The information received by this Office on May 16, 2000 has been reviewed. This project is referenced by
the Raleigh Regional Office as NBRRO 00-145. The features represented on the Wake County Soils and
the USGS Wake Forest Quad maps were evaluated to ascertain their subjectivity to the Neuse Buffer Rule.
There are two features represented on both of the maps that are at least intermittent creeks and as such are
subject to protection under the Neuse River Basin: Nutrient Sensitive Waters Management Strategy;
Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC
0233).
The appropriate buffer is delineated on Richland Creek and the unnamed tributary. NCAC .0233 (6) states:"
Non -electric utilities crossings, if perpendicular through the buffer and impacts other than perpendicular
crossing if in Zone 2 only, are an allowed activities." NCAC .0233 (7) further defines allowable as "Uses
designated as allowable may proceed within the riparian buffer provided there are no practical alternatives
to the requested use. These uses require written authorization from the Division or the delegated local
authority." This Office is aware that a PreConstruction Notification is being processed by the Central Office
for the buffer impacts associated with the sewer crossings and the placement of the collection system in Zone
2 of the buffer.
