Division personnel have reviewed and approved your application. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 2004, and as subsequently amended. A Total Residual Chlorine (TRC) limit has been added to this permit. Because you may need time to make modifications to your plant in order to comply with this new condition, the TRC limit will not take effect until April 1, 2008. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. WASTEWATER MANAGEMENT PLAN No later than April 1, 2007, the permittee shall submit to the Division a wastewater management plan. The plan shall include, at a minimum, the following elements: • Facilities assessment. Describe deficiencies and operational difficulties in the existing. collection and treatment systems that hinder performance or permit compliance. Identify potential improvements to correct those deficiencies. At a minimum, evaluate the following considerations: • inflow and infiltration, • diversion of wasteloads during peak flows, • equipment repairs and preventative maintenance, • removal of accumulated solids, wastes, other debris • Optimization plan. Develop a plan for optimization, rehabilitation, expansion and/or replacement of the collection and treatment systems to achieve optimum performance. Identify specific measures and key tasks, including those in the above facilities assessment, and provide an estimated schedule for completion of each. • Biosolids management plan. Develop an operations plan to be used (and describe the procedures currently used) for managing septage / biomass in the treatment system, including associated solids wasting and disposal, to promote optimum treatment system performance. Identify operating parameters to be used and target values or ranges of values where appropriate. • Communications plan. Describe a plan for informing utility customers of their potential impacts on treatment system performance and appropriate practices for minimizing those impacts, including a schedule for implementation of the plan. At a minimum, include the following elements: • oil and grease contributions to the collection and treatment system, • introductory material for new tenants, describing acceptable waste disposal practices • common practices that adversely affect the collection/treatment system • notification procedures in case of emergencies. Director Division of Water Quality 6 April 2006 10 Dear Mr. Gesel: The Environmental Management Commission adopted. 15A NCAC 2H .0223 "Demonstration of Future Wastewater Treatment Capacities" to ensure that wastewater treatment systems do not exceed their hydraulic treatment capacities. This Rule specifies, in part, that "prior to exceeding 80 percent of the wastewater treatment systems permitted hydraulic capacity, (based on the average flow of any calendar year), the permittee must submit an approvable engineering evaluation of their future wastewater treatment needs. This evaluation must outline specific plans for meeting future wastewater treatment needs by either expansion of the existing system, elimination or reduction of extraneous flows, or water conservation and must include the source(s) of funding for the improvements." A review of your self -monitoring reports has indicated that the subject facility exceeded the 80% value for calendar year 2005. The average flow calculated for this period was 0.0596 MGD, and represented 85.14 % of the current treatment capacity. In order to remain in compliance with the Rule, you must submit an approvable engineering evaluation of future wastewater treatment needs. This evaluation must outline specific plans for system expansion and include the sources of funding for the expansion. If future expansion is not proposed, a detailed justification must be made based on past growth records and future growth projections and, as appropriate, shall include conservation plans or other specific measures to achieve waste flow reductions. They would not pay the lab thus the lab would not release the results. I have proceeded to assess penalties for Autum Forest and Woodlake for missing DMR data and the total for all the missing data is $28,174. Paying the lab would have been cheaper! We are working with the Betsy Jeff Penn 4H camp. They have months that no discharge occurrs and they failed to turn in DMRs when there was no flow. We asked them to provide water use information to show the camp was down and then we may let them slide. They have been instructed (again) to submit DMRs every month and if no flow, just indicate so on the DMR.
