You are correct, the project falls within the thresholds under item (g) of the GC 4263. Therefore, they will need an individual 401. Even though they indicated that the project is not
located within buffer areas, they still need to address post-construction stormwater impact to wetlands from a high-density development.

Good Afternoon Chonticha,
The US Army Corps of Engineers has received a Pre-Construction Notification application (attached) dated June 24, 2022, requesting to utilize the Nationwide Permit No. 39 for proposed
permanent impacts to 0.099 acres of wetlands associated with the construction of a sawmill and plane mill complex with large truck and vehicular access at a former power plant facility
that has been demolished and removed. The applicant’s agent considered the 401- General Water Quality Certification 4263 (GC 4263) to be deemed and did not request 401 review. Upon
review of the proposed plans, I wanted to make sure that a written individual water quality certification was not required due to Condition (g) of the GC 4263 not being met. Could please
provide me with some guidance?
