Dear Ms. Homewood,
Please refer to the following responses to the comments on the 401 application, for the referenced
project, provided to Hazen and Sawyer on October 3rd, 2022.
1. Please explain why the permanent maintenance crossing at impact site S1 cannot be in the same
location as the permanent stream stabilization.
• We decided to locate the permanent maintenance crossing at impact site S1 adjacent
to the permanent stream stabilization as a result of several constructability
considerations as follows. During construction, we have designated that the contractor
cross the branch on drag mats to minimize disturbance to the stream. Our intent is for
the contractor to open up the trench to install the proposed pipe, stabilize and restore
the banks at this location to existing conditions, and then utilize drag mats to cross the
stream until it is time to abandon the existing north and south outfalls between the
downstream and upstream tie-in points, as indicated in the construction drawings.
Additionally, restoring the banks to existing conditions at the permanent stream
stabilization will increase the amount of material over the proposed line, which should
improve the long-term viability of the system as it will tend to counteract the natural
erosive tendencies of the stream.
Once the proposed 36" ouffall is operational, the contractor will be responsible for
abandoning, in -place, the north and south outfalls. Part of this abandonment process
will include removing the existing pipe crossing the stream as shown in the picture
below.

As indicated on DWG C2, removal of this pipe will consist of installing plugs on either
side of the pipe, and then removing the length of pipe between the plugs (which includes
the exposed segment through the stream). Installing the plugs and removing the pipe
will require the contractor to bench back the banks. Upon making these improvements,
the contractor will then install the permanent maintenance crossing directly overtop of
the former location of the existing pipe by grading the banks back from the ordinary
water mark at a 4:1 slope. In other words, since this location needed to be disturbed to
remove the existing pipe, we decided to proceed with modifying it to the permanent
maintenance crossing. The Client has requested the permanent maintenance crossing
because the next nearest access point to easement, along NC Hwy 109, is approximately
6,500 LF away along the proposed alignment.
It appears that some portions of the construction corridor will be parallel to, and within 10 feet
of, the top of any streambank (not the OHWM). Construction close to streambanks has
significant potential to create unstable streambanks and contribute to downstream water
quality violations. Please provide a detailed justification for any land clearing disturbances
proposed within 10 feet of the top of bank.
• The following note,
"CONTRACTOR SHALL ONLY CLEAR AND NOT GRUB WITHIN THE EXISTING 10-FT
PERMANENT EASEMENT, AND SHALL CLEAR AND GRUB WITHIN THE PROPOSED 30-FT

3. Some of the impact maps provided clearly show a permanent maintenance corridor, however
other impact maps do not show the permanent maintenance corridor. Please clarify.
The impact maps that do not depict a permanent maintenance corridor associated
with the project is due to the pipe either being located in a currently non forested
area, such as roadside or cow pasture, or an existing maintained corridor associated
with the existing pipe or other utility. The existing non forested areas are anticipated
to continue to be non forested and to be used as the permanent maintenance corridor
for this project.
4. You indicate that permanent stream restoration will be provided by instream riprap, or instream
RECM. The Division does not recommend RECM within the bed of a stream. Please revise your
plans accordingly.
• The following stream crossings have been revised to show in -stream riprap as the
permanent stabilization measure: STA 45+50 (DWG CS); STA 66+55 (DWG C7); STA
91+00 (DWG C10); STA 123+75 (DWG C13); Connection G-STA 4+75 (DWG C24)
The Division regularly receives applications from the City of Winston Salem for stream
stabilization activities where sewer lines have been previously located parallel and adjacent to
large streams and are at risk of failure due to stream migration and erosion. The Division
strongly encourages the City to reconsider the alignment of this sewer line, as it is located
closely adjacent to multiple meander bends within Fiddlers Creek. As the City is aware, streams
migrate over time, especially within meander bends, and stream erosion has been increasing
with additional urbanization and higher intensity precipitation events the area has been
experiencing lately.
• During the preliminary design phase of this project Hazen developed a detailed basis of
design memo, attached to the comments herein as Appendix A. One design element that
we addressed in this study analyzed which side of the stream would be preferable to
install the proposed line; therefore, a significant amount of time was spent in
developing the alignment shown on the drawings. The following factors led to selecting
the proposed alignment, along the north side of the stream:
1) The south outfall could not be paralleled on the uphill side at Connection I
without significant earthwork and easements.
2) The south outfall could not be paralleled on the inside of the meander of
Fiddlers Creek, just south of NC Hwy 109, without significant earthwork and
easements.
3) The south outfall could not be paralleled just north of Willard Rd due to the
geometry of the outfall to miss the embankment of an existing pond adjacent
to Fiddlers Creek.
4) The client requested that this project consolidate the flows from the north and
south outfalls into one line. Therefore, all lines currently feeding into the north

and south outfalls had to be tied in to the proposed line. The interceptors that
need to be tied in along the north side of the creek are larger and convey more
flow than those on the south side of the stream. As such, an alignment on the
north side of the stream resulted smaller -diameter crossings of Fiddlers Creek
to tie in the collectors and interceptors along the south side. in the event of a
failure of any one of these proposed crossings, much less wastewater would
be discharged from these compared to the interceptors along the north side
of the creek.
5) For the future replacement project directly upstream of the proposed project
(refer to Appendix A) it would be very challenging to parallel the existing
south outfall and make the 500 LF trenchless installation beneath US 1-741 US
Hwy 311.
Both WSFCUC and Hazen recognize that there are select areas where the adjacent banks
along Fiddlers Creek demonstrate signs of instability. Tim Schueler, Hazen's stream
restoration group leader, met with Brad Bennett (Hazen) and Derek Stroud (of WSFCUC)
on -site on 5110122 to review the following areas: 42+00-45+00 (DWG C5); 60+00-61+00
(DWG C7); 74+25-75+75 (DWG C8). Hazen offered to furnish bank -stabilization designs
along these areas as part of this project, but WSFCUC elected not to include this effort
as part of this project in the interest of cost and schedule. Additionally, Hazen initiated
contact with the City of Winston-Salem's Stormwater Department (per WSFCUC's
request) to see if there were opportunities to partner with it to restore the stream banks
through the City's stormwater CIP. The Stormwater Department indicated that Fiddlers
Creek was not a high -priority area and did not wish to pursue bank stabilization as part
of this project, at this time.
The existing north outfall has been in service since 1935, and in that time Fiddlers Creek
has not changed to a sufficient degree so as to compromise the function of the existing
north outfall. Additionally, the proposed sewer will be installed approximately 20 ft
uphill from the existing sewer, and will be as deep if not deeper than the thalweg of the
stream along much of the alignment. Therefore, despite accelerated scour and down -
cutting from increasing urbanization, the sewer line has been designed with the intent
of keeping the pipe out of the destructive influence of Fiddlers Creek over the lifetime of
the project.
