No 8. PROJECT SUMMARY. The applicant is requesting a Major Modification of CAMA Permit #126 -09 to reconfigure an approved marina by reducing the size of the piers and platforms, converting the structure from a stationary structure to a floating structure, adding "No Wake" buoys, and relocating the proposed structure landward of the 75' AEC a- Yeopim Partners, LLC Field Investigation Report Page 2 Project Setting Farms at Riversound, previously Riversound Subdivision Phase II is located off of Drummond's Point Road (SR 1100), adjacent to Yeopim River and Middleton Creek. Phase II of the tract is a 668.8 acre tract originally approved for a 299 lot subdivision serviced by a package treatment plant The tract has approximately 3,600 linear feet of shoreline fronting on Middleton Creek and the Yeopim River. The development included a stationary 130 slip docking facility, a Dock Masters Station with bathrooms, a portable pump -out w/ building, and a 32 space parking lot. Development on the property has been limited to road construction to date A majority of the property is wooded with the upland portions having been a managed pine plantation prior to being purchased by the Waterfront Group, LLC (and subsequently Yeopim Partners, LLC). Pines and hardwoods can be found in varying growth stages with typical undergrowth including, but not limited to, cat brier (Smilax rotundifolia), poison ivy (Toxicodendron radicans) and caroling jasmine (Gelsemium sempervirens). A section of the marina lot adjacent to the water was delineated as 404 wetlands by Tracy Wheeler with the US Army Corps of Engineers and is classified as a bottomland hardwood swamp. Average elevation of the marina property is approximately 4' above normal water level along the high ground portion of the property and 1' above sea level within the wetland area The flood designation for most of the property is AE, and the entire tract is located within the 100 year floodplain Soils on the marina site are as Wahee fine sandy loam, nearly level and somewhat poorly drained, that has a loamy surface and a loamy or clayey subsoil, and Dogue fine sandy loam, nearly level to gently sloping, that is moderately well drained The shoreline gently slopes to the water along the wetlands. Water depths on the Yeopim River within the project area are -1.3' to -6' at an average distance of 380' waterward of NWL. No submerged aquatic vegetation found within the project area. The property is located along Estuarine Waters of the Yeopim River and has a 75' landward Area of Environmental Concern. The nearest major water body to the proposed marina is the Albemarle Sound, which is 4 miles by water. There is one marina operating in the area, approximately 4 2 miles from the Yeopim Partners marina site, on Yeopim Creek at Albemarle Plantation Albemarle Plantation's marina is a 158 slip docking facility exclusively for the residents of the Plantation Fuel and pump -out facilities are available to the public for a fee Land uses bordering the subject property are residential To the east is a development residential lot and to the west, across Middleton Creek is Phase I of Riversound, which is currently undeveloped due to the failure of the developer to complete the waste treatment plant designed to service the subdivision Development Proposal The original permit authorized the development of Riversound Phase ll, a 299 lot subdivision, with a 130 slip marina with three 8' wide piers and three "T" platforms, a Dock Masters Station with bathrooms, portable pump - out, and a parking lot. Use of the proposed marina was for the property owners in Phase I and Phase II of Riversound The current owner(s) Yeopim Partners, LLC, have subdivided and platted the property in Phase II, reducing the number of lots down to 56 and renamed Phase 11 from Riversound to Farms at Riversound. Yeopim Partners, LLC Field Investigation Report Page 3 The permittee would like the following changes to the marina: 1) reduce the width of the piers and platforms from 8' to 6 25', 2) make the docking facility a floating structure not stationary, 3) install two "No Wake" buoys, 4) reconfigure the parking lot, 5) reduce the width of the elevated access over 404 wetlands, and, 6) change the receiving facility for the marina waste from a package treatment plant to a septic system. According to the application the marina has been designed to handle boats up to 30' in length. "No Wake" buoys are proposed approximately 200' from the northwest and southeast corners of the marina. A portable pump -out facility is proposed; however, the prior request included pumping the effluent to a waste treatment system. The current request will involve pumping the effluent into an on -site septic system, subject to approval As currently proposed, the marina will be open to the general public. The prior request (and approval) was for a private residential marina for property owners in Riversound Subdivision The docking facility and pump -out will be available to nonresident boaters, Yeopim Partners, LLC Field Investigation Report Page 3 Anticipated Impacts From the Requested Modification 1) The modification will result in a 15.5% reduction in open water shading or 2,252sf 2) The reduced gangway from an 8' wide walkway to a 4' wide gangway will result in a 50% reduction in wetland shading or 120sf. 3) Area devoted to the marina in Public Trust Waters and Estuarine Waters will be reduced by approximately 10 3% or 12,626sf, Submitted by:_Lynn W. Mathis Date: December 15, 2014 Major Modification Request for CAMA Permit #126-09 Riversound Subdivision — Farms at Riversound Narrative and Calculations: The proposed modifications include the reconfiguration of the next phase of the Riversound subdivision from 299 to 56 and redesign of the parking area This represents an approximately 75% reduction in the number of homes Of the 56 lots, 10 will be waterfront, representing a 50% reduction relative to the previously permitted site plans, calling for more than 20 such lots. In connection with these reductions, Yeopim Partners are making very minor changes to the prior, permitted site plans. Enclosed are copies of the revised drawings, depicting these minor modifications, which essentially consist of going to a floating dock system, with T -heads being reduced from 80 feet to slightly over 61 feet; reducing dock widths to 6'3 ", and as a result of the floating dock system eliminating approximately 275 support pilings The reductions will reduce the total square feet of structures in the Public Trust Waters by 15% (2,240 sf) as well as reducing the overall footprint of the marina in the Public Trust Waters by 10% (12,626 sf). The wastewater facilities at the marina and Farms at Riversound lots will no longer connect to the treatment facility located in Phase I of the Riversound Subdivision and have been changed to individual conventional septic systems As a result of this change the marina will use a portable pumpout system that will be disposed of at the marinas bathroom facility.
