We issue this permit pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007, or as subsequently amended. Changes to Your Previous Permit. The Division understands that you have made no significant alterations to your facilities since last renewal. We have therefore made minimal updates to your facility map and treatment -component description. We have added parameter codes to the effluent - monitoring page for your convenience [see Supplement to Cover Sheet and Section A. (1.)]. Considering that you have no need to disinfect your effluent, we have deleted Total Residual Chlorine (TRC): We have also deleted Naphthalene monitoring at your request based on your analyses indicating "not detected" over this past permit cycle (database n = 48). Concerning BTEX. Please note that we may not comply with your request to delete monitoring for Benzene, Toluene, Ethylbenzene, and Xylene (BTEX) because these databases are insufficient in size to support such action (n = 7). The Division requires a minimum of 12 sample events before running a defensible Reasonable Potential Analysis (RPA). However we have added a footnote providing you the option to petition the Division for future data review [see Section A. (1.), footnote 3]. Finally, we are concerned with discrepancies in your reported units -of -measure with regard to BTEX (mg/L vs. µg/L). Please be advised that your permit requires you to employ the most sensitive approved test method practically and technologically available (see permit Boiler Plate, Sect D. Part 4, ¶ 3) considering a given parameter's instream water -quality standard. For example, Benzene requires all testing to a practical quantitation level (PQL) of 1 µg/L. Issuance of NPDES Permit • NC0086665 If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable, you have the right to an adjudicatory hearing, upon written request submitted within thirty (30) days after receiving this letter. Your request must take the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes, and you must file it with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this permit shall be final and binding. This permit is not transferable except after notifying the Division of Water Quality. The Division may require permit modification, or revocation and re -issuance. ACUTE TOXICITY MONITORING (ANNUAL) The Permittee shall conduct annual toxicity tests using protocols defined as definitive in EPA Document EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24-hour static test. Effluent samples for self -monitoring purposes must be obtained below all waste treatment. The Permittee '11 conduct one test annually, with the annual period beginning in January of the calendar year of the e ' - ctive date of the permit. The annual test requirement must be performed and reported by June 30. If no , 'scharge occurs by June 30, notification will be made to the Division by this date. However, the databases for these parameters contain only seven (7) samples each, and are judged insufficient to run a defensible RPA. Moreover, a significant percentage of the data submitted were reported in mg/L instead of µg/L (see attached), a test -sensitivity inappropriate to the relative stream standard for each parameter. This facility discharges under zero -flow receiving -stream conditions allowing no credit for dilution in the environment. Proposed Renewal - Changes from Previous Permit — Because this facility does not generate domestic waste, and because it has no reason to disinfect its effluent, DWQ will remove TRC monitoring and limit from this permit for renewal. We have also deleted Naphthalene monitoring at the Permittee's request based on analyses indicating "not detected" over this past permit cycle (database n = 48). Toxicity — The Permittee passed all quarterly Whole Effluent Toxicity (WET) tests since Jan2006 (see attached). Describe the treatment system List all installed waste treatment components with capacities, describe the processes that generate wastewaters. The wastewater system is primarily for the treatment of storm water, process water, system blow downs, wash downs, air conditioning condensate and other discharges associated with the operation of the gas turbines. The treatment system is designed to remove oil/ fuel from the wastewater. The treatment system consists of an oil water separator (OWS) with a coalescing filter that functions as a polishing filter. Wastewater is collected in the OWS sump, passes through the OWS and then is pumped through the polishing filter before discharge to the 001 outfall. The OWS and coalescing filter have a capacity of 11,600 gallons. The discharges are primarily influenced by precipitation and plant operations, which can vary greatly seasonally. Design, average, and maximum instantaneous discharge flow rates from the OWS and 001 outfall range between 100 and 200 gpm respectively. Discharge duration varies from 30 - 60 minutes. The oil and solids collected by the OWS are pumped out by a contractor and taken off site for recycling and disposal as needed.
