It was determined that the feature represented on the USGS and Wake County Soils maps is a creek and as such is subject to the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance of Existing Riparian Areas, Administrative Code T15A:02B.0233 (NCAC 0233). The feature becomes subject to protection below the road crossing and any new activities at that point or below, will require a fifty foot buffer. Please note, depending on the linear feet or acreage involved in this project, there may be jurisdictional wetlands or waters that may require concurrence with the Corps of Engineers. This letter only addresses the applicability of the Neuse Buffer Rules. For information relative to the Wetlands 401/404 issues, please contact Mr. John Dorney at 919- 733 -1786. Based on our phone conversation yesterday, I've enclosed the maps she requested. The site is Midway Baptist Church, located about one mile past Swift Creek on 401 North. We are requesting your evaluation to determine if a channel on the north property line, beginning at Hwy 401 and extending to an existing driveway culvert pipe, is considered jurisdictional under the Neuse Rive Buffer rules. The approximate length of channel in question is about 500 feet extending downstream from Hwy 401. I believe the channel begins at Hwy 401, based upon the enclosed USGS Map (Lake Wheeler), which does not indicate a blue line stream. Last week we received a notice from Wake County Planning Department that we must come up with a plan to address this driveway crossing before August 26, 2002 or a fine may be issued. Apparently, the church had a driveway permit from NCDOT when they installed the driveway several years ago, but they did not get a land use permit from Wake County. I hope you can see from the above that anything you can do to expedite this review would certainly help. I believe your evaluation time should be minimal and I would like to meet you on site to answer any questions.
