Hi Steve,
I've reviewed the plans and discussed with DWR that the plans are not adequate. The pipe in lot 6 does not connect to
the wetlands; it's within the fill footprint. There's no connectivity purpose of the pipe between lots 15 and 3 since the
wetlands in lot 15 would be filled. That culvert could be removed if not necessary for your stormwater management, but it
appears it would go uphill to connect to the swale on lot 3. The pipe between lot 3 and 6 is also within the fill footprint. If
you move the pipes out of the swale/fill footprint to connect to the wetlands and can provide an elevation view of each
showing a slope of 0, that would be acceptable.
We have reviewed several iterations, and the same concerns have not been addressed. If you cannot provide the
information necessary and the impacts would exceed the 0.5-acre threshold with impacting the remaining wetlands, then
you'll need to submit an Individual Permit. Otherwise, you'll need to modify the plans to reduce the impacts to allow clear
hydrologic connectivity/aquatic passage if it cannot be completed with the current design. Please let me know if you have
any questions.

The markup doesn't provide any elevations, so it still appears Section A would have to go uphill to the added ditch and
Section C would have to go uphill through the culvert to connect to the added ditch. Could you install two culverts that
would directly connect to the wetlands? If we cannot determine that wetlands would maintain hydrologic
connectivity/aquatic passage with the road as proposed, you may need to modify the plans to avoid/minimize impacts to
the wetland.

Please see the attached — my most recent response/comment focuses on Wetland C and the remaining wetlands with the
proposed road construction. There would be wetlands remaining within Lots 3 and 6, and the swales do not appear to be
sufficient to provide and maintain aquatic passage/hydrologic connectivity. From my understanding, a pipe would connect
the remaining wetlands in Lot 3 to a swale along Lot 15, where wetland fill is proposed at this time. This does not show
how hydrologic connectivity/aquatic passage would be maintained with the wetlands between Lots 5 and 6. The remaining
wetlands in Lot 6 would have to go uphill to connect to the swale (8.1 4 8.5), and then the swale would be uphill (8.5 4
9.5) to connect to the wetlands in Lots 5 and 6. A potential solution to this issue would be to construct culverts that would
allow direct connection from the two remaining wetlands in Lots 3 and 6 to the proposed unimpacted area of Wetland C
between Lots 5 and 6. Another solution would be modify the proposed plans to avoid "isolating" wetlands.

Give me more detail in your thinking. Wetland B is not connected now. Wetland A is connected to the top of
the bank of the ditch in the rear. Wetland C has one point of connection to the top of the bank at the rear of

Robert and I discussed the plans and, it is still hard to determine whether the remaining wetlands in Lots 3 and 6 would be
connected and maintain connectivity to the wetlands bordering Lot 5/6 utilizing swales. Installing culverts may be the best
way to ensure maintained connectivity. Would the interested buyers be provided the delineation/plans? Is there enough
room on Lot 6 to construct a driveway without filling wetlands? The concern is that the owners of Lots 3, 6, and 8 may
inadvertently fill wetlands when designing/building their houses.

I coordinated with the project engineer regarding your comments and have the following responses.
Aquatic life movements: The remaining wetland areas will be connected via roadside swales. See attached plan with
arrows indicating connection.
Avoidance and minimization: The engineer attempted to avoid and minimize impacts as much as possible.
Unfortunately, the wetland pocket to be impacted is located in the middle of the site and it was not possible to avoid it
without losing several lots, which would have made the project economically infeasible. The lots were laid out to place
septic systems in suitable soils. The attached site plan includes suitable/unsuitable soils with the lot layout that helps to
demonstrate this.

culverted, bridged, or otherwise designed and constructed to maintain low flows to sustain the movement of those
aquatic species. If a bottomless culvert cannot be used, then the crossing should be designed and constructed to
minimize adverse effects to aquatic life movements."
It appears that more efforts to avoid/minimize impacts to aquatic resources need to be explored.
