PROJECT SUMMARY: Upland excavation of small peninsula, remove concrete, construction of a bulkhead, 10' wide timber wharf, remove existing docks & slips in upper basin, add 5 new slips & floating dock on south side of property, rebuild 2 courtesy piers next to existing unpaved boat ramp, & install a fuel tank with containment dike on upland area. Project Setting The applicant's property is located off NC 345 at 390 Harbor Road (Parcel #s 013331000— Lot 1, & 024855032—no Lot # assigned), in Wanchese, Dare County; adjacent Wanchese Harbor, a man-made basin leading to Mill Landing Creek (Mill Creek), which connects to the Roanoke Sound. These vacant lots (112,753 sf) comprise of ±960 linear feet (Ift) of shoreline with areas of rock riprap and an elevation of 5.5' above normal water level (NWL). Current development at this lot consists of crushed stone/gravel surface, a wooden shoreside dock along the end of the basin, a wooden shoreside dock along the northwest side of #390 parcel, courtesy piers along each side of an unpaved boat ramp, and a wooden dock on the southwest corner of #390 parcel. Vegetation along the shoreline consists of indigenous grass, pine trees, wax myrtle, cat briers, and patches of Phragmites (non 404) growing up the embankment. Both riparian properties are zoned commercial; the riparian property to the west is developed with a pier, shoreside dock/boardwalk, and slips; riparian property to the east is developed with piers, bulkheading, boardwalk, slips, and boat buildings. Permit history for the property included Major Permit #85-03, issued to Willie Daniels in 2003 docks, finger piers, and slips in the basin; General Permit #5147-A, issued to Willie Daniels for a dock and excavation in January 1989; and a Notice of Violation, Case #02- 46A, that was issued to Willie Daniels, Jr. and processed for major development of a dock in a man-made basin off Mill Creek at 390 Harbor Road. A scoping meeting was held on 08/12/22 with representatives in attendance from Construction Engineering Services, BBY Holdings, Division of Coastal Management, Division of Water Resources, NOAA Federal, and Division of Marine Fisheries. The USACE was unable to attend, but followed up with an email on 08/23/22 to confirm that the project area did not appear to have any 404 wetland vegetation along the project shoreline. The water classification for the adjacent water body of Mill Landing Creek (Mill Creek) is SC: Aquatic Life, Secondary Contact Recreation, and is part of the Pasquotank River Basin. The adjacent waterbody is designated as Coastal Waters, is closed to shellfish taking, and is not within a PNA. The depths adjacent the project area vary from -5.7 to -15 in the upper boat basin, and -5.2 to -7.5 in front of the peninsula that leads to the Harbor. Field Investigation Report: BBY Holdings, LLC, John Bayliss Page 3 Development Proposal The applicant proposes to make the following site improvements: • Remove all concrete, docks and 15 slips • Upland excavation of 2,257 sf of a small peninsula (removing 460 cubic yards (cy) • Excavation of 2,092 sf below NWL to a connecting depth of -7 along the area of the excavated peninsula (removing 543 cy) o Create a temporary 55'x55' dredge spoil area landward of the 30' buffer with silt fence in place • Installation of 879 Ift (1.5' wide) vinyl bulkheading an average distance of ±1' of NWL o It is noted that 5-7' of bulkheading will be constructed across the property line to tie into the adjacent, existing bulkhead owned by Bayliss Boatworks (applicant). • Construct a 10'x879' timber wharf landward of new bulkhead • Construct an 8'x96' floating dock • Replace 2 courtesy piers (15'x3' and 20'x3) adjacent the existing boat ramp • Install 15 tie pilings to create 4 slips (proposed in the area of the upland excavation, and placed perpendicular to the proposed timber wharf, each with a dimension of 80'x22'), and 1 wet slip parallel to the proposed timber wharf on the south shoreline. • 4 fuel dispensers along the shoreline landward of the wharf • Install a 12,000-gallon fuel tank with a retention dike (12' wide x 36'-8" long x 4' tall) landward of the 30' buffer Anticipated Impacts CS AEC (High Ground Habitat) . The timber wharf will shade 8,790 sf in this habitat • The fuel tank will cover 442 sf in this habitat. • The excavation of the peninsula will remove 2,257 sf of upland area. EVVIPTA AECs The construction of bulkheads and the backfill associated with the bulkheading will result in 879 sf of impact to shallow bottom habitat. The dock and piers will result in 873 sf of shading of open water habitat. The excavation below the peninsula will impact 2,092 sf of open water habitat. The project will consist of removal of an existing small peninsula of land at the southeast corner of the parcel to allow new bulkhead to align with the existing adjacent bulkhead and provide a straight bulkhead line across the south side of the property. The bulkhead will then extend northward up the west side of the parcel and then across the north side for a total of 879 LF of new bulkhead. The removal of the peninsula will involve 460 CY of upland excavation and 543 CY of dredging. This material will be stored on site and used to backfill some of the low areas behind the new bulkhead. The existing broken concrete rubble riprap along the existing shoreline will be removed to allow the installation of the new bulkhead. A 10 foot wide timber wharf will be constructed along the landward side of the bulkhead to provide work space for loading of components and rigging on to new and repaired vessels. The 10 foot width is re- quired to be able to maneuver carts and hand trucks bringing larger components to the boats for in- stallation. Boats will be temporarily tied up side to the bulkhead while these operations are taking place or while they are waiting their turn to be hauled out by the existing travelift on the adjacent property. Boats will also be temporarily tied along the bulkhead before and after being sea trialed after construction or after repairs are completed. There will be no permanent docking of boats along the face of the bulkhead. The project will also include the removal of existing docks and 15 existing slips in the upper basin and the addition of 5 new 80 foot slips and a 96' long by 8' wide floating dock along the south side of the property. There is an existing unpaved boat launch ramp just north of the southwest corner of the property which will remain and the two existing tending piers will be rebuilt. On the upland area of the site a 12,000 gallon fuel tank with a 12'x36'-8"x4' containment dike will be installed just behind the 30' CAMA buffer near the southwest corner. Also included is a letter from the owner of Fresh Catch, the property immediately to the southwest stating that the new 80 foot slips will not hinder his vessels from leaving or returning to his dock. A scoping meeting was held at which DWR was present. The date of the scoping meeting was August 12, 2022 and this project was discussed. This meeting met the requirement for requesting a pre -filing meeting under 40 CFR Part 121 for 401 Certifications in accordance with the federal Clean Water Act.
