The applicant still proposes .047 acres of 404 fill for the purposes of grading to accommodate a pool, landward of the 75' AEC. With these changes, the applicant is now proposing an elevated walkway across the area to access a to be constructed docking facility. Let me know your thoughts, and Holley I believe USACE will be able to go nationwide on this but will let him verify. Patrick, Greg, and Cameron, Mr. Bednarz would like to confirm that with appropriate local approval that he can clear/grade his lot on Oak Island (124 SW 4th St.). He is not proposing fill or excavation just to cut vegetation to grade. Also, take a look at the attached drawing with no fill proposed within 75' AEC and a 6' wide raised walkway to access the docking facility. Pending USACE approval (nationwide) to fill the area landward of 75' AEC (less than 0.10 of an acre) which requires no mitigation, would we need to go through with the CAMA Major because the only structure within the AEC is now the 6' raised boardwalk? Could we get that permitted under a CAMA Minor or as a tag -along to the active General Permit for the docking facility? As it stands now we are waiting for Corps approval which is more likely to be granted with proposed fill landward of 75' AEC (adjacent to proposed pool).
