by the manufacturer or supplier conforming to the following requirements: Filtering efficiency - 85% minimum Tensile Strength of 20% maximum elongation 30 lbs/lin in (min) Slurry Flow Rate - 0.3 gal/sq fl/min Installation and maintenance shall be by the manufacturers' recommendations. Materials shall meet the requirements of the North Carolina Department of Transportation. T-13.03.1 PROTECTION OF AIR OUALITY: The air pollution likely to occur due to construction operations shall be minimized by wetting down bare soils during windy periods, requiring the use of properly operating combustion emission control devices on construction vehicles and equipment used by contractors, and by encouraging the shutdown of motorized equipment not actually in T-13-1 use. Trash burning will not be permitted on the construction site. T-13.03.2 PROTECTION OF WATER QUALITY: The Contractor shall observe the rules and regulations of the State of North Carolina and agencies of the United States Government prohibiting the pollution of stream or river waters by the dumping of any refuse, rubbish or debris therein. T-13.03.3 PROTECTION OF SEWERS: The Contractor shall take adequate measures to prevent the impairment of the operation of the existing sewer system and prevent construction materials, pavement, concrete, earth, or other debris from entering a sewer or sewer structure.
