Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
This final permit includes no major changes from the draft permit sent to you on August 13, 2008:
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this
letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of Water Quality or permits required by the Division of Land
Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be

In compliance with the provision of North Carolina General Statute 143-215.1,

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby revoked. As
of this permit issuance, any previously issued permit bearing this number is no longer effective. Therefore, the
exclusive authority to operate and discharge from this facility arises under the permit conditions, requirements,
terms, and provisions included herein.
Chemical Specialties, Inc. is hereby authorized to:
1. Continue to operate an existing wastewater treatment system consisting of the
following components:
➢ Lime slurry tank,
➢ Solids mixing tank
➢ Three (3) reaction tanks for pH adjustment,
➢ Two acre unlined storage lagoon,
➢ Instrumented flow measurement, and
➢ 1/2 acre lined storage lagoon
The facility is located at 5910 Pharr Mill Road, Harrisburg, in Cabarrus County.
2. Discharge from said treatment works at the location specified on the attached map
into the Rocky River which is classified C waters in the Yadkin -Pee Dee River Basin.

A. (1) EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
During the period beginning on the effective date of the permit and lasting until expiration, the Permittee is
authorized to discharge from outfall 001. Such discharges shall be limited and monitored by the Permittee as

There shall be no discharge of floating solids or foam visible in other than trace amounts.
A. (2) LAGOON INFLUENT MONITORING REQUIREMENTS
Monthly monitoring for the following parameters shall be conducted in the lagoon influent conducted from
sampling prior to entry into the lagoon:
pH Total Dissolved Solids Chloride Nitrate Calcium Magnesium Manganese Zinc
Monitoring and analyses shall be performed using DWQ-approved methods. The monitoring should be
conducted for 36 months. Analytical results should be reported to DWQ.
The results of the sampling and analysis shall be sent to the Aquifer Protection Section, 1636 Mail Service
Center, Raleigh, NC 27699-1636 on Form GW-59 [Compliance Monitoring Report Form] within 60 days of each
sampling event.

A. (3) CHRONIC TOXICITY PASS./FAIL PERMIT LIMIT (QUARTERLY)
The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in the "North
Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised November 1995, or subsequent versions.
The effluent concentration at which there may be no observable inhibition of reproduction or significant
mortality is 0.96% (defined as treatment two in the procedure document). The permit holder shall perform
quarterly monitoring using this procedure to establish compliance with the permit condition. The tests will be
performed during the months of January, April, July and October. Effluent sampling for this testing shall be
performed at the NPDES permitted final effluent discharge below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B.

Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the
effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste
stream.
. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required,
the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating
the facility name, permit number, pipe number, county, and the month/year of the report with the notation of
"No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences
Branch at the address cited above.
Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will
begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will
revert to quarterly in the months specified above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly
monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test
requirement will revert to quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of
Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to
include alternate monitoring requirements or limits.
If the Permittee monitors any pollutant more frequently then required by this permit, the results of such
monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT Forms
submitted.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an
invalid test and will require immediate follow-up testing to be completed no later than the last day of the month
following the month of the initial monitoring.

A. (4) GROUNDWATER MONITORING REQUIREMENTS .
Monitoring wells 1, 4, 5, and 6 shall be sampled semi-annually in conjunction with semi-annual RCRA post
closure permit sampling for the following parameters:
NO3 Sulfate
Calcium Chromium
Magnesium Zinc
Iron Arsenic
Manganese Total Dissolved Solids
pH Water Levels
Chloride Specific Conductance
The measurement of water levels must be made prior to sampling for the remaining parameters. The depth to
water in each well shall be measured from the surveyed point on the top of the casing.
Separate sampling is not required for those parameters included in the RCRA post closure permit groundwater
monitoring requirements and the results of the RCRA permit sampling may be submitted in fulfillment of this
permit requirement for those parameters. Analysis for parameters contained herein but not included in the
RCRA permit should be conducted simultaneously with the RCRA mandated analysis and all results should be
submitted simultaneously.
The results of the sampling and analysis shall be sent to the Aquifer Protection Section, 1636 Mail Service
Center, Raleigh, NC 27699-1636 on Form GW-59 [Compliance Monitoring Report Form] within 60 days of each
sampling event.
Any additional groundwater quality monitoring, as deemed necessary by the Division, shall be provided.
The COMPLIANCE BOUNDARY for the disposal system is specified by regulations in 15A NCAC 2L,
Groundwater Classifications and Standards. The Compliance Boundary for the disposal system constructed
prior to December 31, 1983 is established at either (1) 500 feet from the waste disposal area, or (2) at the
property boundary, whichever is closest to the waste disposal area. An exceedance of Groundwater Quality
Standards at or beyond the Compliance Boundary is subject to immediate remedial action in addition to the
penalty provisions applicable under General Statute 143-215.6A (a) (1).
In accordance with 15A NCAC 2L, a REVIEW BOUNDARY is established around the disposal systems midway
between the Compliance Boundary and the perimeter of the waste disposal area. Any exceedance of standards
at the Review Boundary shall require remedial action on the part of the Permittee.

1.0 Proposed Changes Incorporated into Permit Renewal
• Due to the groundwater contamination down gradient from the lagoon, an additional
monitoring requirements have been added to establish potential connection between existing
contamination and lagoon seepage (See Special Condition A (4).).
2.0 Summary
Chemical Specialties has applied for renewal of the NPDES permit for their Cabarrus
County manufacturing facility. Although 40 CFR 415 applies to the manufacture of inorganic
chemicals, the subparts do not adequately characterize the processes used by Chemical
Specialties.

* Ammonium Chloride is not produced in accordance with requirements of 415 X for coverage.
** Copper Nitrate is not currently produced, however the facility wishes to maintain the
capability to produce it in the future. As such, no allocation will be granted under subpart 415 AJ
at this time.
*** Zinc Chloride is the only chemical produced that is covered by the 415 language. 40 CFR 415
BO provides allocations for TSS, zinc, arsenic, lead and pH. However, many other species of zinc
and arsenic are produced on -site making limit determination complicated at best. To this end,
existing limits will be maintained for these two species. For consistency, the zinc chloride -based
lead limit will also be maintained based on the calculation in the previous permit.
Limits for all other metals will remain unchanged. Their bases have roots in a development
document, however exact values could not be duplicated.
Pesticide production wastewaters are not discharged. They are contained in compliance with 40
CFR 415 455.
Mold Guard, another product considered by the Division as a pesticide, is currently being phased
out of production.
3.0' Compliance Summary
DMR Data Review and RPA Analysis
DMR data for this facility is difficult to interpret based on the fact there were only three months
of discharge during the January 2002 - December 2004 data review period. Monthly average
values for the months reporting a discharge are reported in Table 1. Although values for many
parameters were below the detection level, there is not enough data to make a decision to change
or remove any permit requirements.

WET Test Results
The facility is required to perform a chronic toxicity test at 0.96% effluent. From January 2000
through December 2004 there was only one month in which the facility was both discharging and
required to perform a toxicity test. This test was performed in May 2003 and the facility passed.

Thanks for speaking with me this morning about the groundwater concerns at this
permitted facility. I understand that this permit is currently under review for
renewal. I have attached a spreadsheet that should illustrate the degree of
groundwater impact downgradient of the 2-acre unlined lagoon. This office recommends
that groundwater monitoring continue on a semi-annual basis and that concurrent with
those sampling events, that samples of the wastewater be collected from within the
lagoon or upon its entering the lagoon. Those samples should be analyzed for pH,
Total Dissolved Solids, Chloride, Nitrate, Calcium, Magnesium, Manganese and Zinc
using DWQ approved methods.

Chemical Specialties (CSI) is on the right (west) side of SR 1158.

a hazardous waste site.
PART IV - EVALUATION AND RECOMMENDATIONS
Chemical Specialties, Inc., is requesting renewal of its NPDES Permit for the discharge
of treated wastewater.
This facility obtained an inactive status for this facility and did not discharge since 2002.
However, this facility is still producing wastewater that is being discharged to the two acres
lagoon. According to the permittee, the wastewater is being evaporated and therefore no
discharge had been recorded since 2002. It should be noted that this site is a hazardous waste site
and there are couples of monitoring wells near the downstream slope of the pond. Rob McDaniel
(Tel # 919-508-8553) with the Division of Hazardous Waste is familiar with this site and he is
handling the hazardous waste permit for this facility. Also, the data from the monitoring wells
required by this permit have elevated concentration for Dissolved Solids, Chloride, Nitrate,
Calcium and Magnesium. We suspect that the unlined pond is seeping to the groundwater.
Pending review and approval by the Western NPDES Program Unit, It is recommended
that Chemical Specialties, Inc., apply for a non -discharge permit.

Dr. - I spoke with Samar about this one last week (it is assigned to you - Yadkin). It is more
complicated than we have thought in the past. He believes there is a problem with the lagoon and
that is why it isn't discharging (maybe infiltration as there have been some hits to GW
monitoring).
Anyway - let's keep in close touch with MRO and APS on this one prior to submitting for public
notice. We'll have to determine what direction we want to go in with re. to the lagoon issue.
FYI - I was afraid I may forget to pass this along. I'll probably copy for the file and his staff report
is coming soon with the same info.

Sludge generated during the wastewater treatment process at the Site is allowed to settle
in the wastewater treatment holding lagoon #5 before the clear liquid is pumped through
the measuring and sampling weir to the river.
If it becomes necessary in the future to remove sludge from the #5 lagoon, it will be
properly profiled and sent to a secure industrial waste facility.
