Colleen,
I have attached here a Statement of Availability for the buffer credits Mr. Hagerty requires, as outlined on your email correspondence on July 20th. When you are able, can you please
send out documentation verifying the buffer credit requirement? Once received, we'll continue to process/document the credit sale transaction with a Mitigation Credit Transfer Certificate
accordingly.
Thanks very much for everyone's help with this,
Daniel

Hi all,
I need a Statement of Availability, typically a letter on official letterhead, that contains bank name, bank sponsor, buffer credits needed, buffer credits available, and River Basin/HUC
code. Once provided, I can continue my review.
Please note that I will be out of the office until next Monday.
Thanks,
Colleen Cohn

I received the payment for the buffer mitigation for the after-the-fact Hagerty’s Pool project. I understand Mr. Hagerty will need to contact DEQ for additional authorization. I will
be on vacation for the next two weeks, so I ask that Daniel coordinate with Mr. Hagerty, Katie and Colleen.
I will hold the payment check until DEQ-DWR has issued the associated paperwork.

Hey Daniel,
You can provide a Statement of Availability to the permittee per Colleen’s needs indicated in the email from her below. However, credits cannot be sold and debited from the credit
ledger until DWR has issued a formal letter indicating the mitigation required and the acceptable Bank from which they can be purchased.
Once the letter is issued by DWR, MMI can debit/sell the credits to the permittee.
Thanks
Katie

Katie / Colleen,
We had a request come in for a minor after-the-fact buffer requirement (for an individual private landowner's backyard project). We are preparing to facilitate this buffer credit transaction
but I wanted to check with you to see if the email below from Colleen stating the credit requirement was sufficient documentation for the authorization. Essentially, I wanted to make
sure we had sufficient paperwork in place for the annual ledger audit when the time comes. Can you please confirm?
Thanks,
Daniel

Hello Kevin – As we discussed, MMI does have available Riparian Buffer Credits from our Tar River Headwaters Riparian Buffer and Nutrient Offset Mitigation Bank to satisfy the 135 sq.
ft. of buffer mitigation that you need in the TarPam 03020101 HUC. We will send you an Invoice for the 135 sq. ft. later today. Once you have made the payment, we will send you the Transfer
Certificates that you will need to send to Collen at DEQ.
Please feel free to forward this email to Collen for the Statement of Availability that she has requested.
If you have any questions just give me a call.

Hi Mr. Hagerty,
I apologize for the delay. It looks like this project will require mitigation. Impacts to Zone 2 are at a 1.5:1 ratio, so for 90 square feet of impacts, you will need 135 square feet
of mitigation. You will need to reach out to a mitigation bank and ask for a Statement of Availability for 135 square feet of impacts. Once you’ve received the Statement of Availability,
please forward a copy to me.
Based on the current available mitigation banks that service your area (HUC 03020101), it looks like you can reach out to the mitigation bank below:
There may be another mitigation bank that services the area that I’ve missed in my quick skim of this site: https://edocs.deq.nc.gov/WaterResources/DocView.aspx?dbid=0&id=2206931 <https://urldefense.com/v3/__https:/edocs.deq.nc.gov/WaterResources/DocView.aspx?dbid=0&id=2206931__;!!NloGYB4gzA2ciQ!JVo3JUa1_hpBs-8AfT_HpFHE-vhh25WWcj8trB-uSoioko_X0BSSRV9MfX0nlr5tJrmniKm2RcxOFDGs7cRJbOMQoqrN$>
. You’re looking for one that serves the Tar-Pamlico Basin in “Buffer Credit Service Area” 03020101.
If credits aren’t available, you can reach out to the Division of Mitigation Services: https://deq.nc.gov/about/divisions/mitigation-services/dms-customers/stream-wetland-buffer-ilf-programs
