Division personnel have reviewed and approved your application for renewal of the subject
permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9,1994 (or
as subsequently amended).
This final permit the following changes from the draft you were sent on March 16, 2005:
➢ Based on your comments, groundwater reporting forms will be due within 60 days of each
sampling event, rather than 30 days.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such
demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division
may require modification or revocation and reissuance of the permit. This permit does not affect the
legal requirements to obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, the Coastal Area Management Act or any other
Federal or Local governmental permit that may be required.

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby revoked. As of this
permit issuance, any previously issued permit bearing this number is no longer effective. Therefore, the exclusive
authority to operate and discharge from this facility arises under the permit conditions, requirements, terms, and

the Rocky River which is classified C waters in the Yadkin -Pee Dee River Basin.

SUPPLEMENT TO EFFLUENT LIMITATIONS
AND MONITORING REQUIREMENTS
SPECIAL CONDITIONS
A (2). CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QUARTERLY)
The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in the "North
Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised November 1995, or subsequent
versions.
The effluent concentration at which there may be no observable inhibition of reproduction or significant
mortality is 0.96% (defined as treatment two in the procedure document). The permit holder shall perform
quarterly monitoring using this procedure to establish compliance with the permit condition. The tests will
be performed during the months of January, April, July and October. Effluent sampling for this testing
shall be performed at the NPDES permitted final effluent discharge below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B.

Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of
the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the
waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test
form indicating the facility name, permit number, pipe number, county, and the month/year of the report
with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the
Environmental Sciences Branch at the address cited above.
Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring
will begin immediately until such time that a single test is passed. Upon passing, this monthly test
requirement will revert to quarterly in the months specified above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly
monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly
test requirement will revert to quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division
of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and
modified to include alternate monitoring requirements or limits.

A (3). Groundwater Monitoring Requirements
Monitoring wells 1, 4, 5, and 6 shall be sampled semi-annually in conjunction with semi-annual RCRA post
closure permit sampling for the following parameters:

Iron Arsenic
Manganese Total Dissolved Solids
pH Water Levels
Chloride Specific Conductance
The measurement of water levels must be made prior to sampling for the remaining parameters. The depth
to water in each well shall be measured from the surveyed point on the top of the casing.
Separate sampling is not required for those parameters included in the RCRA post closure permit
groundwater monitoring requirements and the results of the RCRA permit sampling may be submitted in
fulfillment of this permit requirement for those parameters. Analysis for parameters contained herein but
not included in the RCRA permit should be conducted simultaneously with the RCRA mandated analysis
and all results should be submitted simultaneously.
The results of the sampling and analysis shall be sent to the Aquifer Protection Section, 1636 Mail Service
Center, Raleigh, NC 27699-1636 on Form GW-59 [Compliance Monitoring Report Form] within 60 days of
each sampling event.
Any additional groundwater quality monitoring, as deemed necessary by the Division, shall be provided.
The COMPLIANCE BOUNDARY for the disposal system is specified by regulations in 15A NCAC 2L,
Groundwater Classifications and Standards. The Compliance Boundary for the disposal system
constructed prior to December 31, 1983 is established at either (1) 500 feet from the waste disposal area, or
(2) at the property boundary, whichever is closest to the waste disposal area. An exceedance of
Groundwater Quality Standards at or beyond the Compliance Boundary is subject to immediate remedial
action in addition to the penalty provisions applicable under General Statute 143-215.6A (a) (1).
In accordance with 15A NCAC 2L, a REVIEW BOUNDARY is established around the disposal systems
midway between the Compliance Boundary and the perimeter of the waste disposal area. Any exceedance
of standards at the Review Boundary shall require remedial action on the part of the Permittee.

2.0 Summary
Chemical Specialties has applied for renewal of the NPDES permit for their Cabarrus
County manufacturing facility. Although 40 CFR 415 applies to the manufacture of inorganic
chemicals, the subparts do not adequately characterize the processes used by Chemical
Specialties.

* Ammonium Chloride is not produced in accordance with requirements of 415 X for coverage.
** Copper Nitrate is not currently produced, however the facility wishes to maintain the
capability to produce it in the future. As such, no allocation will be granted under subpart 415 AJ
at this time.
*** Zinc Chloride is the only chemical produced that is covered by the 415 language. 40 CFR 415
BO provides allocations for TSS, zinc, arsenic, lead and pH. However, many other species of zinc
and arsenic are produced on -site making limit determination complicated at best. To this end,
existing limits will be maintained for these two species. For consistency, the zinc chloride -based
lead limit will also be maintained based on the calculation in the previous permit.
Limits for all other metals will remain unchanged. Their bases have roots in a development
document, however exact values could not be duplicated.
Pesticide production wastewaters are not discharged. They are contained in compliance with 40
CFR 415 455.
Mold Guard, another product considered by the Division as a pesticide, is currently being phased
out of production.
3.0 Compliance Summary
DMR Data Review and RPA Analysis
DMR data for this facility is difficult to interpret based on the fact there were only three months
of discharge during the January 2002 — December 2004 data review period. Monthly average
values for the months reporting a discharge are reported in Table 1. Although values for many
parameters were below the detection level, there is not enough data to make a decision to change
or remove any permit requirements.

WET Test Results
The facility is required to perform a chronic toxicity test at 0.96% effluent. From January 2000
through December 2004 there was only one month in which the facility was both discharging and
required to perform a toxicity test. This test was performed in May 2003 and the facility passed.
Correspondence File Review/Compliance History
This facility had one monthly average flow limit violation in June, 2003. The permit limit is 0.025
MGD and the calculated value was 0.037 MGD.

answering +ry quesiiuris. The purpose of This iei er is to provide NCDvJQ with comments
on the draft permit.
In the Special Conditions Section, Item A.3. Groundwater Monitoring Requirements,
fourth paragraph, the permit requests that groundwater results be submitted to the
Division within 30 days of each sampling event. CSI would like to request that this time
frame be extended to 60 days. The purpose of the extension is to allow ample time for
sample analysis, compilation by consultants, review by CSI and then submission to the
Division.
Also, in Part IV under the header the work Municipal is misspelled.
As you explained in our phone conversation the Fact Sheet is not actually a part of the
permit. Please revise the name in the fact sheet to reflect Chemical Specialties, Inc.

Apparently these folks talked with you about a permit modification last year. They finally got a
copy of the modified page in Janaury 2003 but not all the wording in Condition A(3) is
consistent with the change in sampling. Please send a request to the appropriate NPDES
individual to have it corrected as follows:
1. The first sentence should read: ...semi-annual RCRA post closure permit sampling
2. Paragraph four should provide the current mailing address for the Groundwater Section
and should specify that submission of GW-59s should be within 30 days of each
sampling event.

The Division has reviewed your request to reduce the well monitoring sampling to semi-annually. for the subject
permit. The Division hasapproved this request.
Please find enclosed the Llrevised permit page. The revised page or pages should be inserted into your permit.
The old page may then Pe discarded. All other terms and conditions contained in the original permit remain
unchanged and in full effect. This permit modification is issued under the requirement of North Carolina General
Statutes 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental
Protection Agency.
If any parts, measurement frequencies or sampling requirements contained in this .permit modification are
unacceptable to you, you;: have the right to an adjudicatory hearing upon written request within thirty (30) days
following receipt of this letter. This request must be a written petition conforming to Chapter 1506 of the North
Carolina General Statutes, filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh,
North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.

j SUPPLEMENT TO EFFLUENT LIMITATIONS
AND MONITORING REQUIREMENTS
SPECIAL CONDITIONS
A (3). Groundwater Monitoring Requirements
Monitoring wells 1, 44 5, and 6 shall be sampled semi-annually in conjunction with quarterly RCRA post closure permit
sampling) for the following parameters:
NO3 ; Sulfate
Calcium Chromium
Magnesium Zinc
Iron I Arsenic
Manganese ! Total Dissolved Solids
pH Water Levels
Chloride Specific Conductance
The measurement of water levels must be made prior to sampling for the remaining parameters. The depth to water in each
well shall be measured from the surveyed point on the top of the casing.
Separate sampling is not required for those parameters included in the RCRA post closure permit groundwater monitoring
requirements and the results of the RCRA permit sampling may be submitted in fulfillment of this permit requirement for
those parameters. Analysis for parameters contained herein but not included in the RCRA permit should be conducted
simultaneously with the !RCRA mandated analysis and all results should be submitted simultaneously.
The results of the sampling and analysis shall be sent to the Groundwater Section, Permits and Compliance Unit, P.O. Box
29535, Raleigh, NC 27626-0535 on Form GW-59 [Compliance Monitoring Report Form) every February, May, August, and
November.
Any additional groundwater quality monitoring, as deemed necessary by the Division, shall be provided.
The COMPLIANCE BOUNDARY for the disposal system is specified by regulations in ISA NCAC 2L, Groundwater
Classifications and Standards. The Compliance Boundary for the disposal system constructed prior to December 31, 1983 is
established at either (1)!:500 feet from the waste disposal area, or (2) at the property boundary, whichever is closest to the
waste disposal area. An exceedance of Groundwater Quality Standards at or beyond the Compliance Boundary is subject to
immediate remedial action in addition to the penalty provisions applicable under General Statute 143-215.6A (a) (1).
In accordance with 15A' 1CAC 2L, a REVIEW BOUNDARY is established around the disposal systems midway between the
Compliance Boundary and the perimeter of the waste disposal area. Any excecdance of standards at the Review Boundary
shall require remedial action on the part of the Permittee.\

Enclosed are one original and two copies of the application for renewal of
our NPDES Permit # NC0006351 consisting of EPA Forms 1 and 2C and
one original and two copies of our Sludge Management Program. Per
instructions from your staff, only one copy of lab reports is enclosed.
The extremely variable weather patterns lately have made rainwater
estimates difficult. The Schematic of Water Flow for Form 2C shows
flows as best we can determine for normal weather patterns.
We are essentially applying for a permit that is unchanged from the one
that is in effect now.

SLUDGE MANAGEMENT PLAN

Sludge generated during the wastewater treatment process at the Site is allowed to settle
in the wastewater treatment holding lagoon #5 before the clear liquid is pumped through
the measuring and sampling weir to the river.
If it becomes necessary in the future to remove sludge from the #5 lagoon, it will be
properly profiled and sent to a secure industrial waste facility.
No other sludge is generated or disposed from the wastewater treatment process

NOTE 1
All parameters were analyzed for but only the ones that had "hits" were listed on the
form. All parameters not listed were reported from the lab as Non -Detect.
NOTE 2
Chlorine is not used on this Site. It has never been used on this Site. This result is
probably due to interference from oxidizing materials used at the Site such as hydrogen
peroxide or sodium nitrite.
NOTE 3
Domestic sewage does not flow to the waste treatment system. There is a separate drain
field for this flow. Fecal coliform is expected to be present from geese or other wildlife
that frequent the settling pond.
NOTE 4
Flouride is not used at this Site. This is probably naturally occurring in the process water
or is a minor contaminate in one of the process raw materials.
NOTE 5
Phenolics or cyanides are not used at this Site.
